AND (2) Smt.Anitha, W/o Gajendra, D/o G.Thippa Reddy, Aged about 25 years, R/o Gramadatlu village, Rayadurga Taluk, Ananthpur Dist. RESPONDENTS Nil PETITION UNDER SECTION 13(B) OF THE HINDU MARRIAGE ACT OF 1955 FILED BY THE PETITIONERS. The Petitioners respectfully submits as follows:- That for the purpose of issue of process notices ete., from this Hon’ble Court, the addresses of the Petitioners, morefully described in the cause title of the petition. The Petitioner No.1 is ‘represented by her Counsel Sri. Vinay, Bellary. The Petitioner No.2 is represented by his Counsel, Sri.K.S.Lokesh, Prasanna Kadethota, Chitradurga. 1." The Petitioners to this petition are Hindus. Their marriage solemnized at Gramadatlu village, Rayadurga |Taluk, Anathpur Dist., on 15-5-2009 in the parental house of Petitioner No.2. 2. The Petitioners lead their marital life at Andralu village for 2 years. After that, there was differences were arose between the Petitioners, which cannot be set-right, despite of advises of the relatives, elderly people and friends of both the parties to the petition. Even though there is lot of differences between the Petitioners: they lived together for about 1 year, Several panchayaths convened by the elderly persons went in vain. No alternative the Petitioners decided it is impossible to lead the marital life between them and Petitioner No.2 went to her parental house in the last week of August 2012 and living separately from her husband. Since that date they have not been able live together and their marriage has been irretrievably broken. There are no any chances and possibilities of renunion. 3. The parents, relatives, friends and well wishers of both the Petitioners have attempted several times and advised, repeatedly, to live together, as husband and wife, in the interest of both the Petitioners, forgetting the differences arose between them. Inspite of the repeated reconciliation, both the Petitioners refused to lived together to lead marital life. 4. Without any alternative way, the Petitioners, on the advise of their elders, parents, relatives and well wishers have agreed and submitted this petition, for dissolution of marriage by mutual consent. The Petitioner No.2 has not claim any maintenance in future from the Petitioner No.1 5. This petition has been presented by both the Petitioners, voluntarily, willfully, without any force, undue influence, threat, and without any collusion between them, for the dissolution of marriage by mutual consent, since it is impossible to live together and to continue the marital life as husband and wife, 6. The cause of action for the above petition arose in the last week of August 2012 and subsequently, when lot of differences arose between the Petitioners, and they are started to live separately from 3 years, the chances and possibilities of reunion broken. The Petitioner No.1 is the permanent resident of Andralu village, Bellary Dist. within the jurisdiction of this Hon'ble Court. Fe Separate vakalaths and list of documents are submitted, 8. The Court fee of Rs.100/- is paid as per, Karnataka Court Fee and Suit Valuation Act. PRAYER Wherefore, it is most respectfully prayed that this Hon'ble Court kindly be pleased to pass a judgement and decree, for the following reliefs: a) Dissolve the marriage solemnized between the Petitioners No.1! & 2 on 15-5-2009 at Gramadatlu village, Rayadurga Taluk, Ananthpur Dist by granting decree of divorce by mutual consent. b) Grant such other relief or consequential reliefs as this Hon’ble Court deems fit in the facts and circumstances of the case.
