SUMMARY:Thisamendmentadoptsanewairworthinessdirective(AD)thatis
applicabletocertainRaytheonModelBeech400,400A,and400Tseries
airplanesModelBeechMU30010airplanesandModelMitsubishiMU300
airplanes.Thisactionrequiresrepetitiveinspectionstodetectcrackinginthe
radiusofthecutoutoftheaftflangeoftheleftengineforwardcarrythroughmount
bracket,andreplacementwithanewbracketandfittingifnecessary.Thisaction
isnecessarytopreventfailureoftheenginemountandpossiblelossofthe
engine,andconsequentlossofcontroloftheairplane.Thisactionisintendedto
addresstheidentifiedunsafecondition.

SUPPLEMENTARYINFORMATION:TheFAAhasbeenadvisedthatcertain
enginemountsonaffectedairplaneshavedevelopedcracks.Oneoperator
discoveredcrackingduringaroutineinspectionontheaftflangeoftheleftengine
forwardcarrythroughmountbracket.Additionalairplanesweresubsequently
inspected,andcrackingwasdiscoveredinthesamelocationonfourairplanes.At
thetimeofthecrackfindings,allofthoseairplaneshadaccumulatedbetween
2,000and3,000totalflighthours,andallwereequippedwiththrustreversers.
Thecracksoriginateintheradiusofthecutoutoftheaftflangeoftheengine
mountbrackets.Thepurposeofthecutoutistoprovideclearanceforcertain
enginecomponents.Becausealloftheseairplaneswereequippedwiththrust
reversers,itwasinitiallydeterminedthattheconditionwouldbefoundonlyon
airplaneswiththrustreversers.However,similarcrackingwaslaterdiscoveredon
anumberofairplaneswithoutthrustreversers.Thecauseofthecrackinghasnot
beendetermined.Thiscondition,ifnotcorrected,couldresultinfailureofthe
enginemountandpossiblelossoftheengine,andconsequentlossofcontrolof
theairplane.
ExplanationofRelevantServiceInformation
TheFAAhasreviewedandapprovedRaytheonSafetyCommuniqueNo.189,
Revision1,datedJanuary2002,whichdescribesproceduresforaonetimevisual
inspectiontodetectevidenceofcrackingoftheleftengineforwardcarrythrough
mountbracket,andasubsequentonetimefluorescentpenetrantinspectionto
detectcrackinginthesamearea.Thecommuniquerecommendsimmediate
replacementofanycrackedbracketwithanewbracketandfitting.

Sinceanunsafeconditionhasbeenidentifiedthatislikelytoexistordevelopon
otherRaytheonModelBeech400,400A,and400TseriesairplanesModelBeech
MU30010airplanesandModelMitsubishiMU300airplanesofthesametype
design,thisADisbeingissuedtopreventfailureoftheenginemountand
possiblelossoftheengine,andconsequentlossofcontroloftheairplane.This
ADrequiresrepetitiveinspectionstodetectcrackingintheradiusofthecutoutof
theaftflangeoftheleftengineforwardcarrythroughmountbracket,and
replacementwithanewbracketandfittingifnecessary.Theactionsarerequired
tobeaccomplishedinaccordancewiththeserviceinformationdescribed
previously,exceptasdiscussedbelow.
RequirementsforFerryFlightPermit
TheFAAhasdeterminedthataferryflightpermit,ifgranted,mustincludecertain
limitationsforairplanesequippedwiththrustreversers,duetotheincreasedloads
andvibrationlevelsassociatedwiththrustreverseroperation.
DifferencesBetweenADandRelevantServiceInformation
TheapplicabilityofthisADandthemanufacturer'sSafetyCommuniqueNo.189
areidenticalwiththeexceptionofoneserialnumber.ForBeechMU30010
airplanes,thecommuniquespecifiesserialnumbersA1001SAthrough1010SA
inclusive.ThetypecertificationdatasheetforthismodelspecifiesA1011SAas
thelastserialnumber.TheFAAassumesserialnumberA1011SAmayhavebeen
convertedtoadifferentmodelandreidentifiedandthereforehasdeterminedthat
itisnecessarytoincludeserialnumberA1011SAintheapplicabilityofthisADto
ensuretheinclusionofallairplanessubjecttotheidentifiedunsafecondition.
Inaddition,SafetyCommuniqueNo.189recommendsinspectionofthesubject
areaviaaonetimevisualinspectionwithin25flighthours(forairplaneswithmore
than1,500totalflighthours)andaonetimefluorescentpenetrantinspection
within50flighthours.However,inlightofthepotentialseverityoftheunsafe
conditionandtheuncertaintyofthecauseoftheprematurecracking,theFAA
findstheserecommendationsinadequatetoaddresstheidentifiedunsafe
conditioninatimelymanner.TheFAAhasdeterminedthatafluorescent
penetrantinspectioncoulddetectcrackingthatavisualinspectionmightmiss.
Also,theFAAhasdeterminedthattheinitialinspectionmustbeperformedatthe
earlierof14daysor25flighthours,andthattheinspectionsmustberepetitively
performed,totimelydetectcrackingthatcouldcontributetotheunsafecondition.
IndevelopingappropriateactionsandcompliancetimesforthisAD,theFAA
considerednotonlythemanufacturer'srecommendations,buttheavailabilityof
parts,theaverageutilizationoftheaffectedfleet,thetimenecessarytoperform
aninspection(2workhours),andthedegreeofurgencyassociatedwith
addressingtheidentifiedunsafecondition.Inlightofallofthesefactors,theFAA
findsinitialandrepetitivefluorescentpenetrantinspectionstobewarranted,in
thattheywillprovidemoredetaileddata,allowoperatorstodetectcrackingbefore
itbecomesahazardtothestructure,andprovidethenecessarycontinued
operationalsafetyforthefleet.
InterimAction
Thisisconsideredtobeinterimactionuntilfinalactionisidentified,atwhichtime
theFAAmayconsiderfurtherrulemaking.

Sinceasituationexiststhatrequirestheimmediateadoptionofthisregulation,it
isfoundthatnoticeandopportunityforpriorpubliccommenthereonare
impracticable,andthatgoodcauseexistsformakingthisamendmenteffectivein
lessthan30days.

Althoughthisactionisintheformofafinalrulethatinvolvesrequirements
affectingflightsafetyand,thus,wasnotprecededbynoticeandanopportunityfor
publiccomment,commentsareinvitedonthisrule.Interestedpersonsareinvited
tocommentonthisrulebysubmittingsuchwrittendata,views,orargumentsas
theymaydesire.CommunicationsshallidentifytheRulesDocketnumberandbe
submittedintriplicatetotheaddressspecifiedunderthecaptionADDRESSES.

RegulatoryImpact
Theregulationsadoptedhereinwillnothaveasubstantialdirecteffectonthe
States,ontherelationshipbetweenthenationalGovernmentandtheStates,or
onthedistributionofpowerandresponsibilitiesamongthevariouslevelsof
government.Therefore,itisdeterminedthatthisfinalruledoesnothave
federalismimplicationsunderExecutiveOrder13132.
TheFAAhasdeterminedthatthisregulationisanemergencyregulationthatmust
beissuedimmediatelytocorrectanunsafeconditioninaircraft,andthatitisnota
"significantregulatoryaction"underExecutiveOrder12866.Ithasbeen
determinedfurtherthatthisactioninvolvesanemergencyregulationunderDOT
