Tribes are the TON, Cocopah, and Quechan. The Border Patrol has established a continuing
relationship with these Nations and continue to coordinate Tactical Infrastructure construction and also
access with them.

General:

A significant amount of coordination has occurred with the Tohono O'odham Nation that has involved
members of the project teams and is fairly routine. For both the Cocopah and Quechan the S.O.P. has
been for coordination to be primarily through OBP personnel (b) (6)
is trying to make contact with those personnel for the latest information relative this data call.

Tohono O'odham:

Tucson Sector
Projects DV-2, DV-3a, DV-3b, DV-4a, DV-4b, and DV-5

For all of the projects except DV-5, we have existing Resolutions giving us
access to perform the VF300 project on the Nation. These resolutions allow
us to use the previously cleared staging and access also.

For DV-5, OBP is working with the TON to get permission to do the planning
investigations (design and environmental surveys); OBP has already presented
to the Village of Newfield, and the next step is that the Village is going
to talk internally and give their decision to OBP, and then the District
will give their concurrence with the Village. OBP is actively engaging the
TON representatives to move this decision through the process. OBP is
expecting to get the permission to survey sometime in the next month. (from
5 Mar 2008 message, but confirmed as still latest as of 20 Mar 2008.)

USBP POCs routinely involved include (b) (6) and (b) (6) (Tucson
Sector.)

General Notes related Cocopah and Quechan: In most instances access roads
are available via existing county roads/easements granted to the County.
However, some survey and construction access for the fence laydown requires
permissions and/or easements from the Tribes. As noted above these actions
are being worked primarily via the USBP routine liaison officials.

Cocopah:

Project CV-1b

Access issues are working. In the event of an environmental waiver, as noted in the Yuma meeting,
there will still be need to work issues with the Nation. General impression is that will not be
problematic, but will still have to be done and per your instructions won't be initiated until (and if) waiver
is invoked.

Quechan:

Yuma Sector
Project CV-1b

Team is waiting for the Tribal Cultural Committee to write up their findings and submit them to the tribal
council for their review to assist in their decision of whether or not to grant us right-of-way.

The following qualitative information is from SPL's perspective...

TON (Tucson Sector)


SPL's primary POC is(b) (6) . As VF planning and execution work
increases I will be re visible role as well.

The following is a list of currently involved POC's that attend regular bi-
weekly meetings with the TON, organized by USBP, where we discuss
construction issues, deviations from EA, contract issues, future work and
peform site visits.

nt'l boundary on the TON and its rangers have
historically built and maintained barbed wire fencing for cattle management
and to better manage illegal foot traffc)

Additionally, (b) (6) has met with folks at the TERO office to discuss

bi-weekly meetings.

Last week my PM, (b) (6) , attended a meeting with the tribe. There it
was agreed that w d the tribe's cultural commi ural
report (conducted by GSRC). This is an action item for (b) (6) .

We're waiting for the tribe's cultural committee to write up their findings
and submit then to the tribal council for their review to assist in their
decision of whether or not to grant us right-of-way.

h (Yuma Sector)
(b) (6) is the liaison between USBP and this tribe as well. Again, the USBP
en the primary source of information and negotiation.

Status of TON right-of-entry for VF300:

The following projects are on the Nation:

DV-2, DV-3A, DV-3B, DV-4A, DV-4B, and DV-5.

The TON has felt slighted by DHS in the various high profile visits of VIPs
to Arizona. This was compounded by representatives from SBInet referencing
these visits during one of their meetings with the TON. A little politics
government-to-government would go a long way.
