CEmarkingisamandatoryconformitymarkingfor
certainproductssoldwithintheEuropeanEconomic
Area(EEA)since1985.[1]TheCEmarkingisalsofound
onproductssoldoutsidetheEEAthataremanufactured
in,ordesignedtobesoldin,theEEA.ThismakestheCE
markingrecognizableworldwideeventopeoplewhoare
notfamiliarwiththeEuropeanEconomicArea.Itisin
thatsensesimilartotheFCCDeclarationofConformity
usedoncertainelectronicdevicessoldintheUnited
States.
TheCEmarkingisthemanufacturer'sdeclarationthatthe
productmeetstherequirementsoftheapplicableEC

ThemarkconsistsoftheCElogoand,ifapplicable,the
fourdigitidentificationnumberoftheNotifiedBody
involvedintheconformityassessmentprocedure.
"CE"originatedasanabbreviationofConformit
Europenne,meaningEuropeanConformity,[3]butis
notdefinedassuchintherelevantlegislation.TheCE
markingisasymboloffreemarketabilityinthe
EuropeanEconomicArea(InternalMarket).

Meaning
Existinginitspresentformsince1995,theCEmarkingindicatesthatthemanufacturerorimporterclaims
compliancewiththerelevantEUlegislationapplicabletoaproduct,irrespectiveofwheremanufactured.
ByaffixingtheCEmarkingonaproduct,amanufacturerisdeclaring,atitssoleresponsibility,conformity
withallofthelegalrequirementstoachieveCEmarkingwhichallowsfreemovementandsaleofthe
productthroughouttheEuropeanEconomicArea.
Forexample,mostelectricalproductsmustcomplywiththeLowVoltageDirectiveandtheEMC
DirectivetoysmustcomplywiththeToySafetyDirective.ThemarkingdoesnotindicateEEA
manufactureorthataproducthasbeenapprovedassafebytheEUorbyanotherauthority.[4]TheEU
requirementsmayincludesafety,health,andenvironmentalprotection,and,ifstipulatedinanyEUproduct
legislation,assessmentbyaNotifiedBodyormanufactureaccordingtoacertifiedproductionquality
system.TheCEmarkingalsoindicatesthattheproductcomplieswithdirectivesinrelationto'Electro
MagneticCompatibility'[5]meaningthedevicewillworkasintended,withoutinterferingwiththeuseor
functionofanyotherdevice.
NotallproductsneedCEmarkingtobetradedintheEEAonlyproductcategoriessubjecttorelevant
directivesorregulationsarerequired(andallowed)tobearCEmarking.MostCEmarkedproductscanbe
placedonthemarketsubjectonlytoaninternalproductioncontrolbythemanufacturer(ModuleAsee
Selfcertification,below),withnoindependentcheckoftheconformityoftheproductwithEUlegislation
ANEChascautionedthat,amongstotherthings,CEmarkingcannotbeconsidereda"safetymark"for
consumers.[6]
CEmarkingisaselfcertificationscheme.Retailerssometimesrefertoproductsas"CEapproved",butthe
markdoesnotactuallysignifyapproval.Certaincategoriesofproductsrequiretypetestingbyan
independentbodytoensureconformitywithrelevanttechnicalstandards,butCEmarkinginitselfdoesnot
certifythatthishasbeendone.

CEmarkingismandatoryforcertainproductgroupswithintheEuropeanEconomicArea(EEAthe28
memberstatesoftheEUplusEFTAcountriesIceland,NorwayandLiechtenstein)plusSwitzerlandand
Turkey.ThemanufacturerofproductsmadewithintheEEAandtheimporterofgoodsmadeinother
countriesmustensurethatCEmarkedgoodsconformtostandards.
Asof2013CEmarkingwasnotrequiredbycountriesoftheCentralEuropeanFreeTradeAgreement
(CEFTA),butmembersRepublicofMacedonia,Serbia,andMontenegrohadappliedformembershipof
theEuropeanUnion,andwereadoptingmanyofitsstandardswithintheirlegislation(asdidmostCentral
EuropeanformermembercountriesofCEFTAthatjoinedtheEU,beforejoining).

RulesunderlyingCEmarking
ResponsibilityforCEmarkinglieswithwhoeverputstheproductonthemarketintheEU,i.e.anEUbased
manufacturer,theimporterordistributorofaproductmadeoutsidetheEU,oranEUbasedofficeofanon
EUmanufacturer.
ThemanufacturerofaproductaffixestheCEmarkingtoitbuthastotakecertainobligatorystepsbefore
theproductcanbearCEmarking.Themanufacturermustcarryoutaconformityassessment,setupa
technicalfileandsignaDeclarationstipulatedbytheleadinglegislationfortheproduct.The
documentationhastobemadeavailabletoauthoritiesonrequest.
ImportersofproductshavetoverifythatthemanufactureroutsidetheEUhasundertakenthenecessary
stepsandthatthedocumentationisavailableuponrequest.Importersshouldalsomakesurethatcontact
withthemanufacturercanalwaysbeestablished.
Distributorsmustbeabletodemonstratetonationalauthoritiesthattheyhaveactedwithduecareandthey
musthaveaffirmationfromthemanufacturerorimporterthatthenecessarymeasureshavebeentaken.
Ifimportersordistributorsmarkettheproductsundertheirownname,theytakeoverthemanufacturer's
responsibilities.Inthiscasetheymusthavesufficientinformationonthedesignandproductionofthe
product,astheywillbeassumingthelegalresponsibilitywhentheyaffixtheCEmarking.
Therearecertainrulesunderlyingtheproceduretoaffixthemarking:
ProductssubjecttocertainEUdirectivesorEUregulationsprovidingforCEmarkinghavetobe
affixedwiththeCEmarkingbeforetheycanbeplacedonthemarket.
Manufacturershavetocheck,ontheirsoleresponsibility,whichEUlegislationtheyneedtoapplyfor
theirproducts.
Theproductmaybeplacedonthemarketonlyifitcomplieswiththeprovisionsofallapplicable
directivesandregulationsandiftheconformityassessmentprocedurehasbeencarriedout
accordingly.
ThemanufacturerdrawsupanEUdeclarationofconformityoradeclarationofperformance(for
ConstructionProducts)andaffixestheCEmarkingontheproduct.
Ifstipulatedinthedirective(s)orregulation(s),anauthorizedthirdparty(NotifiedBody)mustbe
involvedintheconformityassessmentprocedureorinsettingupaproductionqualitysystem.
IftheCEmarkingisaffixedonaproduct,itcanbearadditionalmarkingsonlyiftheyareofdifferent
significance,donotoverlapwiththeCEmarkingandarenotconfusinganddonotimpairthe

legibilityandvisibilityoftheCEmarking.
Sinceachievingcompliancecanbeverycomplex,CEmarkingconformityassessment,providedbya
notifiedbody,isofgreatimportancethroughouttheentireCEmarkingprocess,fromdesignverification,
andsetupofthetechnicalfiletotheEUdeclarationofconformity.

Selfcertification
Dependingonthelevelofriskoftheproduct,theCEmarkingisaffixedtoaproductbythemanufactureror
authorizedrepresentativewhodecideswhethertheproductmeetsalltheCEmarkingrequirements.Ifa
producthasminimalrisk,itcanbeselfcertifiedbyamanufacturermakingadeclarationofconformityand
affixingtheCEmarkingtotheirownproduct.Inordertoselfcertify,theManufacturermustdoseveral
things:
1.DecidewhethertheproductneedstohaveaCEmarkingandiftheproductappliestomorethan
onedirectiveitneedstocomplywithallofthem.
2.Choosetheconformityassessmentprocedurefromthemodulescalledoutbythedirectiveforthe
product.ThereareseveralmodulesavailablefortheConformityAssessmentProceduresaslisted
below:
ModuleAInternalproductioncontrol.
ModuleBECtypeexamination.
ModuleCConformitytotype.
ModuleDProductionqualityassurance.
ModuleEProductqualityassurance.
ModuleFProductverification.
ModuleGUnitverification.
ModuleHFullqualityassurance.
Thesewilloftenaskquestionsabouttheproducttoclassifythelevelofriskandthenrefertothe
"ConformityAssessmentProcedures"chart.Thisshowsalltheacceptableoptionsavailabletoa
manufacturertocertifytheproductandaffixtheCEmarking.
Productsconsideredtohaveagreaterriskhavetobeindependentlycertifiedbyanotifiedbody.Thisisan
organizationthathasbeennominatedbyaMemberStateandhasbeennotifiedbytheEuropean
Commission.Thesenotifiedbodiesactastestlabsandcarryoutthestepsaslistedinthedirectives
mentionedaboveandthendecidedwhethertheproducthaspassed.Amanufacturercanchooseitsown
notifiedbodyinanyMemberStateoftheEuropeanUnionbutshouldbeindependentofthemanufacturer
andaprivatesectororganizationoragovernmentagency.
Inrealitytheselfcertificationprocessconsistsofthefollowingstages:
Stage1:IdentifytheapplicableDirective(s)
ThefirststepistoidentifywhethertheproductneedstobearCEmarkingornot.Notallproductsare
requiredtobearCEmarking,onlytheproductsthatfallwithinthescopeofatleastoneofthesectoral
directivesrequiringCEmarking.Therearemorethan20sectoralproductdirectivesrequiringCEmarking
covering,butnotlimitedto,productssuchaselectricalequipment,machines,medicaldevices,toys,
pressureequipment,PPE,wirelessdevicesandconstructionproducts.

Identifyingwhichdirective(s)maybeapplicable,astheremaybemorethanone,involvesasimpleexercise
ofreadingthescopeofeachdirectivetoestablishwhichapplytotheproduct(Anexampleofthescopeof
theLowVoltageDirectivebelow).Iftheproductdoesnotfallwithinthescopeofanyofthesectoral
directives,thentheproductdoesnotneedtobearCEmarking(and,indeed,mustnotbearCEmarking).
LowVoltageDirective(2006/95/EC)
Article1statestheDirectivecovers"anyequipmentdesignedforusewithavoltageratingofbetween50
and1000VforA.C.andbetween75and1500VforD.C,otherthantheequipmentandphenomenalisted
inAnnexII."
Stage2:IdentifytheapplicablerequirementsoftheDirective(s)
EachDirectivehasslightlydifferentmethodsofdemonstratingconformitydependingontheclassification
oftheproductanditsintendeduse.EveryDirectivehasanumberofessentialrequirementsthatthe
producthastomeetbeforebeingplacedonthemarket.
Thebestwaytodemonstratethattheseessentialrequirementshavebeenmetisbymeetingthe
requirementsofanapplicableharmonisedstandard,whichofferapresumptionofconformitytothe
essentialrequirements,althoughtheuseofstandardsusuallyremainsvoluntary.Harmonisedstandardscan
beidentifiedbysearchingtheOfficialJournalontheEuropeanCommissionswebsite,orbyvisitingthe
NewApproachwebsiteestablishedbytheEuropeanCommissionandEFTAwiththeEuropean
StandardisationOrganisations.
Stage3:Identifyanappropriateroutetoconformity
Althoughtheprocessisalwaysaselfdeclarationprocess,therearevariousattestationroutestoconformity
dependingontheDirectiveandclassificationoftheproduct.Someproducts(suchasinvasivemedical
devices,orfirealarmandextinguishersystems)may,tosomeextent,haveamandatoryrequirementforthe
involvementofanauthorisedthirdpartyor"notifiedbody".
Therearevariousattestationrouteswhichinclude:
Anassessmentoftheproductbythemanufacturer.
Anassessmentoftheproductbythemanufacturer,withadditionalrequirementformandatoryfactory
productioncontrolauditstobecarriedoutbyathirdparty.
Anassessmentbyathirdparty(e.g.ECtypetest),withtherequirementformandatoryfactory
productioncontrolauditstobecarriedoutbyathirdparty.
Stage4:Assessmentoftheproduct'sconformity
Whenalloftherequirementshavebeenestablished,theconformityoftheproducttotheessential
requirementsoftheDirective(s)needstobeassessed.Thisusuallyinvolvesassessmentand/ortesting,and
mayincludeanevaluationoftheconformityoftheproducttotheharmonisedstandard(s)identifiedinstep
2.

Whenthemanufacturer,importerorauthorisedrepresentativeissatisfiedthattheirproductconformstothe
applicableDirectives,anEUdeclarationofconformitymustbecompletedor,forpartlycompleted
machineryundertheMachineryDirective,anECUdeclarationofincorporation.
Therequirementsforthedeclarationvaryslightly,butwillatleastinclude:
Nameandaddressofthemanufacturer
Detailsoftheproduct(model,descriptionandtheserialnumberwhereapplicable)
ListofapplicablesectoralDirectivesandstandardsthathavebeenapplied
Astatementdeclaringthattheproductcomplieswithalloftherelevantrequirements
Signature,nameandpositionoftheresponsibleperson
Thedatethatthedeclarationwassigned
DetailsoftheauthorisedrepresentativewithintheEEA(whereapplicable)
AdditionalDirective/standardspecificrequirements
Inallcases,exceptforthePPEDirective,alloftheDirectivescanbedeclaredononedeclaration.
OnceanEUdeclarationofconformityhasbeencompleted,thefinalstepistoaffixtheCEmarking

TheCEmarkinghastobeaffixedbythemanufactureroritsauthorizedrepresentativeinthe
EuropeanUnionaccordingtoitslegalformatvisibly,legiblyandindeliblytotheproduct

89/106/EEC(constructionproducts),89/336/EEC(electromagneticcompatibility),89/392/EEC
(machinery),89/686/EEC(personalprotectiveequipment),90/384/EEC(nonautomaticweighing
instruments),90/385/EEC(activeimplantablemedicinaldevices),90/396/EEC(appliancesburning
gaseousfuels),91/263/EEC(telecommunicationsterminalequipment),92/42/EEC(newhotwater
boilersfiredwithliquidorgaseousfuels)and73/23/EEC(electricalequipmentdesignedforuse
withincertainvoltagelimits)
ThesizeoftheCEmarkingmustbeatleast5mm,ifenlargeditsproportionshavetobekept
IftheappearanceandworkmanshipofaproductdonotallowfortheCEmarkingtobeaffixedonthe
productitself,themarkinghastobeaffixedtoitspackagingoraccompanyingdocuments
IfadirectiverequirestheinvolvementofaNotifiedBodyintheconformityassessmentprocedure,its
identificationnumberhastobeputbehindtheCElogo.Thisisdoneundertheresponsibilityofthe
NotifiedBody.[1]

Emark
Onmotorvehiclesandrelatedparts,theUNECE"emark"or"Emark",ratherthantheCElogo,hastobe
used.[10]ContrarytotheCElogo,theUNECEmarksarenotselfcertified.[11]Theyarenottobeconfused
withtheestimatedsignonfoodlabels.[12]

Misuse
TheEuropeanCommissionisawarethatCEmarking,likeother
certificationsmarks,ismisused.CEmarkingissometimesaffixedto
productsthatdonotfulfillthelegalrequirementsandconditions,orit
isaffixedtoproductsforwhichitisnotrequired.Inonecaseitwas
reportedthat"Chinesemanufacturersweresubmittingwellengineered
electricalproductstoobtainconformitytestingreports,butthen
removingnonessentialcomponentsinproductiontoreducecosts".[13]
Atestof27electricalchargersfoundthatalltheeightlegitimately
brandedoneswithareputablenamemetsafetystandards,butnoneof
thoseunbrandedorwithminornamesdid,despitebearingthe
mark[13]noncompliantdeviceswereactuallypotentiallyunreliable
anddangerous,presentingelectricalandfirehazards.

CEmarknexttoaMadeinChina
text,whichisthemostcommon
situationtoday.

Therearealsocasesinwhichtheproductcomplieswiththeapplicablerequirements,buttheform,
dimensions,orproportionsofthemarkitselfarenotasspecifiedinthelegislation.[14]

Directive2006/95/EC,theLowVoltageDirective,specificallyexcludes(amongstotherthings)plugsand
socketoutletsfordomesticusewhicharenotcoveredbyanyUniondirectiveandthereforemustnotbeCE
marked.[15]ThroughouttheEU,asinotherjurisdictions,thecontrolofplugsandsocketoutletsfor
domesticuseissubjecttonationalregulations.Despitethis,theillegaluseofCEmarkingcanbefoundon
domesticplugsandsockets,particularlysocalled"universalsockets".[16]

ChinaExport
AlogoverysimilartoCEmarkinghasbeenallegedtostandfor
ChinaExportbecausesomeChinesemanufacturersapplyittotheir
products.[17]However,theEuropeanCommissionsaysthatthisisa
misconception.ThematterwasraisedattheEuropeanParliamentin
2008.[18]TheCommissionrespondedthatitwasunawareofthe
existenceofany"ChineseExport"markandthat,initsview,the
ThedifferencebetweentheCElogo
incorrectapplicationoftheCEmarkingonproductswasunrelated
andalleged"ChinaExport"mark.
toincorrectdepictionsofthesymbol,althoughbothpracticestook
place.IthadinitiatedtheproceduretoregisterCEmarkingasa
Communitycollectivetrademark,andwasindiscussionwithChineseauthoritiestoensurecompliancewith
Europeanlegislation.[19]

Legalimplications
TherearemechanismsinplacetoensurethattheCEmarkingisputonproductscorrectly.Controlling
productsbearingCEmarkingistheresponsibilityofpublicauthoritiesinmemberstates,incooperation
withtheEuropeanCommission.Citizensmaycontactnationalmarketsurveillanceauthoritiesifthemisuse
oftheCEmarkingissuspectedorifaproduct'ssafetyisquestioned.
Theprocedures,measuresandsanctionsapplyingtocounterfeitingoftheCEmarkingvaryaccordingtothe
respectivememberstate'snationaladministrativeandpenallegislation.Dependingontheseriousnessofthe
crime,economicoperatorsmaybeliabletoafineand,insomecircumstances,imprisonment.However,if
theproductisnotregardedasanimminentsafetyrisk,themanufacturermaybegivenanopportunityto
ensurethattheproductisinconformitywiththeapplicablelegislationbeforebeingforcedtotakethe
productoffthemarket.
