NOTICE
All counsel are hereby advised that this appeal will be scheduled for disposition in
accordance with the following requirements.
Appellant shall return the attached reply letter to this office within twenty (20) days from the
date of this Notice, along with appellant's certification that a copy of the executed reply letter has
been provided to all counsel of record. Appellant shall choose one of the following: (a) Accepted
as a submitted case for consideration by the Court upon the briefs and without oral argument;
(b) Placed upon the Daily List for early, expedited argument (5 minutes maximum per side); or
(c) Placed upon the Daily List for standard argument (15 minutes maximum per side). If
appellant fails to return the reply letter within the required twenty (20) day period, the case will be
submitted to the Court for consideration and decision upon the briefs and without argument.
Appellant's choice of one of the three options set forth above does not require appellee's
consent. Upon receipt of the copy of appellant's reply letter, or following the passage of twenty
(20) days from the date of this notice, appellee may petition the Court for an option other than the
option selected by appellant. Any such petition shall contain a certification that a copy thereof
has been served upon all counsel of record.
This is the only notice you will receive until your case is placed on the daily argument or
submit list. If briefs were not timely filed, the party that failed to file a timely brief will not be
permitted to orally argue.
