LIMITED PRODUCT WARRANTY

For EVERDIGM Quick Coupler and their associated parts

WARRANTY
EVERDIGM Corporation (hereinafter called EVERDIGM), subject to the WARRANTY
LIMITATIONS herein, warrants its products to be free of defects in materials and/or
workmanship. If any parts shall fail by reason of poor materials and/or workmanship within a
period of twelve (12) months for single-shift operations and six (06) months for multiple-shift
operations after the date of delivery of such new products to the first retail purchaser or renter,
or within a period eighteen (18) months from the shipping date from EVERDIGMs factory,
whichever period comes first. EVERDIGM will, at its option, repair or furnish such part free of
charge, which is found upon examination by EVERDIGMs authorized service outlet or by
EVERDIGMs factory under the conditions listed in WARRANTY LIMITATIONS.

WARRANTY LIMITATIONS
Exceptions from warranty: Warranty is limited to replacement of defective parts only. Labor,
mileage and travel time, meal, loss time, freight cost, import duty and documentation, and any
other expenses incurred by warrantable failure are not covered by warranty.
Sealing parts: Sealing parts such as seals installed in new products are warranted to be free
of defects in material and/or workmanship for a period of six (6) months after the date of first
usage, or for a period twelve (12) months from the shipping date from EVERDIGMs factory,
whichever period expires first.
Wear items: Wear items listed herein below are warranted for a period of three (3) months
after the date of first usage, or for a period of eighteen (18) months from the shipping date
from EVERDIGMs factory, whichever period expires first, only if they shall fail by reason of
defective material or poor workmanship only, not from normal wear and/or abuse. EVERDIGM
reserves the full right to determine if and to what extent warranty adjustments may be made
for failure or performance deficiency of these items.
Wear Items: Retaining pins, joint pins, rings, fasteners such as bolts, studs, nuts
and washers, rubber or polyurethane components, wear plates, hoses, etc.
Spare Parts: Spare parts obtained individually are warranted for a period of three (3) months
after the date of first usage, or for a period eighteen (18) months from the shipping date from
EVERDIGMs factory, whichever period expires first.

Repairs: All repair work carried out by a EVERDIGM authorized service outlet or by
EVERDIGMs factory are warranted for a period of three (3) months, but this warranty is valid
until expiry of the original warranty period for the object of supply.
Alterations & Modifications: No claim will be accepted by EVERDIGM if the product or part
is altered or modified in any way without prior written approval by EVERDIGM.
Incidental and/or consequential damages: To the fullest extent permitted by applicable
law, EVERDIGM is not responsible for any incidental, consequential or special damages and/or
expenses.
Improper, Operation and/or Maintenance: Breakage or damages attributable to
installation or operation or use not in accordance with EVERDIGMs guidelines, operating
instructions, and/or procedures, a failure to follow any scheduled maintenance or routine
maintenance as outlined in the operation and maintenance are not covered by any warranty
Rust and/or contamination: Any damages attributable to rust, or contamination of hydraulic
fluid are not covered by any warranty
Operation beyond published capacities: All obligations under this warranty shall be
terminated if the product is operated or used beyond its published capacities such as excessive
hydraulic pressure and flow, excessive heat, or incorrect hydraulic fluid setting.
Claim application: EVERDIGM assumes no liability for warranty claims unless the proper filled
out claim form is submitted and received by EVERDIGM within fifteen (15) days of the date of
discovery of the defect or within fifteen (15) days of the date of repair.
Warranty registration: EVERDIGM assumes no liability for warranty claims if the proper
documentation, which proves the delivery of the product to the first retail customer or the
products first date of usage, is not received by EVERDIGM before warranty claim being applied.
No other warranty: These limited warranties and the obligations of EVERDIGM thereunder
are in lieu of all other warranties, expressed or implied warranties without limitation including
merchantability or fitness for particular purpose.
