Death penalty

Death penalty should be given or not is always been a big question regarding Indian judiciary
what people at large feel about death penalty is still very confusing.
well the Indian judiciary in case of bachan singh vs state of Punjab have their views in
favour of death penalty they think so, because in their view it will create fear among the other
criminals that if they try to do so or if they do this or that kind of crime they will be hanged
till death their life will be taken from them.
Even I think that the view of majority to an extent is right because if you stop giving capital
punishment then the time will come when no one have been feared of his life and law also
because they are already known to the fact that what so ever crime they are going to do their
life are not going to be taken. Only some punishment would be sentenced to them which
would extent to life imprisonment.
Also giving capital punishment actually gives a strong message to public at large that still
their judiciary is capable enough of treating the criminals in right way and they dont have to
take things in their hands to avenge from criminals.
But what justice Bhagwati said was totally contradicting the views of majority he said that
the work of the judiciary is to rehabilitate the criminal judiciary work is to end the crime not
criminals. He actually said that you cannot take an eye for an eye.
I also support his views because what he said was true you cannot take an eye for an eye.
Now you are living in a modern era where you need to change your rules which suits your
culture and your own people as well now if you kill somebody because he has done the same
than where the difference between you and them.
By doing this you are actually on the same scale not even a single point less than the
criminals. Instead of sentencing them death penalty judiciary should innovate something
different which can give strong message and punishment as well to the criminals.
There are so many modern countries which had put a complete stay on capital punishment.
Also capital punishment is irrevocable once it being done it cannot be recalled. If we are not
capable of giving life to someone than we have no right to take it from other, its the most
things which is given by the god which we are destroying. It is also barbarous and cruel
because when you are hanging someone it will cause him/her uncountable amount of pain
sometimes even their skin comes out eyes and so many other kind of complication.
At last I will conclude with that capital should be given but its shouldnt be on mandatory
basis. it should be given to the criminals who judiciary feels actually a danger for society that
if he kept alive he will be threaten to public at large. for ex. Terrorist or habitual criminals.
