AN ORDINANCE IMPOSING THE REGULATION ON FARE OF MOTORIZED TRICYCLE FOR HIRE


(MTH) OF THE CITY OF DIGOS
Be it ordained by the Sangguniang Panlungsod of Digos City in session assembled that:

SECTION 1. TITLE This Ordinance shall be known as An Ordinance imposing the


Regulation of Fare Rates of Motorized Tricycle for Hire (MTH) in the City of Digos
SECTION 2. The Transportation plays a vital and significant role in our economy in the
public movement of goods and products and more particularly in the movement of individuals
or public in the delivery of its services.
SECTION 3. The Tricycle Section in the City of Digos represents the biggest number of
public transportation in developing and promoting inter-modal and strategic transportation
that are reliable, responsive and viable service to the public.
SECTION 4. And that due to the fluctuating prices of Gasoline per liter, it is but proper
that the fare rates of the said Motorized Tricycle for Hire (MTH) shall be based on the price
rates of Gasoline per liter in Digos City as follows:

The above rates shall be applied within poblacion area. Outside the poblacion
area, a reduction of Php 1.50 shall be imposed from its existing fare rate. And for every Php
1.00 increase or decrease within the poblacion area on the basis of the range of price rates of
gasoline per liter in the City of Digos.

SECTION 5. The City of Digos Franchising and Regulatory Board (CDFRB) of this City is
responsible in implementing the provision under Section 4 of this Ordinance through its Board
Resolution.

SECTION 6. REPEALING CLAUSE Any Ordinance/s Resolution/s or parts thereof


inconsistent herein are hereby repealed accordingly.
SECTION 7. EFFECTIVITY CLAUSE This Ordinance shall take effect immediately upon its
approval.

AN ORDINANCE PRESCRIBING THE NEW MOTORIZED FARE IN THE CITY OF DIGOS, DAVAO DEL
SUR AND PROVIDING PENALTIES FOR VIOLATION THEREOF
Be it ordained by the Sangguniang Panglungsod of the City of Digos in session
assembled, that:
ARTICLE I: ORDINANCE POLICY AND OBJECTIVES
SECTION 1. TITLE This Ordinance shall be known as An Ordinance imposing the Regulation of
Fare Rates of Motorized Tricycle for Hire (MTH) in the City of Digos
SECTION 2. APPLICABILITY, SCOPE AND PURPOSE This applies to all Tricycles plying in the City
of Digos to regulate the fare collection and to provide the operator and
driver a reasonable return of profit, and still be affordable to the general
public.

SECTION 3. DEFINITION OF TERMS


a) TRICYCLE-FOR-HIRE is a motor vehicle composed of a motorcycle filled with a single
wheel side car or a motorcycle with a two wheel cab operated to render
transportation services to the general public for a fee.
b) MOTORCYCLE TRICYCLE OPERATORS PERMIT or MTOP is the document granting
franchise or license to operate issued to a person, natural or judicial,
allowing him/it to operate tricycle for hire over zones specified therein.
c) ZONE is a contiguous land area or block, say as subdivision or a barangays or street,
where a tricycle for hire may operate without a fixed origin and
destination.
d) SENIOR CITIZEN any resident of the Philippines, at least 60 years old, including those
who have retired form both government offices and private enterprises
and has an income of not more than Sixty Thousand Pesos(P 60,000) per
annum subject to review by the National Statistic Coordination
Board(NSCB) every (3) years.
e) DISABLED PERSON - any person who has disability or incapacity, physically or mentally.
f) STUDENT any person who attends school, colleges and/or universities.
g) DISCOUNT a privilege granted to an individual as provided by existing laws.
ARTICLE II: FARES
SECTION 1. RATES The fares shall be established at a level that will provide the operator and
driver a reasonable return profit, and still be affordable to the general
public.
SECTION 2. SENIORS CITIZENS, DISABLED PERSONS AND STUDENTS PRIVILEGE - For senior
citizens, disabled persons and students, a discount of 20% as prescribed
by law should be observed.
SECTION3 POSTING OF FARE TABLE The table of fares should be posted prominently at the
tricycle terminals and in a conspicuous place inside the vehicle visible to
the passengers.
SECTION 4. SCHEDULE OF TRICYCLE FARE The following schedule of Tricycle fare is hereby
adopted with corresponding routes or zone:

ARTICLE III PENAL PROVISION:


SECTION 1. Any violation to the above provisions or unauthorized increase of fare shall
be penalized in the following manner:
First Offense
Second Offense
Third Offense

or imprisonment or
both such fine and
imprisonment, at the
discretion of the
court.

SECTION 2. Failure on the part of the violator to pay the fine as herein provided shall be
sufficient ground for the City to cause the impounding of the vehicle
involved, without necessity of any court proceedings.
SECTION 3. Provided that if the violator is a judirical entity, its president, manager, or
officer responsible therefore shall be penalized accordingly.
ARTICLE IV REPEALING CLAUSE:
SECTION 1. All ordinances, resolutions and executive orders, or part or parts thereof
which are inconsistent with any of the provisions of this ordinance are
hereby repealed or modified accordingly.
ARTICLE V SEPARABILITY CLAUSE:
SECTION 1. If, for any reasons or reasons, any part or provision of this ordinance shall be
held unconstitutional and invalid, other part or provisions hereof which
are not affected thereby shall continue to be in full force and in effect.
ARTICLE VI EFFECTIVITY CLAUSE:
SECTION 1. This ordinance shall take effect after the required publication and posting
pursuant to Section 511 of the Local Government Code.
