The following documents are attached to this item: (1) a letter to the members of the board signed by representatives of 13 different groups asking the board to adopt a resolution in support of the U.S. Forest Service recommendations for wilderness in the Nantahala-Pisgah Forest Management Plan that is currently under revision, (2) a map of the Macon County Wildemess Area Inventory and (3) a document containing definitions and information about forest planning. The group did not prepare a proposed resolution for the board’s consideration. Forest Service Management Plan for the Nantahala-Pisgah National Forests that reflects the current demands of Western North Carolina’s population and economy, particularly Macon County. Since the last forest plan was finalized over 20 years ago, our region and county have ‘grown tremendously, and will continue to grow significantly over the course of this new forest plan. This growth reflects a demand for living in a landscape where our green infrastructure ensures a high quality of life, and where we protect the values that motivate people to live here today, as well as those values that have motivated generations in the past. We ask that the Macon County Board of Commissioners adopt a resolution in support of the U.S. Forest. Service recommendations for Wilderness in the Nantahala-Pisgah Forest Management Plan that is currently under revision. Visitors travel to Macon County for its scenic beauty and recreation opportunities, including its two designated Wilderness areas (Ellicott Rock and Southern Nantahala), and its, extensive trail system (including the extremely popular Appalachian and Bartram Trails). Largely as a result of these attractions, Franklin recently received Blue Ridge Outdoor Magazine’s 2015 Top Small Town award due to its outstanding recreational opportunities and amenities. In addition, the town of Franklin is an Appalachian Trail Community and receives publicity through the Appalachian Trail Conservancy and the national organizations to which it is connected. Both of these titles bring Macon County widespread recognition, drawing outdoor | | enthusiasts and tourists who greatly bolster our local economy. According to the N.C. Department of Commerce, from 2003-2013, expenditures related to tourism in Macon County rose from neatly $86 million to $141 million per year, generating nearly $11 million annually in county tax receipts. In 2014, tourists spent $148.8 million in Macon County, according to a study generated by Westem Carolina University. Given these economic benefits, we envision a plan that protects these important economic and public resources, and recommends more such ‘opportunities by including new Wilderness recommendations in Macon County. Macon County contains over 152,000 acres of Nantahala National Forest, but only 6,600 actes (approximately 4 percent) are currently designated as Wilderness. However, the recently released United States Forest Service (USFS) inventory of Wilderness Inventory Areas (WIAs; Table 1) in Macon County shows that 47,000 acres will be evaluated for Wildemess recommendation (Table 1). While we do not believe that all of this acreage should be recommended as Wilderness, we do believe that certain areas in Macon County deserve this high level of protection, particularly the additions to the existing Southern Nantahala and Ellicott Rock Wilderness Areas as well as Overflow Wilderness Study Area and Tusquitee Bald (which has additional acreage in Clay County). In addition, we would support any Wilderness recommendations for the WIAs along the Appalachian Trail (A.T.) corridor in Macon County, including Wesser Bald, Tellico Bald, Siler Bald (excluding the area between Wayah Crest and the southern edge of Snowbird Gap), and ‘Chunky Gal. Wildemess designation for these areas would preserve the primeval landscape and wild character that gives our A.T. section its unique attraction for people seeking connection to unspoiled forests. If not recommended for Wildemess, we recommend these WIAs be placed in ‘Management Area 3-Backcountry. Table 1, US, Forest Service Wildemess Inventory Areas in Macon County, NC. National Forest lands designated as Wilderness would continue to be open to all Macon County citizens and visitors. ‘We support the current traditional uses of hunting and fishing on the National Forest and know that our recommendations are compatible with these uses. Wildemess allows hunting, fishing, camping, hiking, and horseback riding — uses that contribute greatly to our local economy and the quality of life that we seek to promote and protect. In addition, we support the creation of early successional habitat on those appropriate lands that are not Wilderness quality, as we support the efforts of local hunting groups to increase game populations within the proposed management plan. Macon County is rich in natural resources and beauty, and we should protect these * resources to ensure that Macon County citizens continue to enjoy a high quality of life. We hope you agree that permanently protecting a small percentage of our public lands in Macon County as Wilderness is a legacy that we owe future generations. Macon County is in a position to become a leader in Western North Carolina by acknowledging the importance of Wildemess and the historical, ecological and cultural legacy that Wilderness preserves. October 2015) Appendix B: Definitions and information about forest planning Definitions and Information about the Wilderness Recommendation Process Wilderness Study Area ‘National Forest System (FS) lands designated by Congress for further study before final designation as Wilderness. These lands are managed in the same manner as designated Wildemess, so that, if they become wilderness, their Wildemess character is preserved. (definition taken from wilderness.net).. ‘Management Area 3- Backcountry (MA 3; previously called MA $ Backcountry) ‘Administrative designations like MA 3 can be changed in subsequent plans, meaning that they do not offer permanent protection as Wilderness does. MA 3-Backcountry (MA 5 in the 1994 plan) emphasizes backcountry areas where there is little evidence of other humans or human activities other than recreation use. A large block of land is necessary to ensure relative freedom from the sights and sounds of people. An unroaded forested environment, and natural appearing forest with large, old trees are desirable. This management area provides large blocks of habitat relatively undisturbed by human developments that some species prefer. Visitors using these areas for backcountry activities are less likely to encounter other people. - Emphasize a semi-primitive recreational setting - Provide non-motorized reaction use - Close all roads to private motorized vehicles ~ Classify land as not suitable for timber production in order to qualify for semi-primitive, non-motorized recreational settings and wildlife habitats that require large blocks of undisturbed land - Manage habitat of mature forests for bear and animals requiring similar environments (Land and Resource Management Plan, Nantahala-Pisgah National Forests, Amendment 5, March 1994) Wilderness Recommendation Process ‘The wilderness recommendation process has a sequence of steps: inventory, evaluation, analysis, and recommendation, - Inventory: The primary function of the inventory step is to identify all lands in the plan area that may have wilderness characteristics as defined in the Wildemess Act. The inventory is intended to be reasonably broad snd inclusive, based on the inventory eriteria and additional information from public participation, Lands included in the inventory (Wilderness Inventory Arcas, WIAs) will be carried forward for evaluation. - Evaluation: The U.S. Forest Service (USFS) evaluates the wilderness characteristics of the Wildemess Inventory Areas (WIAs). To conduct the evaluation, the USFS applies criteria that are based on the Wildemess Act of 1964 and informed by the Eastern Wildemess Act of 1975 - Analysis: The USFS considers the WIAs evaluated and determines which areas to further analyze for recommendation as part of one or more alternatives in the applicable National Jan, 2015 1 Jan. 2015 Environmental Policy Act (NEPA). Not all lands included in the inventory and subsequent evaluations are required to be analyzed for recommendation. Recommendation: The USFS decides whether to recommend specific areas for inclusion in the National Wildemess Preservation System or as a Wilderness Study Area based on the analysis disclosed in the applicable NEPA document and input received during public participation opportunities. This decision must be included in the final decision document for the plan. The final decision document must identify the wildemess recommendation proposal as a “preliminary administrative recommendation” and qualify it by stating: This recommendation is a preliminary administrative recommendation that will receive further review and possible modification by the Chief of the Forest Service, the Secretary of Agriculture, and the President of the United States. The Congress has reserved the authority to make final decisions on wilderness designation. Plan implementation is not dependent upon subsequent action related recommendations for wilderness designation. ‘The decision document must affirm that the plan includes plan components that provide for managing areas recommended for wilderness designation to protect and maintain the ecological and social characteristics that provide the basis for each area's suitability for wilderness recommendation. Private Dri Water Well August 2015 A private drinking water well as defined in G.S. 87-85 (103) Repair Permit PDWW. According to 15A NCAC 02C .0302 the definition of 2 “repaix” is work involved in deepening, reaming, sealing, installing or changing casing depths, perforating, screening, or cleaning, acidizing or redevelopment ofa well excavation, or any other work which results in breaking or opening the well seal. This definition is supported by the NC Division of Environmental Healt (DEH) whose comments at a tecent meeting included that deepening ot hydro fracturing the well is considered tepairs. However, though the definition of a “tepair” is very clear it does not differentiate the amount of work involved in actually permitting these activities and therefore should not be used in determining fee structure. Fee structure is determined by the actual direct and indirect costs involved in conducting an activity, Note: These repair activities require an application by the owner/agent and a Construction Permit issued before any of these driling activities can proceed. 15A NCAC 02C .0304 requires Environmental Health staff to conduct a field investigation to evaluate the propetty before issuing any permit. ‘The level of time and effort required to petfotm the site evaluation for the above repair activities is no different than for a new construction permits. It is possible . that a permit would be denied because of existing site conditions ot inability to mect set back requirements. During this closed session the consensus of the board was not to buy the property but instead to see whet if anything the county could do to assist the growers association in their marketing and potential sale of the same. On December 18, 2035 Commissioner Tate, Chester Jones, Butch Deal and Mr. Ashe of the growers association sat down with me in my office. Our discussion focused on what if anything the county could do to assist the growers association in selling this, property. This discussion came following a request by Mr. Deal, to sit down with county representatives and basically find out what the “growers association could and could not do” under the terms of the current deed arrangement. Mr. Deal felt it was pertinent for this discussion to happen sooner than later as there are currently parties interested in purchasing the Co-Op property. I would request for the Board of Commissioners to consider the following prior to our January meeting. The representatives from the growers association were in full agreement with this proposal. If we choose to act now, | ‘would need 100% consensus to move forward. ‘* County pay for property to be appraised, in order for the growers association and the county to have a better understanding of today's market value for the land and buildings. Additionally, the appraisal will lead to new and up-to-date percentages of land vs. building value which directly affects the amount of profit gained from sale of the property by both the county and the growers association. a. Tax Office Currently has +/-7,500 concrete block building listed as being builtin 1960. In all reality however, this building was constructed in 1984. This approximate 24 year difference has a substantial negative effect on the value of the building. The 2012 appraisal used the 1960 date of construction as. ‘supplied by the tax office rather than the correct 1984 date. b. While the deed requires three appraisals of this property to be performed prior to sale, past correspondence between the county and growers association indicates that if both parties agree a single appraisal is acceptable. '* The first step in this process if the county agrees to move forward with this suggestion would be to author County Attorney to draft a letter of engagement for appraisal services. | would recommend this letter include anot to exceed amount of $4000 for the appraisal. COUNTY MANAGER’S COMMENTS/RECOMMENDATION: Attachments___X_Yes Agenda Item 12(A) and (B) MACON COUNTY BOARD OF COMMISSIONERS DECEMBER 8, 2015 MINUTES The County Manager called the meeting to order at 6:00 p.m. and welcomed those in attendance. All Board Members, the Deputy Clerk, Finance Director, County Attorney, members of the news media and interested citizens were present. ELECTION OF CHAIRMAN: Per state statute, the County Manager conducted the election for the office of chairman, and opened the floor for nominations. Commissioner Tate nominated Commissioner Corbin as chairman, and the nomination was seconded by Commissioner Beale. There were no other nominations. With no further discussion, the County Manager closed nominations and called for a vote on the motion, which was approved unanimously. The gavel was then passed to Chairman Corbin. ELECTION OF VICE-CHAIRMAN: Chairman Corbin opened the floor for nominations for the office of vice-chairman, and Commissioner Beale nominated Commissioner Tate as vice-chairman. The nomination was seconded by Commissioner Shields. There were no other nominations. EXAMINATION OF OFFICIAL BOND FOR PUBLIC OFFICIALS OF MACON COUNTY: The County Manager explained that North Carolina General Statute (NCGS) 58-72 requires that the board annually examine the bonds of the public officers listed in NCGS 58-72.12, which includes the Finance Director, Tax Administrator, Register of Deeds and Sheriff. Upon a motion by Commissioner Shields, seconded by Commissioner Higdon, the board voted unanimously to approve a resolution entitled “Examination of Official Bonds for Public Officials of Macon County,” a copy of which is attached (Attachment 1) and is hereby made a part of these minutes. Minutes 12.08.15 Page 1 of 6 ADOPTION OF 2016 REGULAR MEETING SCHUDULE: Chairman Corbin reviewed the list of the planned dates for the board’s regular meetings for the upcoming year, which will continue to be held on the second Tuesday of each month beginning at 6 p.m. Commissioner Shields questioned whether the board would want to meet on Election Day on November 8 as planned. The members discussed changing the date, but the County Attorney noted that the proper resolution had not been prepared. Chairman Corbin suggested moving the November meeting to the 15%, and the board agreed by consensus to have the County Attorney prepare a resolution establishing a new schedule of regular meetings of the board for its consideration at the January meeting. No formal action was taken. ANNOUNCEMENTS: Those in attendance watched a video from the North Carolina Association of County Commissioners (NCACC) that provided an update on recent NCACC activities.
