Constructionwork
meansanyworkinconnectionwith
(a) theconstruction,erection,alteration,renovation,repair,demolition
ordismantlingoforadditiontoabuildingoranysimilarstructure;or
(b) theconstruction,erection,maintenance,demolitionordismantling
ofanybridge,dam,canal,road,railway,runway,sewerorwater
reticulationsystem;orthemovingofearth,clearingofland,themaking
ofexcavation,piling,oranysimilarcivilengineeringstructureortypeof
work;
Constructionworkintermsoftheconstructionregulationsandintheinterestof
administrationofhealthandsafetyinconstructionactivitiesislimitedtobuildingworks
andcivilengineering works.E.g.workingatelevatedpositions(cleaningofwindows)
wherenobuildingorcivilengineeringworkactivity,suchactivitymustnotbeclassified
asconstructionwork.Excavationofgravesisanonconstructionworkeventhouthereis
anactivityofexcavation.Itisonlywhenworksincludebuildingorcivilengineeringworks
andthereforeclassifiedasconstructionwork.

Client:
meansanypersonforwhomconstructionworkisperformedfor;
Partyforwhomworkisperformedfor. (Itcanbeapersonoranentity)
Agent:
means a competent person who acts as a representative for a client; or a
person or an organisation that acts as a representative for a client in
managing overall construction work;
or a competent person or entity appointed by the client and who has full
authority and obligation to act on the clients behalf in terms of the

5(1)(b),whichplanmustbe
appliedfromthedateof
commencementofandforthe
durationoftheconstructionwork
andwhichmustbereviewedand
updatedbytheprincipal
contractorasworkprogresses;

"contractor"meansanemployerwho
performsconstructionwork;
"principalcontractor" meansan
employerappointedbytheclientto
performconstructionwork;

twopersonstorepresenttheDepartmentofPublicWorks,oneeachdesignatedbythe
BuiltEnvironmentalCouncilandtheConstructionIndustryDevelopmentBoard;
onepersontorepresentHigherEducationinthefieldofconstructionandrelated
studiesdesignatedbytheDirectorGeneraloftheDepartmentofHigherEducation;
onepersondesignatedbytheSouthAfricanPropertyOwnersAssociation;
twopersonsdesignatedbyemployersorganizationstorepresentemployers whoare
directlyinvolvedintheconstructionindustry;
twopersonsdesignatedbyemployeesorganizationstorepresenttheunionswhoare
directlyinvolvedintheconstructionindustry;
onepersontorepresentconsultantswhoaredirectlyinvolvedintheconstruction
industry:and
personswhoarecompetentinrespectofthematterstobedealtwithbythe
constructionhealthandsafetytechnicalcommitteewhohavebeencooptedbythe
committeewiththeauthorizationofthechiefinspector.

TheConstructionHealthandSafetyTechnicalCommitteemust
(a) advisethechiefinspectoronconstructionrelatedcodes,standardsandtrainingrequirements:
ProvidedthatanyaccreditedorapprovedtrainingmustbeinaccordancewithSouthAfrican
QualificationsAuthoritystandards;
(b) designatepersonsinwritingtoexaminesafetysystemsandsafetyrecordsofcompanieswhohave
highincidentratesandproviderecommendationstothechiefinspectorofoccupationalhealthand
safetyonthefindings;
(c) makerecommendationsandsubmitreportstothechiefinspectorofoccupationalhealthand
safetyregardinganymattertowhichtheseRegulationsrelate;
(d) advisethechiefinspectorofoccupationalhealthandsafetyregardinganymatterreferredtothe
ConstructionRegulationsTechnicalCommitteebythechiefinspectorofoccupationalhealthandsafety;
(e) performanyotherfunctionfortheadministrationofaprovisionoftheseRegulationsthatmaybe
requestedbythechiefinspectorofoccupationalhealthandsafety;
(f) conductitsworkinaccordancewiththeinstructionsandrulesofconductframedbythechief
inspectorofoccupationalhealthandsafety;and
(g) referappealsagainstdecisionsoftheConstructionRegulationsTechnicalCommitteetothechief
inspectorofoccupationalhealthandsafety.
