WindChill’s Law Task Force by Polly Niemi

WindChill’s abusers had watched him starve outside their kitchen window, yet it was very difficult for the D.A. to prosecute
the case. They plea-bargained animal and domestic abuse charges down to a slap on the wrist. The words of their pre-
school child to Kathi spoke volumes: “Are you finally here to help the little horse?” These actions and lack of consequences
told him that abuse was okay. Thus WindChill’s Law Task Force was formed to change the Wisconsin Laws to stop animal
abuse.
Kathy J., Trish P., Robin R., and JoAnn P., volunteered to do research. Polly N. facilitated and edited. The 50 states were
divided up, and this group read every statute concerning animal abuse and neglect from every state, including some still in
legislative committees. Over a 6-month period they met regularly to discuss what was found, what needed changing and
what did not, and why. Better laws found in other states were all inserted into the current WI statutes. The 25 page
document was edited down to 7 pages with end notes, citing the states of origin for the changes. After a final edit by Kathi
T., the document was presented to Representative Milroy for sponsorship.
Representative Milroy agreed to sponsor a bill drafted from this document and asked Senator Jauch to introduce it in the
Senate, becoming AB 747 and SB 555. Dubbed WindChill’s Law, it adds animals to restraining orders, increases penalties for
those who believe the laws of WI don’t apply to them, and provides for evaluation, anger management, and counseling in
sentencing.
A public hearing is required of the assigned committee in each house, in this case the Assembly’s Criminal Justice Committee
and the Senate’s Judiciary Committee. The first hearing was before the 11 members of the Assembly Criminal Justice
Committee. Kathi and Polly went down a day early each time to deliver information and speak with legislators and staff
members. Staff members are crucial to legislators, as they carefully read each bill, research background and how other
states handle issues, and advise the legislators on their vote. The first hearing went very well; Representative Milroy spoke
first, followed by Kathi T, Jeff T, Polly N. Paula M., Kathy J., Gary N., Trish P., and Carole B. and JoAnn P. offered moral
support. Several opposing groups were there to speak against the bill as well. There was question after question for the
first couple Legacy speakers. It became apparent to the committee, that Legacy members were just who they claimed to be:
Ordinary people, trying to right a wrong. The main question, asked to both sides, over and over by the Chair of the
Committee was “Are you willing to work together to resolve these differences?”
Kathi and Polly met with Senator Taylor’s clerk after the first hearing, and were pleasantly surprised when the Senate
Judiciary Committee’s hearing was set for the following week, almost unheard-of speed. Legacy members made the 5 ½
hour trip back to Madison a week later to speak before the five members of the Senate Committee.
It was apparent that language changes were needed in the bill after the first hearing. A meeting was set with groups that
opposed the bill, legal counsel, Representative Milroy, Kathi, and Polly. The legal advisors used the WCL Task Force’s
original document to find clearer language from other states, and a substitute amendment was created. The amended bill
resulted in several crucial opposition groups changing their status to unopposed, a major difference for passage of the bill.

The Senators and Representatives on these committees must be contacted about how they will vote now that there is new
language. Representative Milroy and Senator Jauch will call for committee votes when there are enough votes to pass. This
has to be done quickly to allow time to secure votes in the full Senate and Assembly for the bill to pass before the end of the
session which is the 3rd week in April. Professional lobbyists do the persuading for the large, powerful groups who retain
them: Kathi and Polly are the Legacy’s lobbyists. If the bill does not move out of the committee or if enough votes cannot be
garnered to pass through both houses, the bill will have to be re-introduced next session, which convenes in January, and
the whole process must begin again.

WindChill’s Law is truly a grassroots effort done by caring, ordinary folks who saw the need to change the Wisconsin
statutes. This is from their hearts and souls, with love, hope, and faith for all those who are battered and neglected through
no fault of their own. The goal is to stop the circle of abuse. The WindChill’s Law Task Force research documents are
available to all who want to do the same in their states.
