Submit as hardcopy. Assignments must be word processed using 1.5 spacing and in font size 12, with correct
grammar, punctuation and spelling. Please answer in an essay style, and include a bibliography. Marks are
awarded for overall presentation. The assignment will be a maximum of 1,500 words in length including
quotations, BUT excluding footnotes, appendices and the bibliography.
Assignments that exceed the maximum word count will be penalised by 5 marks.
The student is required to state the word count on both the assignment report and on the last page of the
assignment (i.e. the last page of the main body of work before any appendices, bibliography etc.). If the word
count is incorrect this will be regarded as an ASSESSMENT OFFENCE. The word count may be verified by
the marking tutor.
Plagiarism and Self-Plagiarism: You must acknowledge your source every time you refer to others work or
work that you have previously submitted and been assessed on, using the OSCOLA Referencing system
(Author/Date method). Failure to do so amounts to plagiarism or self-plagiarism, which is against University

THE BRIEF (subject to External Examiner approval)
McPhail v Doulton [1971] AC 424 provides that the test for certainty of
objects in discretionary trusts is the same test as the one used to determine
the validity of mere powers. Read this judgment, together with Re
Gulbenkians Settlements [1970] AC 508 and Inland Revenue Commissioners
v Broadway Cottages Trust [1955] Ch 20, to provide a black letter law
analysis of the development of this principle, explaining how and why the
traditional rule was departed from. With reference to the majority and
dissenting judgments explain the arguments for and against this departure.
This work tests Learning Outcomes 1 and 3.
The work will be marked based on the Universitys generic marking criteria

for Level 5, formerly known as Level I, as set out in the unit guide.
