The following Notification shall be published in the Telangana Gazette.

NOTIFICATON
In the Government Order 3rd read above, permission has been accorded
to the Secretary, Telangana State Council of Higher Education, Hyderabad for
Shifting of Global Degree College, Kamkole, Medak District from one leased
building at H.No.580, Kamkole (V), Munipally (M), Medak District to another
leased building at H.No.1-6-29/4/1, Gunj Road, Sadasivapet, Medak District,
from one Non-notified Rural Mandal to another Non-notified Rural Mandal in
Medak District from the academic year 2014-15.

In the reference 4th read above, aggrieved by the above Government
Orders, Sri Padmanabha Degree College, Sadasivpet, Medak District has filed
W.P.No.25793 of 2014 before the High Court of Telangana & A.P., Hyderabad
with a prayer to Declare the G.O. Rt No.87, HE (CE) Deptt., dt:21.8.2014 as
illegal.. The Honble High Court in its order dt:4-9-2014
in W.P.
No.25793/2014has directed the respondents to show cause as to why in the
circumstances set out in the petition and the affidavit filed this WP should not
be admitted and the Honble High Court made the following Order:Notice before admission returnable in six weeks. But however, in
view of the Judgement rendered in WP No.19620 of 2014, on 26.8.2014,
wherein an identically worded order passed by the State Government
contained in G.O.Rt No87, HE (CE) Deptt., dt:21-8-2014 has been setaside and the matter was remanded back for consideration afresh duly
taking into consideation and account the principles enunciated by the
Divisional Bench in Sadasiva Sri Educational Society, Siricilla,
Karimnagar District v. Gayathri Degree College, Yellreddypet Mandal,
Karimnagar district (2013 (2) ALD 612 (DB)), the operation of the
impugned order in this case G.O.Rt No.87 Higher Education (CE) Deptt.,
dt:21-8-2014 is suspended. However, it is made clear that it shall be
open to the State Government to re-examine the matter, keeping in
view the principles enunciated by the Divisional Bench in the afresh
Sadasiva Sri Educational Society case and pass orders afresh.

In the reference 5th read above, the Secretary, A.P. State Council of
Higher Education, Hyderabad has stated that the shifting proposal of Global
Degree College, Kamkole, Medakd District for shifting of the college from one
leased building at D.No: 580, Kamkole (V), Munipally (M), Medak District to
another leased building at H.No:1-6-29/4/1, Gunj Road, Sadasivapet, Medak
District has been examined on the order of the Honble High Court in WP
No.25793/2014, Dt:4-9-2014. The data collected by the APSCHE to study the
feasibility of sanctioning new degree colleges for the academic year 2014-15 as

The Secretary, APSCHE, Hyderabad has further stated that the
surrounding Mandals such as Kondapur, Munipalli, Pulkal in Medak Dist have
Eight (08) Junior Colleges with 189 inter pass outs. The inter pass outs from
these Mandals usually join in the Degree Colleges of Sadasivpet (M), as there
are no Degree Colleges in these surrounding Mandals. Hence, the total number
of pass outs in Junior Colleges in Sadasivapet Mandal and surrounding Mandals
(841) are higher (223) than the intake in the existing Degree Colleges (618).

The Secretary, APSCHE, Hyderabad has further stated that the reasons
for shifting of the Global Degree College, Kamkole, Medak Dist from one leased
building at D.No: 580, Kamkole (V), Munipally (M), Medak District to another
leased building at H.No:1-6-29/4/1, Gunj Road, Sadasivapet, Medak District, is
as follows:a) The Management of the College proposed to shift the college due to lack
of students at Sadasivapet (M), Medak Dist.
b) To provide better accommodation and facilities to the students.
c) The surrounding Mandals of Sadasivapet (M) i.e., Kondapur, Munipalli in
Medak Dist nearer to Sadasivapat (M) are not having any degree
colleges.
d) The difference between pass outs in Junior Colleges and Degree Colleges
intake enables the Government to consider the shifting of the College.

After careful examination of the proposal, keeping in view Honble High
Court order in the reference 4th read above and in exercise of the powers
conferred by Section 100 of the Andhra Pradesh Education Act, 1982 (Act No.1
of 1982), the Government of Telangana State hereby accord permission to the
Secretary, A.P. State Council of Higher Education /Telangana State Council of
Higher Education, Hyderabad for Shifting of Global Degree College, Kamkole,
Medak District from one leased building at H.No.580, Kamkole (V), Munipally
(M), Medak District to another leased building at H.No.1-6-29/4/1, Gunj
Road, Sadasivapet, Medak District, from one Non-notified Rural Mandal to
another Non-notified Rural Mandal in Medak District from the academic year
2014-15, in relaxation of sub-rule (3) of Rule 14 of the A.P. Educational
Institutions (Establishment, Recognition, Administration and Control of
Institutions of Higher Education) Rules, 1987, issued in G.O.Ms.No.29,
Education, dated:05-02-1987.

The Secretary, A.P. State Council of Higher Education /Telangana State
Council of Higher Education, Hyderabad shall take further action in the matter
accordingly.
