JUDICIAL AFFIDAVIT
OF JUAN DE LA CRUZ
OFFER OF EVIDENCE:
We are presenting the testimony of accused JUAN DE LA CRUZ,
45 years old, married and presently residing at No. 1 Bonifacio Street,
Baguio City to prove that he is not guilty of the crime charged in the
information as he acted in self-defense. This judicial affidavit was taken
in question-and- answer form on December 8, 2015 inside the office of
Atty. Christine Marie Arenas at no. 6 Bonifacio Street, Dagupan City.
The questions were propounded in Pilipino dialect, the language known
to affiant, and his answers were also given in the same Pilipino dialect.
The translations in English, as written below, were made by the
undersigned counsel. Affiant was appraised that any false testimony
given by him may subject him to prosecution for perjury, which
consequence was fully explained to him.
Q. 1. ATTY. ARENAS:

Mr. witness, will you please state your name,


residence and other personal circumstances

WITNESS:

I am JUAN DE LA CRUZ, 40 years old, married,


a bus driver by occupation and presently
residing at No. 1 Bonifacio Street, Baguio City.

Q. 2. ATTY. ARENAS:

Mr. witness, how are you related to the victim in


this case?

WITNESS:

She is my wife, sir.

Q.3. ATTY. ARENAS:

You are being accused for parricide, what can


you say about it?

WITNESS:

I admit that I killed her, but I did it in selfdefense, sir.

Q.4. ATTY. ARENAS:

Will you narrate to the court what happened on


the night of November 2, 2015, at exactly 6
P.M.?

WITNESS:

I surprised my wife naked and in the act of


having sex with another man inside our room
and in our bed.

Q.5ATTY. ARENAS:

When you saw your wife in that act, what


If any did you do?

WITNESS:

I became very angry and I went after the man,


however, he was able to run and fled out of the
house through the window in our room.

Q.6. ATTY. ARENAS:

After the man left, what happened next, if any?

WITNESS:

I tried to lounge at my wife, however, she was


able to elude me and got hold of a pair of
scissors, which she used in stabbing me.
However, I was able to elude it and got hold of a
baseball bat, and because she continued to
stab me, I hit her with the bat in the head
causing her to lose her consciousness.

Q.7. ATTY. ARENAS:

When you saw her lose her consciousness,


what did you do, if any?

WITNESS:

I took her pulse, but there was none, so I tried


to revive her but she was already dead. That
was the time when I called the police.

ATTY. ARENAS

That would be all.
