Message from the Chairman

Dear Friends,
Year 2013 was yet another exciting year for the IT-BPM industry in India and
NASSCOM. The industry after an initial period of slow growth demonstrated its
resilience and will close the fiscal year with a 13 per cent growth in exports, and 9.5
per cent growth in the domestic market.
For NASSCOM, this year was about change, building for the future, launching some
key initiatives and creating a broad based organisational structure.
Implementation of the NASSCOM 2020 Organisational and Governance
Committee chaired by Mr. N.R.Narayana Murthy was a key priority for NASSCOM.
The 7 industry councils were created in the year and have already begun their
tasks, engaging with industry members and building a vision for these sectors.
A key highlight of the year was the launch of the NASSCOM 10,000 Start-ups
initiative, a mega program that aims to catalyse 10,000 technology start-ups over
the next decade. The initiative is built in partnership with leading incubators and
angel groups in the country and focuses on evangelising entrepreneurship,
capability development and access to incubation and funding. The program in its first 9 months has impacted over 200+
start-ups directly and touched over 25,000 entrepreneurs.
The NASSCOM Product Council also strengthened its product initiative and created programs for partnerships between
SIs and product companies, Emerge 50 that showcased innovative product companies and the annual Product
Conclave.
In an era of policy paralysis, NASSCOM worked closely with the government and was able to usher in important changes,
including the release of the Safe Harbour Rules for the first time in India, amendments in the taxation policies, simplification
in SEZ rules in tier 2 cities, as well as action on Service Tax refunds, NASSCOM led discussions on these issues, making
recommendations to the government and getting them implemented.
NASSCOMs efforts in the realm of Global Trade Development saw it spotlight the negative provisions of the US
Immigration Bill, which it considered discriminatory, especially for the IT-BPM sector. NASSCOM partnered with global
companies, associations and others on articulating the impact of these negative provisions on the US industry and the
trade relations between the two countries. The Global Trade initiative also deepened its focus on creating new market
opportunities in emerging markets including Japan, China and Africa.
Yet another milestone crossed by NASSCOM was in the realm of skills development where its Sector Skills Council (SSC)
announced its IT-ITeS Industry Occupational Analysis reports. These identified, for the first time, unique job roles in the
industry/sub-sectors, for Entry, Middle and Leadership levels. Implementation of these standards will help to better define
skills and competencies for the industry.
The year also saw the transition of the NASSCOM President with Mr. R. Chandrashekhar taking on this role, after an
illustrious career with the government. The Executive Council has placed on record their appreciation for the wonderful
work done by Mr. Som Mittal in taking NASSCOM to newer heights.
Going forward, NASSCOM will be help reposition the industry to leverage the opportunities emerging from
digitalisationthe next wave of IT transformation.
Since 2014 is the 25th year of NASSCOMs operations, plans are afoot to unveil a series of initiatives that celebrate this
milestone.

Message from the President

Dear Friends,
I am delighted to take over the role of President, NASSCOM and contribute to
strengthening one of Indias most reputed chambers of commerce. I have been
associated with NASSCOM for a long time, though in a different capacity and
have always admired the ability of the industry to align to a common vision, voice
and strategy.
The opportunities are very vast at this particular juncture and exciting times lie
ahead for our industry. The future looks positive as the industry is evolving
dramatically in terms of scale, complexity and innovation. Going forward,
enabling radical transformation of key sectors in India through the use of ICT to
increase access, enhance efficiency and enable innovation in the sector are
going to be some of our priority focus areas.
The rapidly accelerating trend of innovation and entrepreneurship in the ICT
sector impacts several domains and provides clear indicators that the journey has
begun.
NASSCOM will continue to leverage international and domestic expertise to catalyze innovation and transformation in
the Indian IT-BPM sector. The industry is increasingly prioritizing domains based on potential size, possible impact,
readiness of leadership and role of government. Changing models will bring compelling business innovations with greater
breadth and specialization across key verticals BFSI, telecom, healthcare, education and social entrepreneurship.
The industry councils created by NASSCOM are creating specific programs for the diverse industry sectors and in the year
ahead we will work with members to deepen these engagements and build new programs.
Today, NASSCOM is evolving its role to help the industry harness the new and emerging business opportunities while
becoming a channel for the creation of a digitally inclusive India. Even as it continues to help both large and small
companies achieve global scale, NASSCOM is focusing on how IT can shape and transform the nation.
In order to fulfill its vision and mission, NASSCOM will continue to partner with all the stakeholders, harness the power of
new business and delivery models, explore new geographies and help the IT-BPM industry build greater traction in the
home market.
2014 is expected to be an exciting, rejuvenating year for India and NASSCOM, and I am glad to have become a part of
the organisation at this juncture.

THE YEAR IN REVIEW

GOVERNMENT POLICY ISSUES

were backed by the industry.

NASSCOM has been working closely with both the union

and state governments of India to create a regulatory
climate that is conducive to the growth of the IT-BPM
industry in the country. To deal with the rising concerns
related to the business environment, NASSCOM remained
in the forefront, highlighting these challenges and
working with both industry and government to redress
these problems. NASSCOM was supported in this task by
the industry that provided its critical inputs. Based on
NASSCOM recommendations, the government made
several policy announcements and clarifications related
to existing policies during 2013. These took into account
the issues raised by the IT-BPM industry.

Service Tax refunds

The new Service Tax rules posed challenges to SEZ
operators, who faced difficulties in claiming refunds. After
much deliberation, the CBEC notified the changes, to
enable upfront exemptions and credit and create a
refund mechanism.
While service tax refunds prior to the creation of the new
rules are delayed, the industry has seen refunds picking
up in the last two quarters of 2013. The CBEC too has been
actively sharing information with NASSCOM members
and seeking their inputs on specific problem areas.
Changes in SEZ provisions for the IT sector

In response to repeated requests made by NASSCOM,

the Ministry of Finance for instance, set up an industry
forum to deliberate on the difficulties being posed by the
taxation policy and administration. NASSCOM was
invited alongside its member companies for a free and
frank discussion. The government also made public the
Rangachary Committee recommendations. It notified for
the very first time the Safe Harbour rules, based on the
suggestions made by the committee.

Recognising the need to revive interest in the SEZ policy,

the government in its annual FTP addendum announced
significant changes in the SEZ policy for the IT sector.
Based on NASSCOMs recommendations, the
requirement of minimum land for setting up of SEZs for
IT/ITeS was removed, classification of cities was
rationalised to include upcoming cities/locations and exit
rules for SEZs were framed.

The Foreign Trade Policy addendum announced

significant changes in the SEZ policy, taking into account
the specific needs of the IT sector. NASSCOMs request for
a waiver of minimum land requirement for IT SEZs,
reclassification of cities to encourage activities in Tier2/3
locations and greater clarity on the exit process for SEZ
units were also accepted.

Several operational challenges of NASSCOM member

companies were also addressed. SOFTEX approvals for
instance, were streamlined, the standard default service
list was issued in October, 2013 and a rent-a-cab service
was included. The BCP/DR guidelines notified this year
were further clarified to enable the movement of backup
data from SEZ units to STPIs, paving way for the setting up
of BCP/DR facilities.

NASSCOM additionally shared feedback on the

legislative changes proposed in the New Companies Act
with the Ministry of Corporate Affairs. Similarly, concerns
of the industry regarding the patenting guidelines for
computer related inventions were discussed with the
Indian Patent Office.

Telecom R&D Servicesstreamlining approvals for

experimental licenses
R&D service providers for telecom have been facing
difficulties in receiving approvals for experimental
licenses and the import of equipment. NASSCOM worked
closely with the Department of Telecom and the office of
the Wireless Advisor to the Government of India,
suggesting suitable empowerment of Regional Licensing
Officers for approvals. Having shared industry best
practices on isolation and shielding to prevent
interference with commercial telecom services,
NASSCOM was able to generate enough confidence in
the regulator to allow for approvals.

The highlights of NASSCOMs key engagements with the

government and their outcomes are as follows:
Release of Safe Harbour rules and other developments
related to Transfer Pricing
Circulars were issued to define contract R&D and its
taxation under the Transfer Pricing regime, after the
withdrawal and amendment of controversial circulars
issued in March, 2013 that could have potentially
complicated matters further. NASSCOM was in the
forefront, sharing industry practices and speaking about
the impact these announcements could have.

Industry participation in framing ISO Standards for ITeS/

BPO
SC7, the Software and Systems subcommittee of ISO/IEC
JTC1 is involved in the Standardisation of processes,
methods and supporting technologies for the
engineering and management of software and systems
throughout their life cycles.

September, 2013 saw the release the Safe Harbour Rules

for the first time in the country. Based on NASSCOMs
discussions in the industry forum, a consultative approach
was adopted by the government and duly modified Safe
Harbor rules were notified. While their acceptance and
efficacy is yet to be tested, this notification took almost
four years to come after the amendment in the Act. The
move is was a culmination of NASSCOMs efforts, which

NASSCOM has been offering secretariat support to the

India Mirror Committee (IMC) of SC7 under the JTC-1 for
ISO standards. For this, it works closely with the Bureau of

10

Annual Report 2013-14

Indian Standards (BIS) and industry members. The IMC is

also a part of the BIS committees on software-related
standards.

period of five years. The IT and ITeS industries has also

been declared as 'essential services'. Previously standing
order exemptions were extended for a period of 2 years till
August 2011. Thereafter, NASSCOM with support from
Industry members was in close discussion with the
Government for an extension and also development of a
sector specific model standing order for the IT sector.

With the industry attaining global status, NASSCOM has

been involved with the International Standards
Organisation (ISO) and encouraging more and more
member organisations to participate in different Working
Groups.

Launch of Member Query Service and Member Updates

on Policy

NASSCOM will continue this strategic initiative and work

closely with the BIS and the Department of Electronics
and Information Technology (DeitY) to set a standards
agenda for software in the country.

In tune with its efforts to offer value-added services and

support its large SME membership, NASSCOM launched a
Member Query Service during 2013. The purpose of this
service is to respond to queries related to policy and the
regulatory aspects of business. The member query service
offers a quick response to basic policy and business
compliance-related queries. The NASSCOM website is
regularly updated with key policy announcements and
their impact. A recent initiative has been a regular
commentary on the global economic scenario and
currency rates and fluctuations. This was further
supplemented with member interactions in different
regions.

Intellectual Property Rights

The Indian Patent Office issued draft guidelines on
Computer Related Inventions. NASSCOM undertook an
industry consultation exercise to identify concerns and
forwarded extensive feedback to the Indian Patent
Office. It also participated in national-level consultations,
highlighting how the industry was concerned about the
stringent conditions related to innovation in both software
and hardware as a prerequisite for IP protection.
NASSCOM will continue to work with the industry and
government to establish a favorable IPR environment in
the country and showcase best practices.

GLOBAL TRADE DEVELOPMENT

Over the years, the focus of NASSCOMs Global Trade
Development programme has been to engage with a
wide variety of domestic and international stakeholders
such as governments, customers and associations. Its aim
is to create regulatory frameworks that foster trade with
the Indian IT-BPM industry, position India as a trade
partner and promote global sourcing in emerging
markets and verticals.

Online Payments
Continuing its efforts to streamline the online payment
environment, NASSCOM set up a NASSCOM-IBTC (Indian
Banks Technology Consortium) working group to deal
with the issue. The group, constituted by e-commerce
merchants, leading banks, payment aggregators, has
been suggesting ways to improve the customer
experience related to online payments. It is additionally
analysing the processes and transaction data of online
payments to identify the hurdles and suggest the best
way forward.

Under this programme, NASSCOM has also been

spotlighting Indias edge as an outsourcing destination
and the unmatched value proposition offered by the
countrys IT-BPM service providers. It has been doing so by
reaching out to influencers including legislators, elected
officials, associations, think tanks, academic institutions,
customers, regulators, Indian embassies and the media.
In 2013, NASSCOM continued to strengthen Indias
credentials as a key global IT-BPM hub by initiating the
following activities:

Companies Act
The New Companies Act is in the implementation stage.
New rules are being framed and NASSCOM has been
sharing industry feedback related to the various
provisions with the government. The industrys
apprehension related to the proposed cost audits for the
IT sector have been addressed in the draft rules.
NASSCOM Foundation is taking a lead in the area of
Corporate Social Responsibility and associated
guidelines and rules. It is working closely with the MCA to
suggest changes in processes and enable a smooth
adoption of the CSR mandate in the IT sector.

The US Immigration Bill

The year 2013 witnessed intense debate around the
passage of the US Immigration Bill, which created
tremendous hue and cry, especially within the Indian
tech community. The industry, led by NASSCOM, was
quick to point out that the bill had provisions that
arbitrarily singled out a group of multinational IT
organisations, would dictate how American
organisations pursued their business operations and
selected business partners in the future and that its
proposals amounted to punitive treatment of this industry.
The changes proposed by the bill, including higher visa
costs and increase in wages for H-1B visa holders, were
considered discriminatory and moves that would put the
Indian IT-BPM industry at a competitive advantage.

Information Technology Sector in Karnataka to be

exempted from the Standing Orders Act
The revised IT Policy of Karnataka (I4 PolicyIT, ITeS,
Innovation and Incentives Policy) was unveiled during the
ITE.Biz program of Government of Karnataka in October,
2013. It will help strengthen the thriving IT and ITeS sector in
the state. IT and ITeS establishments in Karnataka are
proposed to be exempted from compliance under the
Industrial Employment (Standing Orders) Act of 1946 for a

11

Annual Report 2013-14

It was felt that the issue of skilled workers travelling for short
durations was unfortunately being linked to the larger
debate on immigration and did not take into account the
contribution of the Indian IT industry to the US economy
through social security, local taxes, creation of local
employment and community work.

The industry is working on the House side, trying to ensure

that the language of the bill is less harmful to global
organisations and US customers, and that, at the end of
the day, is more balanced.

changes in the ICT visa category. NASSCOM, through its

country chapter in Canada,
submitted its own
representation to CIC, cautioning it about the proposed
changes. It also created a Coalition of local Businesses,
where local businesses and associations signed a joint
representation. The key highlights of the submission were
as follows:
The current regime of the ICT category is efficient and
provides business with predictability

India-EFTA Free Trade Agreement

Mobility issues with Australia

The European Free Trade Association (EFTA) is a trade

organisation with representatives from four European
countries. It operates in parallel with and is linked to the
European Union (EU). The EFTA members are Iceland,
Liechtenstein, Norway and Switzerland. NASSCOM has
been working closely with the Department of Commerce
and the EFTA secretariat to ensure a special status for the
Indian tech industry in FTA negotiations. The EFTA
countries follow the EU Data Security directive that has
been an impediment and market access barrier for the
Indian IT-BPM industry.

The Australian government had introduced a new

legislation in Parliament that would further toughen
standards and increase compliance monitoring
mechanisms for the Temporary Work (Skilled) visa
(Subclass 457). The legislation would also introduce new
labor market testing (LMT) requirements for 457
applications. NASSCOM is working through its country
chapter in Australia and Immigration Attorneys to
mitigate the risks of these measures.

Besides the industry, senior Indian government

functionaries, including Indias Finance Minister, Shri. P.
Chidambaram also flagged Indias concern about the
bill, stating that the visa restrictions being suggested for
knowledge workers amounted to non-tariff barriers.

The Department of Immigration and Citizenship (DIAC),

the implementing agency sought feedback from various
stakeholders on how the LMT should be applicable.
NASSCOM, through its chapter in Australia, submitted a
representation to DIAC with its recommendations.

Security Bond Proposal for UK visa

The Home Office, government of the United Kingdom
indicated it will not implement a proposal that requires
temporary migrants from countries whose nationals are
deemed to be at a high risk of overstaying their visas, to
pay a 3,000 security bond. The proposal was originally
scheduled to go into effect from November, 2013.

NASSCOMs Global Mobility Conference

NASSCOM held its 3rd edition of the Global Mobility
Conference on May 2, 2013 in Bengaluru in partnership
with Fragomen. The conference enabled attendees to
gain a comprehensive overview of the current mobility
trends and understand the challenges and best practices
of multiple international destinations for multinational
corporations. Participants were also able to get
clarifications on their queries from the respective
government officers directly. A special session on
Totalisation Agreements signed by India and their
implications on global compensation, benefits and
taxation was also conducted. The conference had
significant representation from the governments of India,
the US, UK, Germany, Australia and Canada. It also drew
over 300 participants from large, small and GIC firms.

The proposed measure was intended to deter foreign

nationals from overstaying their immigration status, which
some UK government officials believe is the countrys
greatest immigration challenge. UK law has included
provisions for the imposition of a security bond since the
Immigration and Asylum Act 1999, but the bond
requirements have never been implemented.
Opposition from internal and external stakeholders
convinced the UK government to abandon the idea.
India had expressed its concern regarding the proposal
to the government both at the ministerial and official
levels. NASSCOM had also written to the Labour Secretary
expressing its reservations on the issue.

rightly-skilled, high-quality, job-ready and employable

manpower. From a workforce development perspective,
these new industry standards cover knowledge,
competence and proficiency.

Global Business Foundation Skills (GBFS). While the FSIT

aims to develop basic skills in IT, GBFS has been
specifically designed to meet the needs of the BPO/KPO
and the LPO industries. NIIT will leverage its on-campus
delivery modelNIIT Careers@Campus--to enhance the
employability of engineering graduates in particular, and
all graduates in general.

The four reports are the first step in the creation of

Occupational Standards (OS), which specify the
parameters of performance that individuals must
achieve when carrying out a function in the workplace.
The reports were launched in New Delhi in the presence of
Shashi Tharoor, Minister of State for Human Resource
Development, Government of India; Som Mittal, former
President, NASSCOM; and R. Chandrasekaran, Vice
Chairman, NASSCOM and Executive Vice Chairman,

SSC and NIIT will train over one lakh students over three
years, starting with 30,000 students in the first year.

THE NATIONAL SKILLS REGISTRY (NSR)

FSIPD (Foundation Skills in Integrated Product

Development) programme launched

The National Skills Registry (NSR), an important initiative

spearheaded by NASSCOM, aims to enhance the
security of processes, operations and systems from the
perspective of employees, and standardising
background check practices. NSR is governed by a
Steering Committee constituted by 15 industry
representatives. NSR has been widely accepted by the
industry and employees alike. Over 130 companies,
accounting for around 70 percent of the IT-BPM
workforce, have subscribed to the NSR. It has 14.5 lakh
web registrations and 9.5 lakh biometric registrations.

Committed to helping India skill over 500 million people by

2020, the NASSCOM Sector Skills Council, launched the
Foundation Skills in Integrated Product Development
(FSIPD) programme. The aim of the programme is to
develop professionals who possess skills that are relevant,
in sync with industry needs and improve their
employability within the engineering and design industry.
The curriculum of the course has been developed by
NASSCOM in partnership with member organisations
active in the Engineering and R&D (ER&D) space.

Streamlining the Recruitment Process

MoU with National Programme on Technology Enhanced

Learning (NPTEL) penned

To check the malpractices of fake offer letters, fake

testimonials and fake resumes, a working group has been
formed to streamline the recruitment process.

On September 3, 2013 NASSCOMs Sector Skills Council

(SSC), signed an MoU with NPTEL. NPTEL is a joint initiative
by seven Indian Institutes of Technology (IIT Bombay,
Delhi, Guwahati, Kanpur, Kharagpur, Madras and
Roorkee) and the Indian Institute of Science (IISc)
Bangalore, under the Ministry of Human Resources
Development (MHRD). Its goal is to create and
disseminate high-quality online course content for
learning.

NSR for Educational Institutions

One of the growing requirements of global customers is to
verify the academic credentials of the candidates joining
the IT-BPM workforce. There is also a need for early
verification of on-campus or off-campus students through
simplified and systematic processes and the right
technology, prior to on boarding. The industry requires
biometric profiling of students from the base source, at a
subsidised cost of delivery. This will enable the sector to
create a central database of potential hires with
credentials. The campus campaign will further help in
encouraging student participation and enrolment and
capturing the biometric profiling of the job aspirants at
the source level.

The objective of this memorandum is to establish a

mechanism for cooperation between NASSCOM SSC
and NPTEL for deploying open courses and online
certifications. The main advantages of online courses and
certifications are scalability, reach and wide impact.
NASSCOM SSC and NPTEL will therefore develop and
deliver learning material using the Massive Open Online
Courses (MOOCs) model. The MOOCs will be followed by
an in-person proctored online exam for providing
certified scores that can be used reliably in recruitment by
the industry and other relevant stakeholders.
