CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


THIS AGREEMENT, made and entered into by and
between:
Fe M. Chan, of legal age, widow, Filipino and
resident of 929 Valdez St., Sampaloc, Manila, herein after
referred to as LESSOR
And
____________________, of legal age, single/married
to ____________________, Filipino and presently residing
at ________________________________________
herein after referred to as LESSEE.
WITNESSETH
WHEREAS, the LESSOR is the lawful and absolute owner
of a four (4) door, two (2) story concrete building located at No.
929 Valdez St., Sampaloc, Manila, covered by Transfer
Certificates of Title Nos. 200873 of the Register of Deeds of
Manila;
WHEREAS, the LESSEE desire to rent the said apartment
for a period of one (1) year from ____________________ to
____________________ particularly the above stated address;
NOW, THEREFORE, for and in consideration of the mutual
covenants and agreements made herein by the said parties,
herein LESSOR and LESSEE hereby enter into this contract
voluntarily on the following terms and conditions, to wit:

1. This lease contract is for a period of one (1) year as


stipulated herein above and may be renewed upon the
termination of the lease period subject to such new terms
and conditions as may be mutually agreed upon between
the parties;
2. That the LESSEE shall make a deposit equivalent to
two (2) months (P 15,000.00) and one month rental
advance amounting to seven thousand five hundred pesos
(P 7,500.00) wherein the deposit shall be paid or applied to
any damages that may be incurred in the premises and to
hold the said amount should the LESSEE refuse to pay
unpaid rentals;
3. That the LESSEE shall maintain the leased premises in
proper tenantable condition and shall faithfully comply with
all laws, policies, rules and regulations of the government
on liquor-drinking, vices, other nuisances and principally on
sanitation and other safety measures. Bets of any kind will
not be allowed in the leased premises;
4. That the LESSEE shall undertake minor repairs within
the leased premises at his own expense and account.
Major repairs, alterations and improvements to be
introduced in the leased premises shall have written
consent of the LESSOR. That all alterations and
improvements to be introduced in the leased premises shall
have the written consent of the LESSOR. That all
alterations and improvements made shall become the
property of the LESSOR at the expiration of the contract of
the LESSEE, without any refund or reimbursement of the
LESSEE whatsoever;
5. That the LESSEE hereby agrees to vacate the leased
premises should he fail to pay two (2) months rental;
6. That the violations of any of the terms and conditions of
this contract of lease shall be sufficient ground for the
LESSOR to terminate the same in addition to his rights and
under the existing laws. This will serve likewise as an
authority to enter or padlock the leased premises for the
purpose of redeeming possession of the same and to retain
such personal properties belonging to the LESSEE to
answer for whatever damages the LESSOR is entitled to;

7. That the LESSEE shall use the leased premises


exclusively for family dwelling and shall have no right to
use the same for business purposes; The number of
occupants of the premises herein leased is expressly
limited to six (6) persons only. The LESSEE is not
authorized to sublease or transfer to a third party the
leased premises, or part thereof, nor dismantle, change
later its set-up, without the prior written consent of the
LESSOR. Non compliance herewith is a ground for the
LESSOR to revoke this contract;
8. All bills for light and water are for the account of the
LESSEE and shall be responsible for all acts and
omissions of his family, maid, any and all other persons by
this allowed access and coming damages to premises; and
to replace those damages at his expense;
9. LESSOR shall be allowed periodic check-up of the
premises leased for the purpose of ascertaining any need
for necessary and urgent repairs to keep the unit habitable;
10. Should the LESSEE fail to pay the rent therein
stipulated in accordance with the terms above setforth or
violate any of the terms and conditions of this contract the
LESSOR shall have the legal right to eject the LESSEE
from the premises and to collect all unpaid rentals plus
damages.
11. That for the use and occupancy of the above
described premises, the LESSEE shall pay unto the
LESSOR within the first week of the month of occupancy at
the residence of the LESSOR a monthly rental of SEVEN
THOUSAND FIVE HUNDRED PESOS (P 7,500.00);
12. In case of court litigation, by writing of the nonpayment of the last agreed rental on the date or any breach
of this contract on the part of the LESSEE the LESSOR
shall be entitled to collect from the LESSEE liquidated
damages and attorneys fees;
13. That the premises leased have been received by the
LESSEE in good, habitable condition;

14. That the LESSEE shall notify the LESSOR at least


thirty (30) days in advance should the LESSEE decide to
abandon the leased premises; Remaining deposit and
advanced payment are refundable after all the bills are
cleared.
IN WITNESS WHEREOF, the parties have hereunto
affixed their signature this ____________________day of
____________________ 2001 at Manila, Philippines.
