RESTRICTIVE COVENANTS FOR

SUGAR PATCH SUBDIVISION

BEFORE ME, the undersigned Notary Public, personally came and appeared
PATCH INVESTMENTS, L.L.C., herein referred to as “Developer”, appearing herein
through its Members and Co-Managers identified below, authorized as may be seen from
that Certificate filed for record at Conveyance Book 1417, at Page 259, under File No.
2008-00014295, Iberia Parish public records, who declared that it is the owner of the lots
situated in Sugar Patch Subdivision as shown on that plat of survey prepared by S. J.
Langlinais & Associates, Inc., Stephen J. Langlinais, P.L.S., dated December 23, 2008 with
revisions April 18, 2009 and April 30, 2009, filed for record in recorded in Conveyance
Book ________, Page _______, Under File No. ___________________ of the public records
of Iberia Parish, Louisiana, and that it hereby establishes the following covenants and
building restrictions which shall be binding upon and run with the title to said property as
hereinafter set forth below:

(1) No lot in this subdivision shall be used for any purpose other than single
family residential. No more than one residence shall be constructed on any
lot in this subdivision. No commercial activities of any kind shall be
conducted on any lot in this subdivision.

(2) The minimum living floor area of the main structure of any dwelling placed
on a lot in the subdivision (exclusive of porches, garages, carports or car
shelters) shall be 1,500 square feet. This restriction of square footage of floor
space shall not apply to multiple storied dwellings, in which case the ground
floor shall contain not less than 1,000 square feet of floor space, excluding
porches, garages, carports or car shelters. All structures, other than the
primary residential dwelling, including barns, out buildings and fences, on
said lots are to be approved by the Developer or its successor named for that
purpose, by letter of approval.

(3) No garage, metal building, house trailer, mobile home, tent, shack, barn, or
other outbuilding shall ever be used as a residence, either temporarily or
permanently, nor shall any structure of temporary character be used as a
residence; nor shall a trailer or mobile home be moved onto a lot for use as
an accessory building.

(4) No accessory building or appurtenant structure shall be permitted on any lot


for rental purposes.

(5) The roof of any building shall be constructed or covered with asphalt or
composition shingles, or factory baked enamel corrugated ribbed panel metal
roofing, or new pre-finished metal roofing of good quality.

(6) No dwelling shall be moved on any lot in the subdivision, in whole or in part,
with the exception of new dwellings or new modular dwellings meeting the
minimum square footage requirements. All dwellings situated on piers must
be completely skirted and or enclosed from the ground to the base of the
structure.

(7) All residences shall be constructed so as to front LA Highway 87 or Crochet


Road.

(8) No lot shall be re-subdivided, (with the exception of lot #39) nor shall any
dwelling be erected or placed on any re-subdivided lot, with the following
exceptions: One person may own two or more contiguous lots, and construct
a residence thereon, in which event the total of the contiguous lots shall be
considered as one lot, subject to these restrictions. It shall also be
permissible for two persons to purchase a single lot and divide it among
themselves, providing each party already owns one full size contiguous lot as
shown on the plat of record, as same may be amended from time to time. In
such event, the total area owned by one owner, the full lot and partial lot
shall be considered as one lot for purposes of these restrictions.

(9) All lot owners shall maintain proper drainage between their lot and the
adjacent lot(s), and nothing shall be constructed or erected upon any lot line,
or boundary between the lots that would restrict normal drainage or would
cause surface water to drain upon an adjacent lot.

(10) Fences shall be permitted, however no fence, wall or other similar structure
shall be erected nearer to the front lot line than the front wall of the dwelling.
Barbed wire or similar type wire material shall under no circumstance be
used for fencing. Wood fencing, vinyl fencing, lattice fencing, and hurricane
fencing are permissible.

(11) No residence shall be located on any lot nearer to the front lot line than the
minimum building setback line of 150 feet for lots fronting on Crochet Road
and 50 feet for lots fronting on La. Hwy 87. No building or appurtenant
structure shall be located nearer than ten (10) feet to its side lot line. No
accessory building or appurtenant structure shall be located closer to the
front lot line than the front of the main dwelling on such lot. No building or
appurtenant structure shall be located nearer to the rear lot line than 50 feet.

(12) Natural gas storage tanks (butane) shall be allowed provided that,
(a) all tanks shall be completely shielded from view of the neighborhood
using materials permissible for fencing as described in paragraph #10.
(b) All tanks shall be located to the rear of the main dwelling and their
location shall comply with side and rear lot line setbacks.

(13) No vacant lot in this subdivision shall be allowed to grow up in weeds and
shall be maintained in accordance with applicable parish regulations.

(14) No noxious trade or activity shall be carried on upon any lot, nor shall
anything be done thereon which may be or become an annoyance or nuisance
to the neighborhood.

(15) No abandoned or junked cars, boat trailers, or other vehicles shall be kept on
any lot in the subdivision, nor shall any lot be used for the storage of
commercial vehicles or equipment other than motor vehicles, which are, used
daily away from the premises.

(16) No lumber or other materials may be stored on any lot except for a
maximum period of 120 days prior to commencement of construction on a
building or structure on any lot, during which construction time building
materials may also be stored on said lot.

(17) No lot shall be used or maintained as a dumping ground for rubbish. Trash,
garbage or other waste shall be kept in sanitary containers.

(18) Horses may be kept provided that they are not kept, bred, or maintained for
any commercial purposes, including the raising and selling of horses. Horses
may only be kept on the lots measuring a minimum of (3) three acres in area,
provided they are kept on the rear one-third (1/3) of such lots. All structures
maintained for horses, including fences, on said lots are to be approved by
the Developer or its successor named for that purpose, by letter of approval.
Other than horses, dogs, and cats, no other animals, including livestock or
poultry may be kept on any lot in this subdivision, with the exception of those
animals, livestock or poultry to be kept and or raised as 4-H projects.

(19) No signs of any kind shall be displayed to the public view on any lot except
one sign of not more than five square feet advertising the property for sale or
rent, or signs used by a builder to advertise the property during the
construction and sales period.

(20) All electrical and or cable service to houses and or out buildings erected in
the subdivision shall be placed underground, at the expense of the purchaser.

(21) With the exception of Lots 1 through 3 and 33 through 39, all sewer
discharge lines shall be run to the rear property line and discharge into the
ditch along the rear property line.

(22) No trucks, vans, trailers, boats, or any vehicle other than a passenger car will
be permitted to park in yards or in front of any residence for longer than a
twelve (12) hour period. No vehicle shall be abandoned or junked in this
subdivision by any lot owner.

(23) No oil drilling, oil development operations, or mining operations of any kind
shall be permitted upon or in any lot, nor shall tanks, tunnels, mineral
excavations, or shafts be permitted upon or in any lot. No derrick or any
other structure designed for use in boring oil or natural gas shall be erected
or permitted within this subdivision. This does not prohibit the development,
outside of this subdivision area, of mineral production by directional drilling
from adjacent properties. Developer reserves all oil, gas, and other minerals
in, or under all of the property described herein.

(24) Easements for installation and maintenance of utilities and drainage facilities
are reserved as shown on the recorded plat. The developers shall not be
liable for any damage done by them, their assigns, agents, employees, to
shrubbery, trees, or flowers or other property of the owners situated on the
land covered by said easements.

(25) These restrictions shall continue in force and effect for a period of fifteen (15)
years from the date hereof and shall be automatically extended for successive
periods of ten (10) years. These restrictions may be altered or amended at
any time by a vote of the owners of more than one-half (1/2) of the lots in the
subdivision, provided that Developer’s consent shall be required for any
amendment until Developer no longer owns any lot in the subdivision.

(26) The failure by a landowner to enforce any restrictions, conditions, covenants


or agreements imposed herein shall in no event be deemed a waiver of the
right to do so thereafter as to that breach, or as to one occurring prior or
subsequent thereto.

(27) The provisions contained herein shall run with the title to and bind that land
of this subdivision and shall insure to the benefit of and be enforceable by
any owner of the land, included in this subdivision, their respective legal
representatives, their successors and assigns.

(28) Invalidation of anyone of these covenants by a judgment or a court order


shall in no way affect any of the other provisions, which shall remain in full
force and effect.
