A RESOLUTION ALLOWING GOLDEN SUMMIT MINING CORPORATION TO UTILIZE THE
RECLAIMED AREA IN BARANGAY MAPUTI, THIS MUNICIPALITY
WHEREAS, Golden Summit Mining Corporation is a duly organized corporation under the Republic of
the Philippines with principal office address at Unit 1407, AIC Burgundy Empire Tower, ADB Avenue,
Ortigas Center, Pasig City;
WHEREAS, Golden Summit Mining Corp. signified its intention to lease the reclaimed area in
Sitio Tagdodo, Barangay Maputi and the local government of this municipality agreed to lease the said area;
WHEREAS, both parties, the LGU and the Golden Summit Mining Corp. shall enter and sign into a
Memorandum of Agreement which will contain terms and condition of
the leasehold of the
reclaimed area;

WHEREAS, LGU Banaybanay is a government institution abiding with the laws of the Republic of
the Philippines and is an owner reclaimed area situated at SitioTagdodo, Barangay Maputi,
Banaybanay, Davao Oriental;
WHEREAS, Golden Summit Mining Corporation is a duly organized corporation under the Republic
of the Philippines with principal office address at Unit 1407, AIC Burgundy Empire Tower, ADB Avenue,
Ortigas Center, Pasig City;
WHEREAS, Golden Summit Mining Corp. signified its intention to lease the reclaimed area in

A RESOLUTION REQUESTING THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS
(DPWH), DAVAO ORIENTAL FIELD OFFICE, MATI CITY, TO FAST TRACK THE
REHABILITATION OF MAPUTI BRIDGE, IN BARANGAY MAPUTI AND THE ON GOING ROAD
REPAIR IN BARANGAY PUNTALINAO, BANAYBANAY, DAVAO ORIENTAL

WHEREAS, the road work in both areas, which are along the national highway, have caused so much
inconvenience to so many motorists and travelers;
WHEREAS, the rehabilitation work in Maputi Bridge is too slow and the road repair in Puntalinao was
stopped thus the Sanggunian requests the DPWH to fast track the completion of these projects;
WHEREFORE, on motion presented by Hon. Marcenio C. Garcia duly unanimously seconded by all
members present, it was
RESOLVED, AS IT IS HEREBY RESOLVED, TO REQUEST THE DEPARTMENT OF PUBLIC

HON. ADALIA LOPEZ- TAMBUANG, TO IMPORT AND OPEN A LETTER OF CREDIT WITH THE
DEVELOPMENT BANK OF THE PHILIPPINES (DBP), MATI CITY BRANCH FOR THE
PROCUREMENT OF HEAVY EQUIPMENT IN THE AMOUNT OF TWENTY- THREE MILLION
EIGHT HUNDRED NINETY THOUSAND (PhP 23,890,000.00) PESOS
WHEREAS, The LGU of Banaybanay will purchase brand new heavy equipment, to wit;
Two (2) units - CBU 6-wheeler Dump Truck, brand new
Two (2) units - CBU 10-wheeler Dump Truck, brand new
WHEREAS, the municipal mayor is given the authority to import and open a letter of credit with the
DBP relative to the purchase of the above mentioned equipment with the SE KYUNG AUTO TRADING CO.,
LTD., presented by JROG Marketing, authorized dealer and seller in the Philippines, and to enroll under
Payment Application Secure System (PASS5) of the DBP;
WHEREAS, the DBP is authorized to debit from the account of LGU Banaybanay the Bureau of
Customs (BOC) Import Processing Fee and Container Security Fee;
WHEREFORE, on motion presented by Hon. Rabsalon M. Lamaran duly jointly seconded by all
members present, it was
