"Smoking Gun" Discovered, Notice Filed to Reliably Inform the Chief Judge, Audrey Collins, and a Request for Initiation of Corrective Actions

Los Angeles, March 25 - following months of repeated attempts, Dr Joseph Zernik, Los Angeles Resident, gained on March 24, 2010 access - to inspect and to copy - two (2) of the NEFs (Notices of Electronic Filings) in the habeas corpus petition of Richard I Fine -
Richard I Fine v Sheriff of Los Angeles County
(2:09-cv-01914). Such access, and additional records that Dr Zernik was for the first time permitted to inspect, but not copy, allowed to clearly discern the nature of two key records in the case: (a) June 29, 2009 Judgment by the Judge John Walter, and (b) February 18, 2010 Mandate by the US Court of Appeals, 9th Circuit. Both records appeared in PACER - the Court's public access system, as honest, valid and effectual court records, which had been entered. However, both records were newly identified as false and deliberately misleading court records. Accordingly, Dr Zernik forwarded today a notice, copied below, to Chief Judge Audrey Collins, US District Court, Central District of California, to reliably inform her of alleged fraud on the court, obstruction and perversion of justice in the habeas corpus petition of Richard I Fine, in particular, and in operation of the court's public access (PACER) and case management/ electronic court filing (CM/ECF) systems in general. In such notice, Dr Zernik also requested that Chief Judge Collins initiate corrective actions. Attached to the March 25, 2010 notice and request was a detailed March 25, 2010 declaration and opinion by Dr Joseph Zernik,

outlining the various ways that fraud and deceit were allegedly perpetrated in the records of
Richard I Fine v Sheriff of Los Angeles County
(2:09-cv-01914), in particular, and in the operations of PACER and CM/ECF at the Central District of California, in general. Richard Fine, 70 years-old, former US prosecutor has been held in solitary confinement in a hospital room in Los Angeles, for over a year, with no medical justification, with no warrant, and with no conviction/ judgment/ or sentencing ever beem entered to provide the legal foundation for his holding. His alleged false imprisonment was only one example in alleged pattern of large-scale, long term false imprisonments in Los Angeles County, California.

Report for the pending November 2010 Periodic Universal Review of Human Rights by the UN Office of High Commissioner of Human Rights. Conduct of the US Court, Central District of California, was alleged as serious deprivation of rights of the many millions who reside in the Central District of California. First and foremost among the victims of such deprivation were the Rampart-FIPs (Falsely Imprisoned Persons) - the many thousand victims of the Rampart corruption scandal (1998-2000), almost elusively black and latinos, who were left falsely imprisoned to this date.
