CONSTITUTION AND BYLAWS
PREAMBLE
We, the students of La Salle College Antipolo, imploring the aid of the Almighty God and guided
by the prayers and the way of life lived by St. John Baptist De La Salle, affirm our inherent democratic
right to pursue an independent, just, and genuine student government that shall inspire us to become true
Lasallians for God and country, strengthen our learning and formation as Lasallians who secure harmony,
unity and cooperation among ourselves and with those who, together with us, make up the Lasallian
community of persons, scholars, learners and citizens, committed to the advancement and defense of our
rights and welfare, safeguard the academic freedom and integrity of the college, affirm human dignity and
worth, promote the common good, actualize our responsibilities as heralds and catalysts for social
change and action, instill a social consciousness that will strike a balance between self and service to
others, healthy competition and cooperation, freedom and responsibility and embody our open-minded
ideals, noble aspirations and genial vision of a humane and sovereign society where truth, justice,
freedom, love, equality and peace reign, do solemnly ordain and promulgate this Constitution.
ARTICLE I
GENERAL PROVISIONS
SECTION 1. This Constitution shall be known as LSCA TEU Student Government Constitution, which
shall here in after be referred to as the TEU SG Constitution.
SECTION 2. This Constitution shall govern the LSCA Student Government also known as the Student
Council together with the Council of Presidents (SCCOP) in the college.
SECTION 3. The LSCA Student Council and the Council of Presidents as mandated by the
undergraduate students shall be the official representative of all bona fide students of LSCA.
SECTION 4. The SCCOP Logo shall be:

ARTICLE II
DECLARATION OF OBJECTIVES
SECTION 1. Facilitate communication between students and the administration, faculty,
fellow students and the rest of the LASALLIAN community.

ARTICLE III
STUDENTS RIGHTS AND OBLIGATION
SECTION 1. Every student has the right to be properly informed of the programs, rules and
regulations and policies of the academic community.
SECTION 2. Every student has the right to have access to his/ her official records and other
pertinent documents and papers pertaining to official acts, transactions or decisions.
SECTION 3. Every student has the right to conduct scholarly research freely and to publish,
discuss and exchange findings and recommendation for the purpose of academic
development.
SECTION 4. Every student has the right to be academically evaluated based on objective
criteria.
SECTION 5. Every student has the right to vote for representative and officers.
SECTION 6. Every student has the right to proper representation in all policy-making bodies
inside the college.
SECTION 7. Every student has the right to assemble and to freely and responsibly express
their views, opinions and grievances.
SECTION 8. Every student has the right to establish, organize, join and actively participate in
clubs, organizations, groups and other associations for purposes not contrary to existing
policies.
SECTION 9. Every student has the right objective presentation and independent operation of
the student- controlled publications, subject to the cannons of responsible journalism.
SECTION 10. Every student has the right to legitimate and responsible use of adequate, safe,
clean and efficient school supplies.
SECTION 11. All other rights as specified in the Students Handbook and the Constitution and
Bylaws but are not specified herein are included as rights of the students.
SECTION 12. Lasallian Students shall observe and uphold the rules and regulations of the
College, the Student Handbook and this Constitution at all times.
SECTION 13. Lasallian Students shall actively participate in the activities, projects and
programs conducted by the LSCA and the student organizations.
SECTION 14. Lasallian Students shall uphold, preserve and maintain the integrity of his/her
Alma Mater.

SECTION 15. Lasallian Students shall take responsibility in the exercises of their rights with
dues regard to the rights of other.
SECTION 16. Lasallian Students shall observe mutual respect and support.
ARTICLE IV
GOVERNMENT STRUCTURE AND OFFICERS
SECTION 1. Statement of the Government Structure
The Tertiary Education Unit Student Government (TEU-SG) of La Salle College Antipolo,
with its mitigating power to establish a government, shall be a democratic union that shall
empower the TEU students rights and as well promote equality and prosperity amongst
individuality without undermining the institutional mission and vision.
SECTION 2. The Power of the Student Body
The TEU-SG shall:
1. have the ability to establish its own government,
2. enact laws amongst members of the council,
3. mitigate the relation between students and the institutional leaders and
stakeholders
4. support students endeavor with accordance to the Mission-Vision statement of the
College.
SECTION 3. Suffrage
The TEU-SG shall recognize the students right to vote, with accordance to the democratic
structure of its established government. The TEU-SG, in relation its governmental structure,
shall recognize the existence of the Commitee on Elections (COMELEC) that shall embody
the students suffrage.
SECTION 4. Political Body and Establishment of Factions
The TEU students shall have the right to establish political factions to provide political
options to students that shall be at least two (2) parties.
ARTICLE V
STUDENT GOVERNMENT FUNDS
SECTION 1. The TEU Student Council Fund shall come from a fixed contribution of every student
enrolled during current school year and other sources derived from approved fund raising
projects.
SECTION 2. The amount of contribution shall be determined by the Executive Board and shall be
collected upon enrollment for the first semester, second semester, and summer term.
SECTION 3. The collection of the fixed contribution shall be undertaken by the Accounting Office and
shall be put into a trust fund otherwise known as the LSCA Student Council Fund and
respective Organization Fund.
SECTION 4. All expenses of the council shall be paid out from this fund in accordance with approved
guidelines on accounting and auditing policies and procedures.
SECTION 5. All other authorized collections by the TEU Student Council, through the Accounting Office
for a special purpose shall be used for such purposes only. Should there be a balance from

such fund, it shall be automatically transferred to the general fund of the council (SC Fund
or respective Organization Fund).
SECTION 6. The balance of the TEU Student Council and Organization Fund is cumulative therefore the
balance for a specific term shall be added to the fund for the next term and succeeding
years.
SECTION 7. Should therefore be any proposal or need for an increase of collections for the TEU SC
Fund or respective Organization Fund, the Executive Board shall convene and conduct
consultations through mass surveys and/or assemblies of their constituents. If the majority
(50%+1) of the student population agrees, therefore, the proposal of the increase is
approved. Below is the scope of consultations:
7.1. TEU SC Fund Entire College Students
7.2. Organization Membership Funds all members of respective organization
SECTION 8. For all purposes of this fund, the incumbent officers and their successors must use this fund
to benefit the students in general.
ARTICLE VI
COMELEC, ELECTION CAMPAIGN AND ELECTION
SECTION 1. The Committee on Election (COMELEC) shall act as quasi-judicial Committee
that will organize, conduct and manage the election of the members of the Board.
SECTION 2. The COMELEC shall enforce and administer all rules and regulations relative to
the conduct of the election.
SECTION 3. The COMELEC shall be composed of nine (9) students, and three (3) faculty
members.
SECTION 4. The COMELEC shall perform the following functions:
4.1 Ensure that the guidelines and procedures for the campaign and elections
are properly observed and implemented.
4.2 Conduct elections.
4.3 Canvass election results.
4.4 Announce results and proclaim winners
SECTION 5. The term of the COMELEC shall begin on the first day of 2 nd semester until the
last day of 1st semester of the succeeding school year
SECTION 6. The COMELEC members shall elect among themselves a Chairman, who shall
direct COMELEC operations and preside over meetings.
SECTION 7. The COMELEC shall draw up and administer procedures for student council
elections, pursuant to the provisions of the Constitution.
SECTION 8. COMELEC decisions shall be made through a simple majority vote.
SECTION 9. No COMELEC member shall be eligible to run for any office in the student
council in the semester immediately following his term in the COMELEC.
SECTION 10. Electoral cases, protests, and petitions shall be forwarded to the COMELEC.
SECTION 11. One COMELEC member shall preside over the elections for professional and
special interest organizations.

11.1
The COMELEC shall make sure that there is no vacancy in the key field
positions. This includes the announcement of filing of candidacy, the election
proper, and the declaration of winners.
11.2
In the event of a vacancy, re-election would be held for that specific
position
11.3
In the event that no one applies for the said position, the COMELEC
together with the Council of Presidents and the supervision of the adviser will
convene on the appointment of the vacant position
11.4
Student Activities Coordinator shall be informed of all the decisions made
by the COMELEC
SECTION 12.
Electoral Campaign
12.1
The campaign must be conducted that befits the dignity of the
Organization.
12.2
Party names, campaign gimmicks and materials must uphold the dignity
and integrity of the LSCA Student Council and fellow candidates.
12.3
Campaign posters / materials should be approved by the Student
Activities Coordinator and the Head of Student Affairs.
12.4
Campaign strategies should not, in any way, besmirch the reputation of
the opposition.
12.5
Campaign must be focused on the candidates qualifications.
12.6
Campaign must be conducted with simplicity and at minimum expense.
12.7
On the first day of the campaign period, parties must submit their official
platform and list of candidates with their corresponding qualifications and 2 x
2 photos for posting by the COMELEC at a designated area.
12.8
Delivery of any speeches during campaign must conform to given
guidelines.
12.9
For the benefit of equality and information, each party will be allowed to
campaign class to class depending on the availability of the class involved.
12.10
A letter should be presented to the Student Affairs Office to be approved
by the Department Chairperson if and whether they can campaign in specific
classes for that day.
SECTION 13.
Electoral Process
Only students who have been screened and declared qualified may run for SC Officers.
Candidates may run under an official party or as independents.
SECTION 14.
Election Procedures
14.1
All students who are OFFICIALLY ENROLLED for the current school
year will be allowed to vote.
14.2
COMELEC members will set the venue for the elections.
14.3
ONLY official ballots will be used for the elections.
14.4
The COMELEC will tally the number of the ballots with the number of
voters.
14.5
After voting, the ballots will be put in a sealed envelope and will be
submitted to the Office of Student Affairs.
14.6
Voters must observe given guidelines for ballots to be considered valid.
14.7
Canvassing of ballots by the COMELEC will take place immediately after
elections.
14.8
Each party/candidate is allowed one (1) poll watcher per canvassing
room.
ARTICLE VII
COMPOSITION, TERM OF OFFICE, QUALIFICATION AND SCREENING OF CANDIDATES

SECTION 1: The governing body of LSCA TEU-SG is composed of the Student Council and Council of
the Presidents. They shall be known as SCCOP.
SECTION 2: The STUDENT COUNCIL shall be composed of:
1. President.
2. Vice President for Internal Affairs.
3. Vice President for External Affairs.
4. Vice President for Operations
5. Vice President for Finance
6. Vice President for Academics
7. Secretary General
SECTION 3: The COUNCIL OF PRESIDENTS shall be composed of:
1. Professional Organization
1. JPIA President
2. EDUCERE Minister General
3. HRM Society President
4. COMMUNICATION GUILD President
5. LA SOCIEDAD DE TURISMO President
6. LIGA DE COMERCIO President

SECTION 4: Election of Officers and Terms of Office

All officers shall have one (1) school year term of office and may run for the same position
twice: The student body elects the Student Council at large while the students of their
respective organizations elect their organization officers. Election of the SC Officers takes
place in the second to the last month of the school year. Their term shall commence/
terminate after graduation ceremonies.
SECTION 5: Qualifications for Student Council Officers:

1. Respect for human dignity, Christian concern for and sincere service to others in the
Lasallian community. Appreciation of their Filipino and Lasallian heritage based on the
recommendation given by respective moderator.
2. Must have an average grade of 85% or 2.5 with no failing grades in their whole stay in
La Salle and must maintain this grade average while in office.
3. Respect and compliance of school rules and regulations. Did not commit any major
offense in the school year immediately preceding the nominations

4. At least an officer of an organization for at least one (1) year or have a background of
leadership.
SELECTION 6: Specific Qualifications for Student Council Officers:
1. President
1.1 Must be a 3rd year or 4th year student.
1.2 Minimum of 2 years residency
1.3 Must not be an incoming officer of any organization/s.

2. Vice President (Internal, External, Operations, Academics)


2.1 Must be a 3rd year or 4th year student.
2.2 Minimum of 2 years residency
2.3 Must not be an incoming officer of any organization/s.

3. Vice President for Finance


3.1 Must be a 2nd year, 3rd year or 4th year student.
3.2 Minimum of 1 year residency
3.3 Preferably taking BS Accountancy, BS Education Major in Mathematics or BS
Business Administration
3.4 Must not be an incoming officer of any organization/s.

4. Secretary General
4.1 Must be a 2nd year, 3rd year or 4th year student.
4.2 Minimum of 1 year residency
4.3 Must not be an incoming officer of any organization/s.

SECTION 7.
Qualifications for the Officers of the different organization
With regards to the qualifications of officers, each organization should refer to their own
Constitution and Bylaws.
SECTION 8.

Screening Process for Student Council

8.2 Procedures for Screening SC candidates:
8.2.1 Students intending to run for the Student Council must secure and fill
up their respective COCs (Certificate of Candidacy) from the Student
Affairs Office.
8.2.2 Upon returning of the COCs the students must submit the following
documents or requirements:
1.
Filled out C.O.C.
2.
Photocopy of previous semesters grade.
3.
Clearance from the Discipline Officer
4.
Parent or guardians approval and reply slip.
5.
Letter of Recommendation from the Moderator and a Faculty
6.
Should undergo a panel interview with the Screening
Committee
8.2.3 The screening committee deliberates on the qualifications of nominees
based on academic and disciplinary standing and recommendation
letters.
8.2.4 The screening committee approves, notifies and announces the
qualified nominees through OSA bulletin boards.
SECTION 9.

Screening Process for Organization Officers


The Screening process for organization officers may or may not be stipulated in the
provisions of the respective organizations Constitution and Bylaws. However, in any case
the organization may follow the process indicated below.
9.1 Students are nominated for Organization Officer positions by their respective
members.
9.2 Nominees are officially screened by the Organization Moderators and Student
Activities Coordinator on the basis of given qualifications.
9.3 Elections of Organization Officers will be done during the Organization General
Assembly which will be organized by the Organization Faculty Moderator.
9.4 Faculty Moderator should be present during the elections.
9.5 A formal letter addressed to the Student Activities Coordinator and the Head for
Student Affairs shall be submitted indicating the electoral process results.
ARTICLE VIII
APPOINTMENTS

SECTION 1. The power to duly appoint LSCA Student Council shall be vested to the members
of the Executive Board.
SECTION 2. The President shall be vested with the power to appoint the:
2.1 Representative to college-wide and multi-institutional committees except if
already vested by this constitution to a particular Student Council.
SECTION 3. The appointee of the Student Council President should come from any bonafide
TEU student.
SECTION 4. All appointees, officers and non-officers shall be subject to the following
qualifications:

4.1 should be of unquestionable credibility and integrity.


4.2 should not have incurred any major or academic offense.
4.3 should have actively participated in any previous or present leadership/voluntary
work.
4.4 all other qualifications stated in the other articles of this constitution.
SECTION 5. The EB shall deliberate on all appointments and shall remove any unqualified
appointee in reference to Article VII section 6 of this constitution.
ARTICLE IX
DUTIES AND RESPONSIBILITIES OF STUDENT COUNCIL
AND COUNCIL OF PRESIDENTS
SECTION 1.
General Functions of the Student Council & Council of Presidents:
1.1 To plan, coordinate, and implement a formation/ development program for student leaders,
together with the College administration, as well as co-curricular and extra-curricular activities
which will enrich the students social awareness, interpersonal skills and the Lasallian core
values of Faith, Service and Communion,
1.2 Establish a link between the administration, faculty, parents and students by representing the
student body in the decision-making of the school through the College Deans Council and by
disseminating vital information on matters which affect the school community, especially the
College students;
1.3 Promote and protect students rights and welfare;
1.4 Implement the rules and regulations stipulated in the TEU Students Handbook;
1.5 Help maintain discipline during departmental and institutional activities
1.6 Initiate activities for better Lasallian community growth;
1.7 Promote awareness of social issues, and commitment to, involvement in and solidarity with
communities within and beyond La Salle College Antipolo;
1.8 Act as official student representatives of the TEU in institutional, Lasallian or non-Lasallian
functions.
SECTION 2.

Specific functions of the Student Council Officers

2.1. Student Council President


1. Approves/signs/notes all resolutions, communications, and papers of the Student Council.
2. Presides over all meetings of the Student Council. He or she may engage in any
discussion provided that he or she consults with the Student Activities Coordinator and the Head
for Student Affairs regarding any decision he or she will make.
3. Presents suggestions, recommendations, and decisions of the Student Council to the
administration, Deans Council and/or Faculty and vice-versa.
4. Represents the Student Council in his / her official capacity as chief executive officer
on occasions that would require representation for the Student Council or the College student
body.
5. Performs such duties and responsibilities as may be necessary.
6. Oversees all co-curricular and extracurricular activities.
2.2 Vice President for Internal
1. Assists the President whenever necessary and assumes their office in their absence with
regards to SC or School initiated gatherings and activities.
2. Initiates activities and programs to effectively promote the essence of community within the
College whether spiritual, formative or special interest.
3. Acts as the Liaison officer between the faculty and the students.

4. Performs other duties that the Student Activities Coordinator or SC President may from time to
time be assigned to him or her.
5. Oversees all extracurricular activities.
2.3 Vice President for External
1. Coordinates and serves as the liaison for all external activities in relation to the Student Council.
Initiates efforts or activities to effectively promote awareness of and involvement in social issues
outside the academe.
2. Be the supervisor and coordinator of the external affairs of the SC under the direction of the
President.
3. Assume the responsibilities of the President in matters concerning external affairs if the
President is absent or incapacitated or if so directed by the EB.
4. Assume automatically the Presidency in the event that both the Presidency and the Internal
Affairs Vice Presidency are permanently vacated.
5. Coordinate with the COP with regards to external affairs of the TEU SG.
6. Performs other duties that the Student Activities Coordinator or SC President may from time to
time be assigned to him or her.
7. Oversees All Co-Curricular Activities
2.4 Vice President for Operations
1. Heads the Logistics Committee, consisting of the VPs of all official student organizations.
Assists the SC with the logistical requirements it needs to pursue the activities initiated by the
SC.
2. Reservation / sourcing for materials, physical set-up, venue and manpower are under his or her
responsibility. Likewise, all materials borrowed from the school should be under his or her direct
care.
3. Performs other duties that the Student Activities Coordinator or SC President may from time to
time be assigned to him or her.
2.5 Vice President for Academics
1. Coordinates with the Deans Council, Department Chairpersons and / or faculty members
regarding academic and curriculum issues.
2. Represents the students in curriculum development programs.
3. Chairs the College Week celebration.
4. Oversees all co-curricular academic related activities
5. Performs other duties that the Student Activities Coordinator or SC President may from time to
time be assigned with.
6. Perform other such duties and responsibilities related to and/or implied from the above
enumeration of duties and responsibilities.
7. Perform other such functions as deemed necessary by the EXECOM.
2.6 Vice President for Finance
1. Initiates efforts or activities to raise funds for the Student Council and
Council of Presidents.
2. Sources out the costing for materials which will be forwarded to the
Purchasing Office of the school.
3. Coordinates with the Finance Office with regards to the budget of the
activities set by the SC through the approval of the Student Activities
Coordinator and the Head for Student Affairs.
4. Assists
all
Organization
treasurers
in
preparing
financial
reports/statements. Act as custodian of the SC funds and enforce
standard operating procedures within the SC with regards to the financial
system.

5. Design and implement a plan for the management of funds under the
jurisdiction of the SCCOP.
6. Formulate and implement policies and procedures governing the
financial resources of the SC.
7. Require financial documents necessary for the maintenance of an
effective monitoring system.
8. Collect and summarize needed data in the preparation of financial
reports dealing with all phases of the financial, accounting and operating
activities of the SC.
9. Prepare semestral financial reports dealing with all phases of the
financial activities of the offices under the SC structure and present such
reports to all offices concerned.
10. Monitor fundraising activities initiated by the offices under the SC.
11. Make periodic reviews of the income and expenditure status of each
budgetary unit for any needed remedial action.
12. Review and monitor all receipts and disbursements of funds within the
SC.
13. Prepare an annual financial report of the SC for examination by the
EXECOM.
14. Performs other duties that the Student Activities Coordinator or SC
President may from time to time be assigned with.
15. Perform other such duties and responsibilities related to and/or implied
from the above enumeration of duties and responsibilities.
16. Perform other such functions as deemed necessary by the EXECOM.

2.7 Secretary General


1. Keeps minutes of the organizations meetings and furnish the facilitator and
attendees copies of the said minutes.
2. Checks attendance during minutes and keep records of attendance of all members.
3. Keeps all papers and official correspondence of the Student Council.
4. Coordination publication of official decisions, projects, and announcements of
the Student Council through the Student Council bulletin board, daily bulletin, the school
newspaper, and/or other appropriate avenues.
5. Heads the Documentation and publicity committee of the SCCOP.
6. Be the Chief Administrative Officer of the Student Council.
7. Take charge of the daily and administrative affairs of the Student Council.
8. Be the official custodian of all records and papers of SCCOP.
9. Be responsible for efficient Student Council office management.
10. Be responsible for the training and development and other concerns and needs of
Student Council officers in the discharge of their duties.
11. Handle all correspondences of the SCCOP, both internally and externally.
12. Coordinate with the other offices to facilitate the maintenance of a
complete and effective filing system of the SCCOP.
13. Supervise the information dissemination of the college-wide activities,
programs and campaigns of the SCCOP through publicity, publications
and the like.
14. Establish programs or projects to obtain regular feedback from the
student body.
15. Prepare the agenda of meetings of the SCCOP after due consultation
with its members.
16. Advise the President on matters of general administration.

17. Perform other functions as deemed necessary by the SCCOP.


18. Performs other duties that the Student Activities Coordinator or SC
President may from time to time be assigned with.
SECTION 3.
Professional/Academic and Special Organizations
3.1 Each official organization in La Salle College, Antipolo City shall have their own set of officers
and their powers, functions, duties and responsibilities as stipulated or defined by the
organizations respective constitution and bylaws recognized by the SCCOP and the Office for
Student Affairs.
3.2 The officers of the academic and special organizations are to be elected each year by the
members of the organization according to the rules and regulations set up by the organizations
constitution and bylaw.
3.3 The head for Student Affairs through the recommendation of the SC and College Administration
may appoint organization heads specifically for Special Interest Organizations and Lasallian
District organizations.
3.4 The organization officers are elected annually through a general assembly set by the incumbent
officers at a date and venue approved by the Student Activities Coordinator.
3.5 The organization Faculty Moderators should be present during this activity.

ARTICLE X
ACCOUNTABILITY OF SCCOP OFFFICERS
All SCCOP officers shall at all times be accountable to the studentry who they must serve
with utmost responsibility, integrity, loyalty, efficiency and professionalism.
ARTICLE XI
THE EXECUTIVE BOARD
SECTION 1. The Executive Board, which shall hereinafter be
referred to as EB, shall be the highest governing body and
representative authority of the TEU-SG.
SECTION 2. The EB shall be composed of the Student Council and
the Council of Presidents

SECTION 3. The EB shall have the following powers, duties and


responsibilities:
To uphold and enforce the provisions stipulated in this Constitution and its bylaws.
To outline and enforce basic policies that shall facilitate the performance of its
duties and responsibilities.
To discuss national, sectoral and college-wide issues and academic-related
matters, projects, programs and campaigns to be presented to the Council of
Presidents.
To ensure fair, efficient and effective representation in all College committees
whose services and decisions affect the welfare of the students.
To create departments and ad hoc as may be necessary to discharge its functions.
SECTION 1. The members of the EB shall determine the frequency

and the time of their meetings.


SECTION 2. Any member of the EB may call special meetings if
he/she deemed it necessary.
SECTION 3. The EB shall constitute a quorum of no less than twothirds of its members.
SECTION 4. A final decision must be reached via a simple majority
(50%+1) of all the members. Decisions made outside this
provision are tentative and unofficial until majority of the EB
members are informed and have agreed.

ARTICLE XII
THE EXECUTIVE COMMITTEE
SECTION 1.
The Executive Committee, which shall hereinafter be referred to as
EXECOM, shall be vested with executive powers.
SECTION 2.
The EXECOM shall be composed of the following:
2.1 President.
2.2 Vice President for Internal Affairs.
2.3 Vice President for External Affairs.
2.4 Vice President for Operations.
2.5 Vice President for Finance.
2.6 Vice President for Academics.
2.7 Secretary General.
SECTION 3.

The EXECOM shall have the following powers, duties and responsibilities:

To discuss and decide on national, sectoral, college-wide issues and


academic-related

endorsement and final approval of the LSCA Administration, whenever
necessary.
To implement all resolutions approved by the EB.
To appeal for reconsideration to the General Assembly any approved motion
or resolution upon two-thirds vote of the members of the EB.

ARTICLE XIII
MEETINGS
SECTION 1. The EB shall conduct regular meeting twice a month or as agreed by the officers
of the Student Council and Council of Presidents.
SECTION 2.

Special meetings of the Student Council and Council of Presidents may be called

upon by the Student Council president when the need arises.


SECTION 3.

Two-thirds (2/3) of the members of the SCCOP or the EB shall constitute a

ARTICLE XIV
ARTICLES OF IMPEACHMENT

SECTION 1.

All SCCOP elected officers may be removed from office, on impeachment for, and
conviction of, culpable violations of this Constitution and betrayal of public trust.

SECTION 2. The following may be grounds for impeachment:


2.1. Any willful violation of this Constitution and its bylaws.
2.2. Gross negligence of duty.
2.3. Illegal disbursement of funds.
2.4. Any behavior which undermines the integrity of the TEU-SG.
2.5. Any other forms of gross misconduct as provided by the TEU-SG policies.
SECTION 3. Any student or officer of the SCCOP may file a resolution of impeachment against any
SCCOP officer. The resolution must be addressed to the Student Activities Coordinator.
SECTION 4. The policies on impeachment shall be as follows:
4.1. The Student Activities Coordinator shall order investigations of cases of
impeachment and recall at its own discretion or on the basis of written complaints
from any student or officer of the SCCOP within seven regular school days (not
including Sundays and holidays). The Student Activities Coordinator shall then
decide whether to initiate impeachment or recall proceedings or not. Should the
Student Activities Coordinator fail to meet this deadline, complaints shall
automatically be dismissed.
4.2. The Student Activities Coordinator shall serve notice of impeachment or recall to the
official/s concerned at least four days before the set hearing date. Any SCCOP
officer must take a leave of absence once notice of impeachment or recall is served
to him/her.
4.3 The Impeachment Committee shall be composed of the following:
1. SC President, unless she/he is under trial
2. Moderator (if it pertains to professional organization presidents)
3. Student Activities Coordinator
4. Head of the Office of the Student Affairs
5. Discipline Officers
6. Guidance Councilor

VACANCIES

SECTION 1. The EB shall decide on actions required for vacancies in the SC following a
special session.
SECTION 2. In case of incapacity in the discharge of duties, removal from office or resignation
of the President, the Vice President for Internal Affairs shall take the position of the
President while maintaining his/her functions and powers as Vice President for Internal
Affairs until the necessary appointment is made.
SECTION 3. In case of incapacity in the discharge of duties, removal from office or resignation
of any EB member excluding the President, the President shall endorse a Student Council
officer.
SECTION 4. Resignation shall only be valid if it concerns health, academics, among others,
subject to the approval of the EB. There shall be no leave of absence from the SCCOP
duties, except for the case of incumbent SCCOP officers seeking to run for office in the
next general elections. Such officers are, however, required to resume their original posts
and complete the term of their original office after election.
ARTICLE XVI
AMENDMENTS
SECTION 1. Any attempt to amend or revise this Constitution shall have to comply with the
following procedures in sequence:
1.1. Any SCCOP officer may propose to amend or revise this Constitution in writing. Such
proposal should be addressed and submitted to the President.
1.2. The President shall call for an assembly of all elected officers of the SCCOP. The
assembly shall allow the proponents to discuss his/her points and reasons for the
amendment or revision.
1.3. Each officer in the assembly shall vote whether in favor or not in favor of the
amendment or revision. A majority vote of all the elected officers in favor of the
amendment or revision shall be needed to continue with the ratification process.
1.4. Any amendment or revision of this Constitution shall be valid only when ratified by
majority votes cast by the members of the TEU-SG at a plebiscite called for by this
purpose.
1.4.1. The membership of the TEU-SG shall comprise of all the bona fide students
of the College as stated in the Article II of this Constitution.
SECTION 2. There shall be no amendment or revision of this Constitution within three years
following its ratification.
SECTION 3. Any amendment or revision to this Constitution shall be transmitted and
communicated to the students within ten school days after its ratification.
ARTICLE XVII
TRANSITORY PROVISIONS & REPEALING CLAUSE
All existing resolutions, codes, Rules of Internal Governance and policies consistent with this Constitution
shall remain operative until amended, repealed or revoked.

ARTICLE XVIII
SEPARABILITY CLAUSE
If any provision of this Constitution is declared invalid, the remainder thereof not affected thereby shall
continue in full force and effect.
ARTICLE XIX
EFFECTIVITY CLAUSE
SECTION 1. This Constitution shall take effect following the ratification by a majority of fifty
percent plus one votes cast by enrolled students at a plebiscite called for by this purpose.
SECTION 2. This constitution shall be applied on the next General Elections for the Academic
Year upon the approval of the administrators and its publication.
SECTION 3. Upon ratification, this constitution shall supersede all previous constitutions of the
Student Councils, and all procedures and policies not consistent with this constitution shall
thereby be amended.
