CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This lease contract is made and entered into this 24 th day of
January, 2016 in Marikina City, by and between:
MRS. ARACELI B. DEL ROSARIO, a Filipino citizen of legal
age and with residence at BLOCK 2 LOT A, ROSITA VILLAGE,
Marikina City, herein after referred to as the LESSOR
-andGOSPEL OF JESUS CHRIST MINISTRIES METRO MANILA
INC., a corporation duly organized under Philippine laws, with
address at OLANDES, Marikina City, duly represented by its
Chairman of the Board with sufficient authority, ENGR. EFREN S.
SARCOS, hereinafter referred to as the LESSEE.
WITNESSETH: That
Whereas the LESSOR is the true owner of a parcel of land
situated at ______________________________________, Marikina City.
Whereas the LESSEE desires to lease the above-mentioned
premises and the LESSOR is willing to lease the same unto the
LESSEE.
NOW, THEREFORE, in consideration of the foregoing
premises and the mutual covenants and obligations hereinafter
contained and to be performed, the LESSOR hereby leases and
the LESSEE hereby accepts by way of lease from the LESSOR the
above mentioned parcel of land subject to the following terms and
conditions:
1. TERM This lease shall be for a period of TEN (10) years,
commencing on December 1, 2015 and ending on December
1, 2025 renewable upon mutual agreement by both parties.
2. RENTAL FEES The LESSEE shall pay a monthly rental in
Philippine legal tender to be paid as follows:
The LESSEE shall pay the LESSOR a sum of TWO
THOUSAND FIVE HUNDRED PESOS (Php 2,500.00)
representing monthly rentals, payable within the first
week of every month from the beginning of the term of

lease until such time the amount spent by the LESSEE


for the construction of the building has been paid by
the LESSOR. Afterwhich, a monthly rental of FIVE
THOUSAND PESOS (Php 5,000.00) shall take effect until
the end of lease.
3. UTILITIES All expenses for water, gas, telephone, and
electricity shall be for the account of the LESSEE.
4. PURPOSE The premises shall be used exclusively for
religious purposes. This includes the construction of a church
building and other necessary structures for its maintenance
and operation as an improvement thereon.
If anytime during the existence of the lease and without the
previous consent of the LESSOR, the premises are used for
other purposes, the LESSOR may:

Rescind the contract;


Increase the rent;
Compel the LESSEE to stop the new activities; or
Eject the LESSEE.

The LESSOR however, does not in any way waive other


lawful remedies or courses of action which may be available
to her.
5. IMPROVEMENTS Any major alterations or improvements
made or introduced by the LESSEE shall, upon termination of
this contract, automatically inure to the benefit of the said
premises and become property of the LESSOR without any
litigation or obligation on the latters part to pay or refund its
value or cost to the LESSEE.
6. SUBLEASE The subject premises may not be subleased
without the written consent of the LESSOR.
7. SANITATION AND REPAIRS The LESSEE shall keep the
leased premises clean and in sanitary condition.
8. DEFAULT IN MONTHLY RENTAL FEES In case the LESSEE
fails to make payment of the monthly rental fees stipulated
above for THREE (3) consecutive months, this contract shall
be deemed immediately terminated.

9. SURRENDER OF LEASED PREMISES If the contract is


terminated, whether
by its expiry after ten (10) years or otherwise, the LESSEE
shall immediately and peacefully vacate and surrender the
possession of the leased premises, including improvements,
upon demand.

TAXES AND FIRE INSURANCE Real estate taxes,
government assessments, and fire insurance charges shall
be for the account of the LESSEE during the term of lease.
11.
THIRD PARTY LIABILITY The LESSEE during its
occupancy of the leased premises shall hold the LESSOR free
and harmless from any damage or liability or responsibility
to any person or property arising out of or as a consequence
of the use of the leased property by the LESSEE, his agents,
employees, domestic help and guests.
12.
SALE, TRANSFER AND MORTGAGE In the event of
the sale, transfer, mortgage or any other encumbrance of
the leased premises, the vendee, transferee, or mortgagee
shall respect all the terms and conditions of this lease
agreement including provisions for renewal thereof.
13.
VIOLATION Any violation of the term herein set forth
by either LESSEE or LESSOR shall be sufficient ground for
termination of this Contract of Lease by the LESSOR with
damage accruing to the innocent party.
14.
ATTORNEYS FEES In case of court litigation by
virtue of nonpayment of the agreed rent or any other breach
of this agreement on the part of the LESSEE, the LESSOR
shall have the right to collect the amount equivalent to 20%
of the total obligation due as liquidated damages and
reasonable fees, exclusive of the cost legally accrued.

IN WITNESS WHEREOF, the parties hereto have signed these


presents on the date this 24th day of January, 2016 at Marikina
City.
