REQUEST OF HAZEL S. CATADMAN, GENERAL MANAGER, SILANGAN
MULTIPURPOSE COPERATIVE, FOR THE CANCELLATION OF THE ANNOTATION AS
INDICATED IN TRANSFER CERTIFICATE OF TITLE NO. T-448128 WHICH READS AS,
EXCEPT BY HEREDITARY SUCCESSION, THE LOT HEREIN SOLD, CONVEYED OR
ANY PART THEREOF, CANNOT BE ALIENATED, TRANSFERRED OR ENCUMBERED
WITHOUT THE PRIOR CONSENT AND AUTHORITY OF THE SELLER, FOR
APPROPRIATE ACTION OF THE BODY.

BACKGROUND

This pertains to theletter fromMs. Hazel S. Catadman, General


Manager,Silangan Multipurpose Cooperative,requesting the cancellation of
encumbrance annotated on Transfer Certificate of Title No. T-448128 covering a
parcel of land, located at Mintal Relocation Area, Phase 1, Barangay Sto. Nino,
Davao City, and containing an area of ONE HUNDRED TWENTY (120) Square
Meters;

Annotated on the abovementioned title is the following encumbrance:

Except, by hereditary succession, the lot herein sold, conveyed or any part thereof,
cannot be alienated, transferred or encumbered without the prior consent and
authority of the seller.
HIGHLIGHTS
The subject property is registered in the name of Edwina MacanasCeriloand the land
title was issued on 26 June 2009 with the aforementioned annotation.
The property was the subject of a Sheriffs Final Certificate of Sale, transferring the
property from Edwina MacanasCerilo to Silangan Multipurpose Cooperative, issued
last April 15, 2014 by Atty. EdipoloSarabia, Jr., Clerk of Court VI and Ex-Officio
Sheriff.
RECOMMENDATION

The Committee recommends togrant the request of Ms. Hazel s. Catadman,


for the cancellation of the annotation contained in Transfer Certificate of Title No. T448128;

A RESOLUTION GRANTING THE REQUEST FOR THE CANCELLATION OF THE
ANNOTATION CONTAINED ON TRANSFER CERTIFICATE OF TITLE NO. T-448128
REGISTERED IN THE NAME OF EDWINA MACANAS CERILO, WHICH STATES,
EXCEPT BY HEREDITARY SUCCESSION, THE LOT HEREIN SOLD, CONVEYED OR
ANY PART THEREOF, CANNOT BE ALIENATED, TRANSFERRED OR ENCUMBERED
WITHOUT THE PRIOR CONSENT AND AUTHORITY OF THE SELLER AS REQUESTED
BY MS. HAZEL S. CATADMAN, GENERAL MANAGER OF SILANGAN MULTIPURPOSE
COOPERATIVE.

WHEREAS, this pertains to the letter-request of Ms. Hazel S. Catadman, General


Manager of Silangan Multipurpose Cooperative of the property embraced by Transfer
Certificate of Title No. 448128 registered in the name of Edwina Macanas Cerilo
covering an area of 120 square meters located at Mintal Relocation Area, Phase 1,
Barangay Sto. Nino, Davao City, requesting the City Council to approve the
cancellation of the annotation found on said title.
WHEREAS, appearingon the above mentioned title is the following annotation, to wit:
Except, by hereditary succession, the lot herein sold, conveyed or any part thereof,
cannot be alienated, transferred or encumbered without the prior consent and
authority of the seller.
WHEREAS, the property wasthe subject of a Sheriffs Final Certificate of Sale,
transferring the property from Edwina Macanas Cerilo to Silangan Multipurpose
Cooperative, issued last April 15, 2014 by Atty. Edipolo Sarabia, Jr., Clerk of Court VI
and Ex-Officio Sheriff;
WHEREAS, this Committee recommends the granting of the request for cancellation
of annotation found on Transfer Certificate of Title No. T-448128;
NOW THEREFORE, be it resolved as it is hereby resolved that the City Council of
Davao grants the request for the cancellation of annotation contained in Transfer
Certificate of Title No.T-448128, which reads as Except, by hereditary succession,
the lot herein sold, conveyed or any part thereof, cannot be alienated, transferred or
encumbered without the prior consent and authority of the seller.
RESOLVED FINALLY, that copies of this Resolution be furnished to the Office of the
Secretary to the Sangguniang Panlungsod, City Planning and Development Office,
City Legal Office, City Mayors Office, and all other offices/departments concerned,
for their information and guidance.
