CONTRACT
This AGREEMENT, made and entered into this day 5th day of March 2016 by and between MYLENE R.
GUPIT, CHARMINE D. MAGBUJOS, and MHELVIN E. MAGDALENA, (Contractor), and, MICHAEL JEROME I.
CAPONPON, (Owner).
WITNESSETH, That the above-mentioned parties hereby covenant and agree to comply with the conditions
hereunder stipulated as follows:
ARTICLE 1. SCOPE OF THE WORK
Owner agrees to the estimate provided by the Contractor on February 27, 2016, pursuant to it, the
Contractor agrees that they will be constructing a two-storey residential house for the Owner. The Contractor shall
furnish all the materials and perform all of the work shown on the drawings and/or described in the specifications
attached as it pertains to work to be performed on property located at Rosario, Batangas.
ARTICLE 2. TIME OF COMPLETION
The parties agree that construction will begin on or before 14th day of March 2016, and that the crew will
work {seven days a week, eight hours a day, or some other schedule}, with an estimated date of completion on or
before 13th day of October 2016.
ARTICLE 3. THE CONTRACT PRICE
The owner shall pay the Contractor the sum of 1,672,465.564 for the material and labor to be performed
under the Contract, subject to any additions and/or deductions made pursuant to authorized change orders.
ARTICLE 4. PAYMENTS
Payments of the Contract price shall be paid in the following manner:
Initial installment 15% of the total amount
Periodic installment ARTICLE 5. GENERAL PROVISIONS
1. All work shall be completed in a workmanship like manner and in compliance with all building codes and
other applicable laws.
2. To the extent required by law all work shall be performed by individuals duly licensed and authorized by
law to perform said work.
3. Contractor may at its discretion engage subcontractors to perform work hereunder, provided Contractor
shall fully pay said subcontractor and in all instances remain responsible for the proper completion of this Contract.
4. All change orders shall be in writing and signed by both Owner and Contractor.
5. Contractor shall at its own expense obtain all permits necessary for the work to be performed, the costs of
which will be the builder's responsibility.
6. Contractor shall remove all debris, equipment, materials, etc. from the location upon completion of the
construction.
7. In the event Owner shall fail to pay any periodic or installment payment according to the above plan,
Contractor has the right to stop all work until such time as payments have been brought current.
8. Contractor shall not be liable for any delay due to circumstances beyond its control including strikes,
casualty or general unavailability of materials.
9. Contractor warrants 10% of the total amount all work for a period of one year following completion.
10. In the event of delay in the completion of work, Contractor shall pay 1% of the total amount per day.
IN WITNESS hereof, we have hereunto set our hands this 5th day of March 2016 in Batangas City.
