I.
Instructions to Bidders
The Boulder County Transportation Department is seeking proposals from qualified vendors for Engineering
Design of Roadway Intersection Improvements on 95th Street in the unincorporated County as specified in this
document.
Submittals are due at the Administrative Services Front Desk located at 2025 14th Street, Boulder, CO or the
email box (preferred) listed below, for time and date recording on or before 2:00 p.m. on Friday, August 17,
2012.
All inquiries regarding the Request for Proposal shall be submitted, in writing, to the Purchasing Office via
email to purchasing@bouldercounty.org with RFP 5678-12 Questions in the subject line, by 4:00 p.m. on
Monday, August 6, 2012. A response from Boulder County to all inquiries shall be emailed to all known
vendors no later than 4:30 p.m., Thursday August 9, 2012. Only questions submitted through this process can
be relied upon.
Your response can be submitted in the following ways. Please note that e-mail responses to this solicitation are
preferred, but are limited to a maximum of 25MB capacity. Electronic Submittals must be received in the e-mail
box listed below. Submittals sent to any other box will NOT be forwarded or accepted. This e-mail box is only
accessed on the due date of your questions or proposals. Please use the Delivery Receipt option to verify receipt

All RFPs must be received and time and date recorded by authorized county purchasing staff by the above due
date and time. Sole responsibility rests with the bidder to see that their response is received on time at the stated
location(s). Any responses received after due date and time will be returned to the bidder.
The Board of County Commissioners reserves the right to reject any and all responses, to waive any
informalities or irregularities therein, and to accept the proposal that, in the opinion of the Board, is in the best
interest of the Board and of the County of Boulder, State of Colorado.

Proposers are expected to examine the drawing, specifications, schedule of delivery, and all instructions.
Failure to do so will be at the proposers risk.

The Contract/Purchase Order will be awarded to that responsible proposer whose submittal, conforming

to the Request for Proposals, will be most advantageous to the County of Boulder, price and other
factors considered.

The County of Boulder reserves the right to reject any or all RFPs and to waive informalities and minor
irregularities in responses received, and to accept any portion of or all items proposed if deemed in the
best interest of the County of Boulder to do so.
5.
No submittal shall be withdrawn for a period of thirty (30) days subsequent to the opening of bids
without the consent of the County Purchasing Agent or delegated representative.
6.
A signed purchase order or contract furnished to the successful bidder results in a binding contract
without further action by either party.
7.
Late or unsigned proposals will not be accepted or considered. It is the responsibility of bidders to
insure that their proposal arrives at the designated place prior to the time indicated in the Request for
Proposals.
8.
The proposed price shall be exclusive of any Federal or State taxes from which the County of Boulder is
exempt by law.
9.
Any interpretation, correction or change of the RFP documents will be made by Addendum.
Interpretations, corrections and changes of the bid documents made in any other manner will not be
binding, and bidder shall not rely upon such interpretations, corrections and changes. The Countys
Representative will not be responsible for oral clarification.
10. Confidential/Proprietary Information: RFPs submitted in response to this Request for Proposal and
any resulting contract is subject to the provisions of the Colorado Public (Open) Records Act, 24-72-201
et. seq., C.R.S., as amended. Any restrictions on the use or inspection of material contained within the
bid and any resulting contract shall be clearly stated in the bid itself. Any restrictions on the use or

separated/packaged from the rest of the bid. Co-mingling of confidential/proprietary and other

cannot be considered confidential.
11. Boulder County promotes the purchase/leasing of energy efficient, materials efficient and reduced toxic
level products where availability, quality and budget constraints allow. Bidders are expected whenever
possible to provide products that earn the ENERGY STAR and meet the ENERGY STAR specifications
for energy efficiency with power management features enabled. Bidders are encouraged to offer
products and equipment with post-consumer recycled-content materials. Products should be packaged
and delivered with a minimum amount of recycled packaging that adequately protects the product, but is
not excessive.
III.
Scope of Services
The services will consist of surveying; detailed road design generally consisting of overall plan
preparation, drainage evaluations, geotechnical investigation and report, specification preparation;
structural design; environmental evaluation and permitting; public process; and right-of-way services.
A detailed Scope of Work can be found in Appendix A.

IV.
Submittal Requirements
Qualified consultants interested in performing the work described in this request for proposals should
submit the following information to the County in the order described.
1. Qualifications of your firm and all staff (including sub-consultants) proposed to perform the work
on this project. Include details of experience your firm has with road design; structural engineering;
rights of way identification; and drainage analysis.
2. A list of similar projects completed in the last seven years. Particular relevant are projects with
federal construction funding.
3. A list of critical issues that the consultant considers to be of importance for the project.
4.
A scope of work for the proposed design and management of the project. Include an approach to
quality control, project management, and team communication. Upon award of selection, the scope of
work will be revised with County staff to formulate the final scope of work for the project.
5. References from at least three other projects with similar requirements that have been completed
within the past seven years and that have involved the staff proposed to work on this project. As
part of the reference check process, the County may choose to visit one or more of the listed
projects and/or request a copy of the plans and documentation completed.
6. A sample plan and profile sheet(s) of a similar project. Examples should be no smaller than
11x17.
7. Consultants willingness to enter into the Boulder County Standard Contract Agreement included in
Appendix E.
8. An all-inclusive itemized budget for each of the major phases in the Scope of Work, namely A
through H.

V.
Selection Criteria
A committee of Boulder County Transportation staff will evaluate proposals received and select the consultant
team. After consultant selection Boulder County will enter into any necessary negotiations to reach a final
contract.
The consultant providing the best value to Boulder County will be selected; the lowest-cost bidder will not
necessarily be selected. Evaluation criteria that will be used are as follows:

b. Details of expertise/strengths to complete the scope of work
c. Experience on projects with federal construction funding
d. References from other similar projects
2. Cost
a. The itemized budget for each phase in the Scope of Work (A through H).

PROJECT DESCRIPTION AND SCOPE OF WORK
95TH STREET INTERSECTION IMPROVEMENTS
PROJECT DESCRIPTION
Boulder County is seeking a design for improvements to the off-set intersections at
95th Street and Isabelle / Valmont Road in the unincorporated County. The goal of
the project is to improve multimodal safety and reduce crashes and to increase
efficiency and operations of the intersection. Preliminary plans have identified the
need for additional lanes at each of the two intersections as well as a traffic signal at
Valmont Road intersection.
Funding for design comes completely from local sources. Funding for construction
includes FY15 Federal Hazard Elimination and Safety (HES) funding.
The County is requesting a topographical survey and Land Survey Plat that meet
Federal design plan criteria; an FIR and FOR design processes; ROW plans (uniform
act) for an estimated eight (8) parcels; utility notifications and coordination; and
final construction documents for the intersections and proposed traffic signal.
PROJECT LIMITS
The project area includes 50 feet either side of the 95th Street Right of Way from
1,000 feet north of the Valmont Road intersection to 1,000 feet south of the Isabelle
Road intersection; the entire Isabelle Road right-of-way including 100 south of the
road centerline for 3,000 feet east of 95th; and the entire Valmont Road right-of-way
for 1,000 feet west of 95th Street. See Appendix B for a map of the approximate
project limits.
CONCEPTUAL PLAN
Boulder County completed a conceptual design along with lane assessments and
Level-of-Service analysis in March 2012. The conceptual recommendations include:

foot contour intervals. The survey should identify county right of way as well as
adjacent ownership labeled with both property owner name and address. The
Project Limits identified above should be used as a guide for the extent of the
survey however the consultant should recommend and include additional survey
if deemed necessary.
Survey information is to be given to Boulder County in both the form of hard
copies and electronic files using the survey guidelines contained in Appendix C
Boulder County Transportations Survey Guidelines for Outsourced Design.
Project control shall be tied to the nearest Colorado High Accuracy Reference
Network Station (HARN). CDOT Region 4 has information regarding existing
HARN points near the project locations and no additional HARN Densification
stations are anticipated.
C. Reports
The following studies and reports will be included in the deliverable products for
this project.
1. Geotechnical Report Provide a geotechnical report showing the results
of approximately seven (7) boring logs including one at each irrigation
structure on Isabelle east of the intersections. Recommend two 20-year
pavement life pavement designs for both 95th Street and Isabelle.
2. Drainage Report - Prepare a report addressing the hydraulic and drainage
impacts of extending identified existing irrigation structures and cross
culverts. Include calculations and sketches of existing and proposed
hydraulic structures.
3. Utility Investigation Report Prepare a report that identifies the
required utility coordination for the preferred design. Submit notification at
approximately 30%, 60% and 95% complete construction plans, at no less
than 30-day intervals. This is anticipated to include existing and proposed
facilities, and potential conflicts. Comments and solutions proposed by
public
and
private
utility
companies,
such
as
irrigation,
telecommunications, gas and electric, etc. shall be incorporated into the
final design.
4. Review existing Traffic Report Boulder County will provide the
selected consultant with the intersection LOS analysis completed in March
2012. Confirm signal warrants and initial geometric improvements.
D. Environmental
Prepare documents in accordance with the requirements of the current federal
and state regulations including the National Environmental Policy Act of 1969
(NEPA). For NEPA documentation the project will likely qualify as a Categorical
Exclusion. Work includes all preparation and submittal of required documents.

E. Design Phases
General Plan Development Requirements
The plan development for this project shall conform to CDOT specifications, and
the documentation shall comply with Federal Highway Administration (FHWA)
and CDOT requirements for administration of related Local Agency contracts and
funding. Electronic files of a title sheet, a CDOT Standard Detail Sheet, a typical

legend sheet and a standard general notes sheet will be provided by Boulder
County. Submit reproducible full-size (24 x 36) and half-size plan sheets of
the 30% plan sheets for review.
The design criteria shall conform to:
Boulder County Multi-Modal Transportation Design Standards
Manual on Uniform Traffic Control Devices (MUTCD), latest edition
American Association of State Highway and Transportation Officials
(AASHTO) 1999 Guide for the Development of Bicycle Facilities, 3rd Edition
AASHTO Road and Intersection Design Manual
Other criteria which may be necessary for this work
Consultant will work with the ditch companies to determine their infrastructure
requirements for areas affected by the project. These requirements shall be
reflected in the plans. Boulder County will manage any legal agreements needed
for final design.
Conceptual Design Phase (30%)
The conceptual design phase shall include approximately 30% complete design
plans with typical sections. Show the preliminary layout of proposed lane
location and length; bicycle and pedestrian facilities; signal poles; utilities; and
culverts, along with the potential realignment of Isabelle Road. Proposed rightof-way acquisitions shall be identified based on recommended lane geometry.
Plans shall be in CDOT format.
Development Design Phase (60%)
An intermediate set of construction documents shall be submitted at
approximately 60% of design completion. This shall include typical crosssections, signal location, plan and profile sheets, drainage plans and
pipe/culvert profiles, storm and erosion control plans, utility plans, traffic control
plan, technical specifications and project special provisions, revised general
notes, and an estimate of earthwork quantities. Input from the first public open
house should be reflected in this design set.
Also included will be preliminary right-of-way and/or easement procurement
documents (legal descriptions, exhibits, etc.) for up to eight parcels.
Procurement of these parcels will be handled by others.
Provide an Engineers cost estimate, commensurate with the level of detail of
this design stage, with the plans and electronic files. Use standard CDOT pay
items as a basis for the engineers estimate.

G. Right-of-Way Plans
Consultant shall develop CDOT Right-of-Way plans for all required right-of-way
for an estimated eight parcels.
Also provide one set of compact discs (CDs) or DVDs containing electronic
copies of final construction plans and specifications, both in AutoCAD and
Microsoft WORD and in .pdf format. All non-pdf files shall be interactive
files, not read only. Copy the final Engineers Opinion of Cost spreadsheet
on these discs in electronic format.
One hard copy of the final Engineers Opinion of Cost, stamped and signed
by a Professional Engineer, registered in the state of Colorado.

BOULDER COUNTY TRANSPORTATION
SURVEY GUIDELINES FOR OUTSOURCED DESIGN
The following information is intended to be a guideline for outside
consultants/contractors which are providing survey or design
services to Boulder County Transportation.
a. The electronic drawing file must be in AutoCAD release 2010, 2011 or 2012. A CD
containing the CAD done for the project must be submitted to the County Engineer.
We prefer to have the CAD in AutoCAD Civil 3D. A third party may be utilized to
convert original CAD elements and files into an acceptable Civil 3D format. If the
files can only be delivered in regular AutoCAD format, the Consultant needs to
provide LandXML files of all proposed and existing surfaces, alignments, and
profiles.
b. If the Consultants accomplishes the surveying needed for the project, an electronic
ASCII file with point number, northing, easting, elevation and description. Survey
files ending in .txt or .csv work well for us. Survey point data files must have survey
point descriptions in an understandable alpha description in both the provided
survey data file and when viewed within AutoCAD. CDOT type TMOSS numerical
coded survey point descriptions will not be accepted. Provide a list of
commonly used acronyms, i.e. EOP=Edge of Pavement, tel ped or TR=
telecommunications pedestal, etc.
c.
The file shall be in model space (not paper space) with 1' contours as continuous.
Planimetric features and break-lines (survey points connected with 3D polylines
along the roadway centerlines, edge of pavement, ditch lines, etc., for use in
surface modeling) must also be provided. All objects and entities must be
recognizable within AutoCAD.
d. Use Simplex.shp Fonts. AutoCAD Civil 3D does not easily except certain fonts
used in MicroStation.
e. Layers may contain only one type of information, i.e. gas lines, layer may only have
polylines showing location of gas lines, with no text or other information on the
layer. Layer naming must clearly describe the following: entity name, new or
existing, above or underground. Use consistent naming conventions through the
drawing layers.
f.
AutoCAD Plot styles must be an *.stb format. All *.stb plot styles, font, and line
type styles must be submitted to the County to assure future plots of the submitted
AutoCAD plots the same when the County plots the drawings. Please note that
when *.ctb are converted to *.stb format, the line widths will stay the same.

a.
The County, in its sole discretion, may elect to extend the term of this
Contract. In the event the County elects to exercise this right, it shall
send written notice to Contractor, pursuant to paragraph 15, of its
intent to extend the term of the Contract. The notice shall set forth the
length of the extension.

parties shall execute a written agreement no later than thirty (30) days
before the expiration of this Contract.
c.
All of the provisions of this Contract shall remain in full force and effect
during any extension or renewed term except that the scope of services
and compensation to be paid to Contractor during any extension or
renewed term shall be mutually agreed upon prior to the
commencement of any extension or renewed term. The agreed upon
scope of services and compensation shall be reduced to writing, signed
by both parties, and attached to this Contract.

Should the parties fail to agree upon the scope of services or
compensation to be paid to Contractor for any extension or renewed
term, or should Contractor fail to submit the required documents within
the time period specified in paragraph 5(d), then this Contract shall
terminate at the end of the then current term and no extension or
renewal of the term of the Contract shall occur.
6.
Quality of Performance: The Contractor shall perform the Contract in a
manner satisfactory and acceptable to the County. The County shall be the sole judge
of the quality of performance. The design work under this contract shall be compatible
with the requirements of a separate contract between the Local Agency and the State
(which is incorporated herein by this reference) for the design/construction of the
project. The State is an intended third party beneficiary of this contract for that
purpose. The consultant shall review the construction contractors shop drawings for
conformance with the contract documents and compliance with the provisions of the
States publication, Standard Specifications for Road and Bridge Construction, in
connection with this work.
7.
Schedule of Work: The Contractor shall perform the Work during the
hours designated by the County so as to avoid inconvenience to the County and its
personnel and interference with the County's operations.
8.
Indemnity: The Contractor shall be liable and responsible for any and
all damages to persons or property caused by or arising out of the actions,
obligations, or omissions of the Contractor, its employees, agents, representatives or
other persons acting under the Contractor's direction or control in performing or
failing to perform the Work under this Contract. The Contractor will indemnify and
hold harmless both the County and the Colorado Department of Transportation, its
elected and appointed officials, and its employees, agents and representatives (the
"indemnified parties"), from any and all liability, claims, demands, actions, damages,
losses, judgments, costs or expenses, including but not limited to attorneys fees,
which may be made or brought or which may result against any of the indemnified
parties as a result or on account of the actions or omissions of the Contractor, its
employees, agents or representatives, or other persons acting under the Contractors

11.
Nondiscrimination Provisions Binding on Subcontractors:
In all
solicitations by the Contractor for any Work related to this Contract to be performed
under a subcontract, either by competitive bidding or negotiation, the Contractor
shall notify each potential subcontractor of the Contractor's obligations under this
Contract, and of all pertinent regulations relative to nondiscrimination and unfair
employment practices.
12.
Information and Reports: The Contractor will provide to authorized
governmental representatives, including those of the County, State and Federal
Government, all information and reports which they may require for any purpose
authorized by law.
The Contractor will permit such authorized governmental
representatives access to the Contractor's facilities, books, records, accounts, and
any other relevant sources of information. Where any information required by any
such authorized government representative is in the exclusive possession of a person
other than the Contractor, then such Contractor shall so certify to the County, and
shall explain what efforts it has made to obtain the information. Upon advertisement
of the project work for construction, the consultant shall make available services as
requested by the State to assist the State in the evaluation of construction and the
resolution of construction problems that may arise during the construction of the
project.
13.
Independent Contractor: The Parties recognize and agree that the
Contractor is an independent contractor for all purposes, both legal and practical, in
performing services under this Contract, and that the Contractor and its agents and
employees are not agents or employees of Boulder County for any purpose. As an
independent contractor, the Contractor shall be responsible for employing and
directing such personnel and agents as it requires to perform the services purchased
under this Contract, shall exercise complete authority over its personnel and agents,
and shall be fully responsible for their actions.
Contractor acknowledges that it is not entitled to unemployment insurance
benefits or workers compensation benefits from Boulder County, its elected
officials, agents, or any program administered or funded by Boulder County.
Contractor shall be entitled to unemployment insurance or workers
compensation insurance only if unemployment compensation coverage or
workers compensation coverage is provided by Contractor, or some other
entity that is not a party to this Contract. Contractor is obligated to pay
federal and state income tax on any monies earned pursuant to this
Contract.

the control of the Board of County Commissioners as the funding entity, funds are
not allocated for any fiscal period beyond the one in which this Contract is
entered into, the County shall have the right to terminate this Contract by
providing seven (7) days written notice to the Contractor pursuant to paragraph
15, and will be released from any and all obligations hereunder. If the County
terminates the Contract for this reason, the County and the Contractor shall be
released from all obligations to perform Work and make payments hereunder,
except that the County shall be required to make payment for Work which has
been performed by the Contractor prior to the effective date of termination under
this provision; and, conversely, the Contractor shall be required to complete any
Work for which the County has made payment prior to providing written notice to
the Contractor of the termination.
b.
The preceding provisions notwithstanding, the County may
terminate this Contract, either in whole or in part, for any reason,
whenever the County determines that such termination is in the
Countys best interests. Such termination shall be effective after the
County provides seven (7) days written notice to the Contractor
pursuant to paragraph 15.
c.
In the event the County exercises either of the termination rights
specified in paragraphs 14(a) or 14(b), this Contract shall cease to be of
any further force and effect, with the exception of all Contract remedies
which are specified herein and may otherwise be available to the parties
under the law, and with the exception of any rights or liabilities of the
parties which may survive by virtue of this Contract.
15. Notices:
For purposes of the notices required to be provided under
paragraphs 5, 9, and 14, all such notices shall be in writing, and shall be either sent
by Certified U.S. Mail - Return Receipt Requested, or hand-delivered to the following
representatives of the parties at the following addresses:

In the event a notice is mailed pursuant to the provisions of this paragraph, the time
periods specified in paragraph 14 shall commence to run on the day after the
postmarked date of mailing.
16.
Statutory Requirements:
This Contract is subject to all statutory
requirements that are or may become applicable to counties or political subdivisions
of the State of Colorado generally. Without limiting the scope of this provision, the
Contract is specifically subject to the following statutory requirement:

22.
Breach: Any waiver of a breach of this Contract shall not be held to be
a waiver of any other or subsequent breach of this Contract. All remedies
afforded in this Contract shall be taken and construed as cumulative, that is,
in addition to every other remedy provided herein or by law.
23.
Termination of Prior Agreements: This Contract cancels and terminates,
as of its effective date, all prior agreements between the parties relating to the
services covered by this Contract, whether written or oral or partly written and
partly oral.
24.
Severability: If any provision of this Contract is found to be invalid,
illegal or unenforceable, the validity and enforceability of the remaining
provisions shall not in any way be affected or impaired thereby.

25.
Third Party Beneficiary: The enforcement of the terms and conditions of
this Contract and all rights of action relating to such enforcement shall be
strictly reserved to the County and the Contractor, and nothing contained in
this Contract shall give or allow any claim or right of action whatsoever by any
other or third person. It is the express intent of the parties to this Contract
that any person receiving services or benefits under this Contract shall be
deemed an incidental beneficiary only.
