1.5. Narrative:

Myself and Officer Wargo were instructed by shift command to assist Cpl Benedict at D18 for a
possibly intoxicated co-pilot. On arrival I spoke to Sgt Zarras who stated that TSA had notified
Cpl Benedict at 0631hrs that a co-pilot that had entered through the known crew member TSA
line was possibly intoxicated. At approximately 0645hrs I spoke to the co-pilot, Maguire, who
was seated in the TSA office at Blue 2. As I spoke to Maguire I could immediately smell the

strong odor of intoxicants coming from his person. Maguire's eyes appeared bloodshot. I asked
Maguire if he had been drinking and he stated not since last night. I asked Maguire what time he
last drank at and he replied 8pm. I requested that Maguire take a Preliminary Breathalyzer Test
and he agreed to. I read Maguire his PBT rights and he consented. At approximately
0700hrs using PBT 7 I conducted the first attempt. Maguire faintly blew into the machine
resulting in an error. I instructed Maguire to blow fully into the machine. The second
attempt Maguire's results were a .081. I advised Sgt Zarras of the results.
At that time Sgt Zarras had Officer Wargo and myself obtain witness statements from the pilot
and the TSA employee who reported the incident. I obtained witness statements (see attached).
At approximately 0715 hrs I was advised by Lt Randolph to arrest the subject and transport him
to Bldg. 610 for booking. I handcuffed Maguire (TC/DL) without resistance. I searched the
subject and placed him in the rear of patrol vehicle 416, which was searched prior to and after all
transports with negative results. I transported Maguire to Bldg 610 and booked him
(PictureLink/LiveScan). I logged Maguire's property in placed it in the property room in lock up.
At that time I was instructed by shift command to take the subject to Romulus PD for a
Datamaster. Myself and Officer Wargo transported Maguire to Romulus without incident. I began
the observation period at 0818hrs. I read Maguire his chemical test rights and he consented
to the breath test. At 0834hrs Officer Wargo conducted the Datamaster resulting in a .05. At
0838hrs a second test was performed resulting in a .05. I transported Maguire back to Bldg. 610
and searched him again with negative results. Maguire was placed in a cell by Cpl Henry.
I then spoke to Det. Carmona and FBI agent Mike Thomas and turned over the witness
statement forms.

On 3-26-16, I was assigned to the Blue 1 & 2 Security Checkpoints, positioned at Blue # 2, Officers
podium.
At approximately 0628 hrs. I was approached by TSA Screener

American Airlines pilot who appeared to be under the influence of alcohol.

I met

stated that he followed up his officers report by proceeding to
the aircraft cockpit and immediately identified the subject now known as John Maguire, Co Pilot of
American Airlines Flt. AA-736 DTW to PHL.

could immediately smell the odor of liquor and mouthwash

pilots in the cockpit, inquiring their destination and how they were feeling and any problems. MAGUIRE
replied he was having trouble with his seat.
asked the other pilot, now known as Capt. Stacey Tappi
if he thought everything was ok? TAPPI replied "he put himself in the hot seat" , take him.
Upon receiving this information I called for a Police supervisor to make my location.
Sgt. D. Zarras arrived and I relayed all information to her about this situation. After conferring with Lt. R.
Randolph by phone it was decided to interview MAGUIRE away from the aircraft and the public. Sgt.
ZARRAS and I went down to the aircraft cockpit and asked MAGUIRE to step out with us regarding a
report to the police that he may have been drinking. In the jet way Sgt. ZARRAS asked MAGUIRE if he had
been drinking this morning or last night. MAGUIRE replied No Sgt.ZARRAS then asked if he would mind
taking a Preliminary Breath Test ? MAGUIRE replied Sure. As we walked up the jet way MAGUIRE
appeared nervous and unsteady.
We walked MAGUIRE to the TSA Managers office at Blue # 2 to continue the interview out of the public
view.
Officers Wargo and Jones arrived with a PBT and assumed control of the investigation, I returned to the
Blue Checkpoint responsibilities.

On 3/26/2016 at 0631 hours Cpl. Benedict asked for a supervisor at gate D18. While in route Cpl.
Benedict informed me by phone that TSA suspected a co-pilot was drunk. The American Airlines co-pilot
(later identify as John Maguire) was on board the airplane at D18. I told Cpl. Benedict to ask the gate
agent to call for a supervisor.
When I arrived the airplane was being loaded with passengers. TSA Manager
stated to
me that TSA Screener
notified him that she suspected the co-pilot for being drunk. Mr.
said he then went on to the airplane to talk to the co-pilot. The co-pilot was wearing a baseball cap and
was sitting in his seat sideways. Mr.
asked him if everything was ok and the co-pilot stated, Yes I am
just having a hard time with this seat. Mr.
stated he could smell mouth wash and alcohol on the copilots breath. Mr.
also stated the pilot Mr. Stacey Tappi made the comment, TAKE HIM.
I notified Lt. Randolph of the incident.
When American Airlines Supervisor Tayonda Michaux DTW #
arrived she was informed. Cpl.
Benedict and I then went on to the airplane to talk to the co-pilot.
I asked the co-pilot Mr. Maguire if he could step off the plane so we could talk to him. When he was
exiting the airplane and walking up the jetway I observed Mr. Maguire was unsteady on his feet. He
leaned into the wall a couple of times. I observed his face being flushed red and his eyes were blood
shot. I stopped in the middle of the jetway and explained to Mr. Maguire why we pulled him off the
airplane. I stated that there was a complaint that he could be drunk. I asked Mr. Maguire if he had been
drinking. Mr. Maguire stated no. I asked him if he was drinking last night and he again stated no. While
talking to Mr. Maguire I could smell intoxicants on his breath. He slurred some of his words. I then asked
him if he would take a PBT. He said he would consent to take one.
We walked Mr. Maguire into the TSA Managers office. While we waited for the PBT to arrive I again
asked Mr. Maguire if he was still willing to take the PBT and he said yes. I asked Mr. Maguire for his ID
and he stated it was on the airplane.

When Officers Wargo and Jones arrived with the PBT, Officer Jones asked Mr. Maguire if he was
volunteering to take the BPT. Mr. Maguire stated Oh, I have a choice. Officer Wargo explained to Mr.
Maguire that if he refused he would be taken to the hospital for a blood draw. Mr. Maguire then stated
he would take the PBT.
The first attempt at the PBT Mr. Maguire did not blow into the machine. The second attempt Mr.
Maguire did not take a deep enough breath. The third attempt Mr. Maguire blew a BAC of 0.081.
I notified Lt. Randolph of the results and was told to bring Mr. Maguire into the station.
Mr. Maguires bag was taken off the airplane. I searched it in front of him and as I was doing the search I
asked him about his ID again. He stated here it is in my shirt pocket.

On the listed date I was called in to conduct a follow up investigation to this case. I reviewed
the report with command and the involved officers. I then proceeded to lock up to interview the
defendant.
DEF/MAGUIRE'S STATEMENT
On March 26, 2016 I advised Def/Maguire of his Constituional Rights. He fully understood
those rights and invoked his right to remain silent and wished not to make a statement. The
interview was concluded and the defendant was placed back into his cell without incident.
Def/Maguire was ultimately released from custody shortly thereafter pending an O/C WR.

On the listed date I prepared and submitted a WR to the WCPO (APA N. Clay) for their
review and determination (scanned/attached).

On the reported date I was assigned to FTO Ofc. Jones. At approximately 0635hrs I was
instructed by Lt. Randolph to take Ofc. Jones and assist Sgt. Zarras at gate D18 for a possibly
intoxicated pilot.
Ofc. Jones and I arrived on scene and were briefed by Sgt. Zarras. I assisted Ofc. Jones in
interviewing the subject, Maguire, who was seated in the TSA office at Blue 2. I immediately was
able to smell the odor of intoxicants emanating from Maguire. I noted his eyes appeared
bloodshot. Ofc. Jones interviewed Maguire and Maguire admitted to drinking the previous night. I
was instructed by Sgt. Zarras to have Ofc. Jones PBT Maguire. Ofc. Jones read Maguire his
PBT rights and Maguire consented. Ofc. Jones conducted the PBT and showed me the results.081. Ofc. Jones and I advised Sgt. Zarras of the results. Ofc. Jones and I then were instructed
to obtain witness statement forms from the pilot and the TSA employee who advised Cpl.
Benedict of the incident. Ofc. Jones and I obtained the statements. Ofc. Jones and I then stood
by with Maguire until being directed by Lt. Randolph to arrest the subject and bring him to Bldg.
610 for processing.
Ofc. Jones placed Maguire into custody, handcuffed him (TC/DL) without resistance and
escorted him down the jetbridge at D19. I stood by as Ofc. Jones searched Maguire and then
placed him in the patrol vehicle. Ofc. Jones and I then transported Maguire to Bldg. 610. Ofc.
Jones searched the patrol vehicle before and after all transports with negative results. I stood by
while Ofc. Jones booked the subject (PictureLink/LiveScan) without incident. I was then
instructed by Lt. Randolph to take the subject to Romulus PD for a Datamaster test.
Ofc. Jones and I transported Maguire to Romulus PD where Ofc. Jones read him his chemical
breath test rights. Maguire consented. Ofc. Jones and I waited the 15 minute observation period
and I then performed the Datamaster test (Operator Cert #30947) Result 1 at 0834hrs was .05.
Result 2 at 0838hrs was .05. I notified Lt. Randolph of the official results.
Ofc. Jones and I then transported Maguire back to Bldg. 610 where Cpl. Henry was standing by
in lockup and took over the prisoner. I then stood by and assisted Ofc. Jones in report writing
and
I entered the DI-177 into LEIN. Nothing further to report.
