The New MU/BPI Agreement: Advice to Members

The New Agreement between the MU and the BPI comes into force on 1st June 2011. This
document provides an overview of some of the key areas that members should be aware of when
working under its terms.

Under the New Agreement the limitation of 4 Tracks from a session has been removed. However,
the limitation on duration remains 20 minutes for a 3 hour session. It is explicit in the New
Agreement that the duration relates to maximum duration of the Track or Tracks embodying a
musicians performance not the number of bars an individual musician has performed on. The
Union will be monitoring this aspect of the Agreement with reference to PPL registrations and
members should report any suspected violations of this aspect of the Agreement.

The criteria under which Classical rates can be applied are that the repertoire to be recorded
would qualify for inclusion in the Official Charts Company Classical Chart. An ensemble no longer
needs to be listed to qualify for these rates.

Filming at Sessions
Under the terms of the New Agreement record labels are permitted to film at studio sessions
without additional payment provided that any footage is used for promotional purposes only.
Should a record label wish to exploit the audio-visual footage commercially an additional payment
of 25.00 becomes due.
Additional Fees
Percentage uplifts for Overdubbing, Doubling and Trebling remain the same. Sunday Working no
longer attracts a double fee however work on Public Holidays or during unsocial hours continues
to attract a double fee.
Location Recordings
If a record label wishes to make a location recording, a fee of 45.00 is due to each musician but
this only allows the label to make promotional use of the recording (as with the MUs Archive and
Promotional Recordings Agreement). Should the label wish to make commercial use of the
recording (live album, video, etc) then a further fee is to be negotiated.
Backing Track & Video Buyout Fees
Under the terms of the New Agreement the system of individual Backing Track and Video Buyouts
has been replaced with a system of Subsequent Payments to members. Under this system the
MU will receive an agreed percentage of VPL Revenue annually for distribution to members who
have performed on recordings incorporated into a VPL registered Promo Video and/or used as a
TV Backing Track.
It should be noted that musicians who are non-members will have no entitlement to Subsequent
Payments.
For the avoidance of doubt, if a recording made under the terms of the old MU/BPI Agreement(s)
in force prior to 1st June 2011 is incorporated into a Backing Track and/or Promo Video after 1st
June 2011 the record label is still liable pay the relevant buyout fees under the old MU/BPI
Agreement(s) to the musicians concerned, not a Subsequent Payment.
Foreign Record Labels
Where work is offered by an overseas label members should be mindful that pursuing that label for
any share of VPL Revenue may not be possible. If Backing Track and/or Video use is not required
by that label then the M4 Standard Contract (which can be downloaded from www.theMU.org)
should be used. If these rights are required then the label should either be made aware of the
additional cost or a higher upfront fee should be charged.
