Second Collection for Catholic Relief Services

HENDERSON, NV

THIRD SUNDAY OF LENT

Dear Brothers and Sisters in Christ,

Soon, our diocese will be taking up the Catholic Relief
Services collection. This collection funds six Catholic
agencies that work to serve Jesus in disguise of our
suffering brothers and sisters around the world. These
agencies provide a broad range of services, including
advocating for immigrants, providing humanitarian aid
in the wake of natural disasters, resettling displaced
individuals, and working for increased peace in our
world. Your support of this collection is an opportunity
to help Jesus in disguise.
In the late morning of April, 2015, a 7.8-magnitude
earthquake struck Nepal toppling buildings and homes,
causing widespread panic, and claiming thousands of
lives. At this time, aid is still being provided by
Catholic Relief Services. Shelter remains an urgent
priority, as many families still live under basic tarps,
tin sheeting or other materials, with minimal protection
from the elements. Long-term recovery efforts will
likely focus on safe rebuilding, support so families can
become resilient, and the restoration of markets and
livelihoods. By joining with the Catholic community
throughout the United States and donating to this
special collection you will provide the necessary means
for CRS to continue to care for our brothers and sisters
in need.
Funds acquired from the CRS Collection are also
distributed to Migration and Refugee Services, Catholic
Legal Immigration Network, Inc., the Department of
Justice, Peace, and Human Development and the Holy
Fathers Relief Fund. The U.S. Catholic bishops are in
full support and stand firmly behind CRS in its
commitment to promote and defend human dignity and
the sacredness of every human life from the moment of
conception until natural death, and at every moment in
between.
Please be generous in The Catholic Relief Services
Collection. Your donations truly make a difference in
the lives of others.
Sincerely yours in Christ,

Most Reverend Joseph A. Pepe, D.D., J.C.D Bishop of

Las Vegas

God, author of every mercy and of all goodness,

who in fasting, prayer and almsgiving have shown
us a remedy for sin, look graciously on this confession of our lowliness, that we, who are bowed down
by our conscience, may always be lifted up by your
mercy. Through our Lord Jesus Christ, your Son,
who lives and reigns with you in the unity of the
Holy Spirit, one God, for ever and ever.

CANONICAL- LITURGICAL FORUM

BY FR. GEM BANDIVAS, JCL, MBA, PhD

ARE CATHOLICS PROHIBITED FROM MARRYING DURING LENT?

Dear Fr. Gem: A friend of mine wanted to get married in
the Catholic Church. They were guided in their marriage
preparation by a respectable deacon in their Church.
Everything seemed going so well except that when they
picked up a date for the wedding, on a Holy Saturday, they
were told that they could not get married on that particular
date. They were told that the penitential and/or
preparatory nature of this time of Lent renders them
inappropriate for the joyous celebration of a wedding.
Canon 843.1 of the 1983 Code of Canon Law states clearly
that Catholics cannot be denied the sacraments if they
opportunely ask for them, are properly disposed, and are
not prohibited by law from receiving them. My question is:
Doesnt my friend have the right to schedule a wedding
during Lent especially when all the requirements
mentioned in the Canon above are all complied with?
Whats going on here? It doesnt seem fair!
- Angelina, Parishioner
Dear Angelina: Catholics have, in general, a right to receive
the sacraments. This general rule is first articulated in Canon
213, in the section of the Code delineating the obligations and
rights of the faithful (i.e., both clergy and laity). It states broadly
that the Christian faithful have the right to the spiritual goods of
the Church, among which it specifically mentions the
sacraments.
More details are then provided on the chapter of the
Code discussing the sacraments. For example, in the canon
that you cited which mentions that if the parties opportunely
ask for the sacraments, are properly disposed, and are not
prohibited by law from receiving them, they shouldnt be
denied the sacraments. If we assume that your friend is a
practicing Catholic, and that both have completed, or are
willing to complete, any necessary preparation-program
mandated by his diocese for all Catholics planning to marry, it
seems reasonable to conclude that they are properly
disposed to marry in the Church. The refusal of this request,
however, was not based on your friend and the fiances
spiritual dispositions, but rather on the time of year when they
want the wedding to take place. So the question to be asked
is, is Lent inappropriate time for the celebration of the
sacrament of Catholic Matrimony?
The 1983 Code of Canon Law has nothing to indicate
that any particular days of the year are definitively off-limits for
the celebrations of weddings. But in 1988, the Congregation of
Divine Worship published a document Concerning the
Preparation and Celebration of the Easter Feasts which
explains authoritatively that there are two days when
marriages may not be celebrated. On Good Friday, All
celebration of the sacramentsis strictly prohibited, except for
the Sacrament of Penance and Anointing of the Sick. And as
for Holy Saturday, The celebration of marriages is forbidden.

The Congregations document is intended to apply

universally and thus cannot be ignored by diocesan bishops,
much less by parish priests. Consequently, if any Catholic ever
asks his pastor to schedule a wedding on Good Friday or Holy
Saturday, the answer must be NO. Thats because even
though the Congregations document was focused on the
Easter Season, and not on the sacraments per se, it has
nonetheless indicated that these dates constitute inopportune
times for the celebration of the sacrament of matrimony.
Refusal would thus be fully accord with Canon 843.1.
So if the Vatican has established that Catholics may
not opportunely ask for the celebration of the sacrament of
matrimony on these dates in Holy Week, is it possible for a
diocesan bishop or a parish priest to broaden the prohibition to
other times of the year when the faithful cannot marry either?
In a word, NO or at least, without specific permission from
the Holy See. The reason for this hinges on a general legal
concept pertaining to the restriction of rights.
Canon 18, in the very first section of the Code
delineating some of the broadest, most basic concepts
governing Church Law, states among other things that laws
that restrict the free exercise of rights are to be interpreted
STRICTLY. In other words, if a canon limits our right to have or
do something, and a question arises as to whether or not the
canon can be applied in an individual situation, the answer
must involve interpreting that canon in the narrowest possible
way.
Put differently, the rights of the faithful cannot be
limited unless the law clearly permits this. A loose
interpretation of any canons restricting a persons rights is not
permissible. Telling Catholics that they cannot get married for
nearly an entire month (e.g. during Advent), and/or for the
entire calendar period between Ash Wednesday and Easter,
obviously constitutes a very loose interpretation of the
restrictions contained in Canon 843.1, and is thus a policy
unsupported by Canon Law.
Note that while Canon Law does permit a wedding
during both Lent (except for the two days just discussed above)
and Advent, the faithful are required to tone down the
celebration, in keeping with these more sober periods of the
liturgical year. The Churchs liturgical books indicate that for
weddings during Advent/Lent, external signs such as music
and flowers are to be less lavish (if there are any at all). Note
that in the process of making this admonition, the liturgical
books DO acknowledge that weddings may indeed be
celebrated during these times they just cannot be celebrated
with the same exuberance and festivity that one often finds at
weddings held at other times of the year.
