INTRODUCTION
Cyber squatting has become an increasing source of annoyance and problem in the internet
world. Apart from some of the other issues such as internet security, hacking and frauds, which
usually occur after going online, Cyber Squatting is the first major problem faced by any
company well before they even setup an internet web site. Before moving on to the various
issues, it is often unclear of what Cyber Squatting actually is. So therefor the question is
Does cybersquatting influence the economy and its workers?
Simply cyber squatting means the registration of a name in violation of a trademark or
business name or other intellectual property of its owners. This includes the registration of a
name deceptively similar to such business name or trademark.
BIRTH
The cyber squatting was born in the late nineties, and has had a remarkable development also
in Europe, and in taly, especially in following 1999.
U.S. Eastern District of Pennsylvania, Judge Berle M. Schiller defined cyber-squatting or cyberpiracy as the "deliberate, bad-faith, and abusive registration of Internet and describes this
action as violation of the rights of trademark owners.
CURRENT PROBEMS
Going back to the problem of cyber squatting we can refer to a much earlier case in China.
This was the time when Chinese corporations did not enjoy the protection of the law against
cyber squatters.
In the past few years, many cyber squatters registered the names of many famous Chinese
companies. As a result, these Chinese companies were forced to pay large sums to 'reclaim'

their domain names.

In this case the only way Chinese companies could resolve the issue was to either pay large
sums of money to the domain squatter .But since then any many other complaints the Chinese
government legislated new laws which gave more protection against cyber squatters.
Also The UNITED STATES OF America has been the first country in the world to deal with the
fight against legislation. It Is from Anticybersquatting Consumer Protection, which came into
force on 29 November 1999.
Either in Italy we are fighting against cybersqatting whuch cost us a lot of problems in the past.

The problem in the case was the famous Swedish furniture company owning the trademark
IKEA. The fabric registered the word 'IKEA' as a domain name in China. In the trial, the
defendant argued that they did not know that 'IKEA' was a trademark owned by them when
they registered it. The defendant also argued that they registered 'IKEA' as domain name
because the letter 'I' stood for Internet and the letters 'KEA' stood for 'a parrot learning to
speak'. China was started defeding itself and started a proper buisness war.
With this episode we see that under new laws corporation which have a trademark exactly
matching or very similar to the domain name have the right complaint against parties already
registered intentionally or unintentionally.
Moving to the similar and more severe issue of domain problems there have been many cases
around world that talks about this issue. The important questions that ive come up with from
this definition are: if this domain speculation issues are reallly serious why arent countries
providing new protections to make the world safer?
the answer to the first question, is that domain speculators often use the educated guessing
mechanism of guessing domain names which are very close to the trademark name of a
corporation but not exactly the same . An example would we with Gmail.com and gmail.com
ecc . Users may write it wrong but this may lead to the company requiring registration of
additional domains names for customer service. This is where domain speculators come into
play, asking for large sums of money for such names.
The second answer is that this infridgment arent always everywhere like in United states,
violating the trademark isnt an issue. But in other countries like india or Italy is a very bad
issue.
The laws in the United States do not prevent domain speculation. This has stirred some
serious concerns but at this moment there are people and even corporation out there making a
lot of money by harassing people or corporation in need of domain names.
