CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This CONTRACT made and entered into by and between:
This CITY GOVERNMENT OF PUERTO PRINCESA, a local government unit, with
postal address at the City Hall Building, Barangay Sta. Monica, Puerto Princesa City,
herein represented by its City Mayor, HON. LUCILO R. BAYRON, hereinafter
referred to as the LESSOR.
-andSHUTTLE VAN BERTH, a business entity existing pursuant to the laws of the
Republic of the Philippines, with DTI Registration No. 01418342, and business
address at PPLTTerminal, Bgy. San Jose, Puerto Princesa City, represented by MR.
JOSE RUFANO MAYO, hereinafter referred to as the LESSEE;

WITNESSETH That
WHEREAS, the LESSOR, is maintaining and operating a Land Transport
Terminal at Barangay San Jose, Puerto Princesa City, pursuant to City Ordinance
No. 123-99, as amended by City Ordinace No. 232-2003, otherwise known as The
Puerto Princesa Land Transport Terminal Ordinance;
WHEREAS, the Said Land Transport Terminal being maintained and operated
by the LESSOR consist of several commercial spaces which, pursuant to the aforementioned City Ordinance, shall be offered for lease to interested person or entity;
WHEREAS, the LESSEE is engaged in land transport business and finds the
need to lease one of the commercial space within the Puerto Princesa Land
Transport Terminal of the LESSOR;
NOW THEREFORE, for and in consideration of the above premises, the
LESSOR hereby leases unto the LESSEE, and the latter hereby accepts in lease from
the former, one of the commercial spaces within the Puerto Princesa Land Transport
Terminal, Barangay San Jose, Puerto Princesa City, subject to the following terms
and conditions:
1. The commercial space subject of this lease contract is particularly identified
as follows:
Open Space [w/o building] No.:_______ ----_______
Land Area :
_______ square meters.
2. Pursuant to City Ordinance No. 232-2003, particular Section 7, par 7.3
[7.3.2] (e), the LESSEE shall pay the LESSOR the amount of TWENTY PESOS
[P20.00] per square meter of open space occupied per month or a total
monthly rental of ____________________________________[P_____.00];
3. The LESSEE shall pay two (2) months advance and one (2) months deposit
amounting to ____________________________________ [P_____.00]
upon award of space and signing of this Contract, pursuant to Section 7, par
7.3 [7.3.3] (d) of the above-mentioned City Ordinance;
4. The term of this lease shall be for a period of One (1) year commencing on
______________________, 2015, renewable thereafter, subject however, to

rental increase as maybe provided for by law and upon mutual consent of
both parties herein;
5. The LESSEE hereby expressly agrees and warrants that the leased premises
shall be used exclusively for his/her transport business and that the said
LESSEE is hereby strictly prohibited from using said premises for any other
purpose or business without prior written consent of the LESSOR;
6. The LESSEE shall not directly or indirectly sublease, assign, transfer, convey,
mortgage or in any way encumber his right of lease over the leased premises
or any portion thereof under any circumstance whatsoever. Any contract that
may be made in violation of this clause shall be null and void;
7. It is expressly agreed and understood that the LESSEE shall be the one who
will provide the necessary improvements to make the open space suitable for
his/her business. However, any work which may be introduced by the
LESSEE or any alterations in the leased premises shall be made with prior
written consent and approval of the LESSOR;
8. The LESSEE shall pay for and defray at its exclusive expense other fees and
charges imposed by City Ordinance No. 232-2003, including the mandatory
GOODWILL FEE required under section 7. Par. 7.3 [7.3.3] (c) of City
Ordinance 232-2003;
9. The LESSEE shall not bring into or store in the leased premises, any
inflammable or explosive goods or materials or any article which any expose
the leased premises and its surroundings from fire or increase the fire hazard
therein or bring or store any prohibited article inside the Puerto Princesa
Land Transport Terminal;
10.

The LESSEE shall abide and comply with all the policies, rules and
regulations as may be implemented by the LESSOR;

11.

Violation by the parties of any of the provision hereof shall cause the
immediate revocation of this Contract.

IN WITNESS WHEREOF, the parties hereto have hereunto set their hands this
