The State has previously listed certain witnesses as Class “C” witnesses, The State classified the listed Class “C” witnesses for both the reasons set out in the Rules of Criminal Procedure relating to Discovery. Further by way of explanation, the Class “C” witnesses are exempt from depositions on both prongs of the Rule of Criminal Procedure, The witnesses listed are strictly ministerial in nature because of their status as public officers. The State intends to introduce official records on each of the Class “C” witnesses from the Secretary of State’s public records to establish that they are in fact public officers or employees, Establishing that the Class “C” witnesses are public officers will satisfy one of the elements of the crimes charged. The official documents have been provided to the defendant in Discovery materials. (copies attached) 3. The State does not intend to call the listed Class “C” witnesses at trial. 's/ William N.
