Dear Dr. Quatrone:
| have reviewed the employment contract and amendment for Marc A. Capizzi, Business
Administrator/Board Secretary, Lodi School District in accordance with N.J.S.A. 18A:7-8())
and to determine compliance with the standards adopted by the Commissioner of Education
at N.J.A.C, 6A:23-3.1. Based upon my review, | have determined that those provisions of the
contract and amendment subject to my review are in compliance with applicable laws and
regulations. This contract amendment is approved for the period effective, July 1, 2015,
through June 30, 2016.
Should there be any changes to the terms of this contract, you will need to submit it to the

PROFESSIONAL DEVELOPMENT
‘The Secretary/Business Administrator shall be entitled to membership
‘at the Board’s expense for professional dues in the following
professional associations: NJASBO and Bergen County ASBO. The
Secretary/Board Administrator also shall be entitled to reimbursement
for expenses incurred for attendance at professional conferences andARTICLE IX.

In accordance with Board Policy, the Board Secretary/Business
‘Administrator is required to have a cell phone to bé used for school
related business. The cell phone.number shall provided to the
Superintendent and other school staff members as determined by
the Superintendent. Ih consideration for the cell phone
requirement, the Board will compensate the Board
Secretary/Business Administrator 9 paymen payment of forty dors ($40)

‘This Contract efnbodies the entire agreement between the parties
hereto and cannot)be varied except by written agreement of the
undersigned parties. Any modifications/changes to the contract must
have the approval of the Executive County Superintendent prior to

REVOCATION

~The Parties hereto agree that in the event the Business
‘Administrator's certification Is permanently revoked, all provisions of
this Employment Agreement shall be null and void as of the date of
the revocation, and if the Business Administrator is lawfully precluded
from performing his duties by any Judgment, Order or direction of
any court of competent jurisdiction or the Commissioner of
Education, all provisions of this Employment Agreement shall
terminate and the Business Administrator's employment shall cease.
‘SAVINGS CLAUSE
If during the term of the Agreement, it is found that a specific clauseOf the contract Is illegal under federal or state law, the remainder of
this Agreement not affected by such a ruling shall remain in force.
ARTICLE XIII, MODIFICATION CLAUSE
The terms and conditions of this Employment Agreement shall not be
modified except by the written consent of both Parties hereto and
review and approval by the Executive County Superintendent. Any
‘amendments to this Employment Agreement shall not create a new
agreement or agreement term but shall only constitute an
amendment to the existing Employment Agreement. » }
