We work for you, the law firm, to provide sophisticated litigation support and financial due diligence analysis as a "consultant, non testifying expert" at substantially discounted rates. In this type of assignment, we render services at your direction and do not contemplate providing expert testimony at either deposition or trial. We conduct research and analysis with an eye toward buttressing your legal theories, and generating information that will advocate and support your clients position. We bill for our subcontracted professional services at a wholesale rate that your firm can mark up to industrystandard rates.

Myers & Co. subcontracted wholesale services while, at the same time, reducing overall cost to the client and optimizing the articulation of client positions.
As an advocate for your clients position, our work
product is not subject to discovery. According to the federal rules of civil procedure, Rule 26(b)(4)(D) Expert Employed Only for Trial Preparation: Ordinarily, a party may not, by interrogatories or deposition, discover facts known or opinions held by an expert who has been retained or specially employed by another party in anticipation of litigation or to prepare for trial and who is not expected to be called as a witness at trial. [Emphasis added]. Work product provided by T.A. Myers & Co. as a "consulting" expert can be passed on, in whole or in part, at your discretion, to the testifying expert.
