General (OAG) seeking access to: "all emails exchanged between Bruce Solomon at the Office of the Attorney

"christopherchristie1@yahoo.com," "International Business Times," "IBTimes" or "Sirota." I am seeking these
emails from the dates 8/27/2015 to the present. Please understand fellow OPRA custodians to include: Lauren
Zarrillo (Division of Law), Matthew Coefer (Department of Environmental Protection), Heather Taylor (Office of
the Governor), Robert McGrath (Division of Criminal Justice), Donna Fletcher-Lugo (Department of Education),
Cynthia Jablonski (Department of the Treasury), Matthew Noumoff (Department of Banking and Insurance) and
David Fish (Department of Labor and Workforce Development)." In a telephone conversation on September
18, 2015, you acknowledged that you filed similar requests with the agencies listed in this request and agreed
that OAG's response can serve as the response on behalf of those other public agencies with whom you filed
this request.
I have conducted a thorough search of OAG e-mail records and files. The records listed above are responsive
to your request. Upon review, the majority of the records listed above are exempt from access as they contain
inter/intra agency advisory, consultative, deliberative material. In Education Law Center v. New Jersey
Department of Education, 198 N.J. 274, 280 (2009), the Supreme Court of New Jersey held that a record,
which contains or involves factual components, is entitled to deliberative-process protection when it was used in
the decision-making process and its disclosure would reveal deliberations that occurred during that process.
Justice LaVecchia, writing for the Court, concluded that the deliberative process privilege permits the
government to withhold documents that reflect advisory opinions, recommendations, and deliberations
comprising part of a process by which governmental decisions and policies are formulated. Id. at 285. Justice
LaVecchia went on to write, [t]he essence of the privilege is simple, its rationale built on powerful logic. . . . the
privilege is necessary to ensure free and uninhibited communication within governmental agencies so that the
best possible decisions can be reached. Id. at 286. "So long as disclosure of such material would reveal the
nature of the deliberations that occurred during the agencys processes, the material is entitled to the protection
of the deliberative process privilege. Id. at 296.
