MEMORANDUM OF AGREEMENT TO BE ENTERED INTO BY AND BETWEEN
PARKLANE WEST ACADEMY, INC. AND THE CITY GOVERNMENT OF
DAVAO TO ALLOW THE STUDENTS OF THE ACADEMY TO UNDERGO ON
THE JOB TRAINING PROGRAM IN THE FACILITY OF THE DAVAO CITY
TREATMENT AND REHABILITATION CENTER FOR DRUG DEPENDENTS

Background
1.

This pertains to the proposed Memorandum of Agreement to be entered into

by and between the City Government of Davao and Parklane West Academy. Under
this agreement, the Health Care Services students of the latter party will undergo
training at the Davao City Treatment and Rehabilitation Center for Drug
Dependents.

Highlights
2. The City Government of Davao supervises the operations of Davao City
Treatment and Rehabilitation Center for Drug Dependents.
3. Parklane West Academy, Inc. is an educational institution which offers Health
Care Services NC II courses. It requires students under said programs to undergo
on-the-job training with a health care facility.
4. The City allows the use of its facilities for the affiliation and training of students.
It undertakes to orient the students regarding its vision, mission, goals, policies and
rules.
5. Upon the other hand, Parklane West Academy will be the one who will organize
and coordinate the schedule of affiliation of its students, arrange the shifts, and
provide Clinical Instructors to monitor, organize and supervise the students.
6. This agreement will be effective for three (3) years and it will commence on
August 3, 2015.
7. According to Ms. Perla Redulosa, the Assistant Center Manager of DCTRCDD, the
center will benefit from the extra help. The students will also learn a lot from the
training.

Recommendations
8. This Committee recommends that the City Mayor be granted the authority to
sign the Memorandum of Agreement. As such, a Resolution entitled A RESOLUTION
TO ENACT AN ORDINANCE GRANTING AUTHORITY TO CITY MAYOR RODRIGO R.
DUTERTE TO SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT OF DAVAO THE
MEMORANDUM OF AGREEMENT BETWEEN THE CITY GIVERNMENT OF DAVAO AND
PARKLANE WEST ACADEMY, INC. FOR THE HEALTH CARE SERVICES NC II STUDENTS
OF THE LATTER TO BE TRAINED AT DAVAO CITY TREATMENT AND REHABILITATION
CENTER FOR DRUG DEPENDENTS (DCTRCDD) must be passed.

A RESOLUTION TO ENACT AN ORDINANCE GRANTING AUTHORITY TO CITY

MAYOR RODRIGO R. DUTERTE TO SIGN FOR AND IN BEHALF OF THE CITY
GOVERNMENT OF DAVAO THE MEMORANDUM OF AGREEMENT BETWEEN
THE CITY GIVERNMENT OF DAVAO AND PARKLANE WEST ACADEMY, INC.
FOR THE HEALTH CARE SERVICES NC II STUDENTS OF THE LATTER TO BE
TRAINED AT DAVAO CITY TREATMENT AND REHABILITATION CENTER FOR
DRUG DEPENDENTS (DCTRCDD)
WHEREAS, pursuant to Section 7, paragraph b, sub-paragraph (2) (iv) of the Local
Government Code on Basic Services and Facilities, a local government unit shall
have social welfare services which include programs and projects on child and youth
welfare and welfare of the elderly and differently-abled persons;
WHEREAS, the City Government of Davao supervises the operations of health care
referral centers known as Davao City Treatment And Rehabilitation Center For Drug
Dependents (DCTRCDD);
WHEREAS, Parklane West Academy, Inc. is an educational foundation which
offers Health Care Services NC II courses. It requires students under said
programs to undergo training with a health care facility;
WHEREAS, the City allows the use of its facilities for the training of students;

NOW THEREFORE, be it resolved as it is hereby resolved to enact an

ordinance granting authority to City Mayor Rodrigo R. Duterte to enter into
and sign for and in behalf of the City Government Of Davao the
memorandum of agreement between the City Government Of Davao and
Parklane West Academy, Inc. for the Health Care Services NC II students of
the latter to be trained at Davao City Treatment And Rehabilitation Center For
Drug Dependents (DCTRCDD).

RESOLVED FURTHER, that copies of this resolution to enact an ordinance

be furnished to the Office of the Secretary to the Sangguniang Panlungsod,
City Mayors Office, DCTRCDD, Parklane West Academy, Inc. and all other
offices/departments concerned, for their information and guidance.

Be it ordained by the Sangguniang Panlungsod of Davao City in session

assembled that:
SECTION 1. TITLE This ordinance shall be known as
SECTION 2. DECLARATION OF POLICY - Section 455, (b) (1) (vi) of
the Local Government Code provides, to wit:
For efficient, effective and economical governance the purpose of
which is the general welfare of the city and its inhabitants pursuant to
Section 16 of this Code, the city mayor shall represent the city in all its
business transactions and sign in its behalf all bonds, contracts, and
obligations, and such other documents upon authority of the
Sangguniang Panlungsod or pursuant to law or ordinance;
SECTION 3. AUTHORITY The City Mayor Rodrigo R. Duterte is hereby
granted legislative authority to sign, for and in behalf of the City Government of
Davao, the Memorandum of Agreement to be entered into by and between Parklane
West Academy, Inc. and the City Government of Davao for the Health Care Services
NC II students of the latter to be trained at Davao City Treatment And Rehabilitation
Center For Drug Dependents (DCTRCDD).
SECTION 4. SEPARABILITY CLAUSE If for any reason, any section or
provision of this ordinance is declared unconstitutional or invalid, other sections or
provisions hereof not affected by such declaration shall continue to be in full force
and effect.
SECTION 5. EFFECTIVITY CLAUSE This Ordinance shall take effect
immediately upon approval.
