Deze Algemene Voorwaarden van de Vereniging Directe Verkoop zijn tot stand gekomen in overleg met de Consumentenbond in het kader van de
Cordinatiegroep Zelfreguleringsgroep (CZ) van de Sociaal-Economische Raad en treden in werking op 1 januari 2008. De CZ stelt het op prijs
indien zulks bij een citaat uit deze Algemene Voorwaarden vermeld wordt.
Definities

In deze voorwaarden wordt verstaan onder:
Algemene Voorwaarden of Voorwaarden: de Algemene Voorwaarden van de Vereniging Directe Verkoop die van toepassing zijn op alle directe
verkoopondernemingen die bij de Vereniging zijn aangesloten;
Directe Verkoop: elke verkoopmethode gebaseerd op de verkoop van consumptiegoederen en diensten rechtstreeks aan de Consument door een
Directe Verkoper, door middel van een voorstelling of een demonstratie van de goederen of diensten ofwel bij de Consument thuis of in de woning van
een andere Consument, of in de werkomgeving van de Consument, ofwel op andere plaatsen buiten winkels;
Consument: de contractant, zijnde de koper van goederen of afnemer van diensten, zijnde een natuurlijke persoon die niet handelt in de uitoefening
van een beroep of bedrijf;
Vereniging: de Vereniging Directe Verkoop (VDV), zijnde de nationale vereniging van directe verkoopondernemingen in Nederland die de belangen van
de Directe Verkoop sector in Nederland vertegenwoordigt en lid is van FEDSA (European Federation of Direct Selling Associations) en WFDSA (World
Federation of Direct Selling Associations);
Onderneming: de directe verkooponderneming, zijnde de zakelijke entiteit die producten onder haar handelsmerk of dienstmerk of ander identificerend
symbool op de markt brengt, via een distributiesysteem gebaseerd op directe verkoop en die lid is van de Vereniging Directe Verkoop;
Verkoper: de Directe Verkoper, zijnde elke natuurlijke persoon of rechtspersoon die producten aankoopt van een Directe Verkooponderneming en
daarna verkoopt als zelfstandig ondernemer;
Product: het begrip product omvat goederen en/of diensten;
Prijs: de prijs van het aangeboden goed of van de aangeboden dienst, zonder eventuele verzendkosten;
Bestelbon: ieder met de hand geschreven of gedrukt document dat dient ter bevestiging van een overeenkomst in Directe Verkoop;
Afkoelingsperiode: de termijn waarbinnen de Consument gebruik kan maken van zijn recht de overeenkomst ongedaan te maken;
Verkoopdemonstratie: de voorstelling en demonstratie van de producten aan een groep van consumenten, door een Verkoper, in de woning van een
gastheer of gastvrouw die andere personen uitnodigt voor deze productvoorstelling;
Gedragscode: een zelfregulerende code met verplichtingen die een niveau van ethisch gedrag vaststelt die de wettelijke vereisten te boven gaan en die
nageleefd dient te worden door alle Ondernemingen, aangesloten bij de Vereniging, en haar Verkopers in de relatie naar de Consument en naar elkaar.
Bemiddelaar: de codebeheerder zijnde een onafhankelijke natuurlijke of rechtspersoon of organisatie, aangewezen door de Vereniging om de naleving
van de Gedragscode door de leden-ondernemingen te bewaken en de klachten van de consumenten, verkopers en de directe verkoopondernemingen
te behandelen;
Geschillencommissie: de Geschillencommissie Directe Verkoop aangesloten bij De Geschillencommissie, Postbus 90600, 2509 LP Den Haag.
Schriftelijk: al datgene dat op schrift is gesteld, hetzij per brief (fax of post), hetzij per email (elektronisch).
2.
Toepasselijkheid
Deze Algemene Voorwaarden zijn van toepassing op alle (koop)overeenkomsten uit Directe Verkoop die tussen Verkoper en Consument worden
gesloten.
Het Aanbod
1.De Verkoper zal een eerlijke en duidelijke presentatie geven van de producten en zodanig dat het commercile oogmerk duidelijk naar voren komt.
Vr het afsluiten van de verkoop zal de Verkoper een voorstelling en/of demonstratie van het Product geven, en de volgende informatie voorleggen:
Zijn/haar identiteit en adres en de naam en adres van de Onderneming;
In welke hoedanigheid hij/zij optreedt;
De belangrijkste kenmerken van de aangeboden producten;
De prijzen van de producten, BTW inbegrepen;
Leveringskosten waar toepasselijk;
Betalingsvoorwaarden, kredietkaart regelingen, levering of prestaties;
Het bestaan van recht tot terugtrekking of annulering;
De garantievoorwaarden;
De inhoud van eventuele aanvullende rechten van de consument en de bijbehorende voorwaarden;
Levertijd, indien niet voorradig.
2.Tijdens een verkoopdemonstratie zal de Verkoper het doel van het onderhoud zowel aan de gastvrouw/heer als aan de gasten bekend maken.
3.Indien door de Verkoper aan de consument de mogelijkheid wordt geboden om uitgesteld of in termijnen te betalen, zullen de voorwaarden waaronder
dit geschiedt in het aanbod worden opgenomen.
4.Elk aanbod dient zodanige informatie te bevatten, dat voor de Consument duidelijk is wat de rechten en verplichtingen zijn, die aan de aanvaarding
van het aanbod zijn verbonden. Indien er sprake is van een beperkte geldigheidsduur van het aanbod wordt deze beperking duidelijk vermeld.
Totstandkoming van de overeenkomst

De overeenkomst komt tot stand doordat de Consument het aanbod aanvaardt. Iedere overeenkomst met een financieel belang van in totaal meer dan
34,-- zal schriftelijk worden bevestigd middels een Bestelbon en een voorbeeld bevatten van een opzeggingsbrief, waarmee de Consument de
overeenkomst ongedaan kan maken (zie bijlage 1). Indien van toepassing moet de Overeenkomst datgene dat in het aanbod is vermeld (zie artikel 3.1
en 3.3) bevatten.
Afkoelingsperiode
De Verkoper is verplicht bij overeenkomsten met een financieel belang van in totaal meer dan 34,-- de Consument een afkoelingsperiode te gunnen
van 8 kalenderdagen, welke termijn eerst ingaat op het moment waarop de Overeenkomst door de desbetreffende Kamer van Koophandel is
gedagtekend. Voor elke Overeenkomst met een financieel belang van in totaal 34,-- of minder geldt eveneens een afkoelingsperiode van 8
kalenderdagen, welke termijn eerst ingaat op het moment waarop de Overeenkomst is gedagtekend.

Geschillencommissie Directe Verkoop

Een geschil ontstaat indien de klacht die de Consument heeft over een Product dat hij/zij heeft aangeschaft niet naar tevrede nheid door de
Onderneming
en/of via de bemiddelingspoging van de Vereniging is opgelost.

Een geschil wordt door de Geschillencommissie slechts in behandeling genomen, indien de Consument zijn klacht, al dan niet vi a de Vereniging,
eerst bij de Onderneming heeft ingediend.
Het geschil dient uiterlijk drie maanden na het ontstaan daarvan bij de Geschillencommissie aanhangig te worden gemaakt.
Wanneer de Consument een geschil aanhangig maakt bij de Geschillencommissie, is de Onderneming aan deze keuze gebonden. Indie n de
Onderneming een geschil aanhangig wil maken bij de Geschillencommissie, moet hij de consument schriftelijk vragen zich binnen 5 weken
schriftelijk uit te spreken of hij daarmee akkoord gaat. De Onderneming dient daarbij aan te kondigen dat hij zich na het ver strijken van de
voornoemde termijn vrij zal achten het geschil bij de rechter aanhangig te maken.
De Geschillencommissie doet uitspraak met inachtneming van de bepalingen van het voor haar geldende reglement in de vorm van een bindend
advies. Het reglement wordt desgevraagd toegezonden. Voor de behandeling van een geschil is een vergoeding verschuldigd door diegene die het
geschil aanhangig maakt bij de Geschillencommissie.
Uitsluitend de rechter dan wel de Geschillencommissie Directe Verkoop is bevoegd van geschillen kennis te nemen.
Geschillen tussen de Consument en de Onderneming over de totstandkoming of uitvoering van overeenkomsten met betrekking tot t e leveren of
geleverde goederen en diensten kunnen zowel door de Consument als de Onderneming aanhangig worden gemaakt bij de Geschillenco mmissie
Directe Verkoop, Postbus 90600, 2509 LP Den Haag (www.de geschillencommissie.nl), Tel: 070-3105310, Fax: 070-3658814.
Nakomingsgarantie
De Vereniging Directe Verkoop staat garant voor de nakoming van een bindend advies dat door de Geschillencommissie aan n va n haar leden
wordt opgelegd. De nakomingsgarantie houdt in dat de Vereniging de verplichting die de Geschillencommissie oplegt, overneemt wanneer dat lid
die verplichting niet nakomt binnen de daarvoor in het bindende advies gestelde termijn en evenmin het bindend advies binnen twee maanden na
dagtekening daarvan ter toetsing aan de gewone rechter voorlegt.
Voor toepassing van deze garantie vereist de Vereniging Directe Verkoop dat de consument een schriftelijk beroep hierop doet bij de Vereniging
Directe Verkoop, Postbus 2450, 5202 CL Den Bosch of per e-mail vdv@directeverkoop.nl.
Wijziging van de Algemene Voorwaarden

De Vereniging Directe Verkoop zal deze Algemene Voorwaarden slechts wijzigen in overleg met de Consumentenbond.
ANNULERINGSCLAUSULE
Deze overeenkomst kan door u ongedaan worden gemaakt binnen acht dagen nadat een afschrift bij de Kamer van Koophandel en Fab rieken te
van een datum is voorzien. Zolang behoeft u ook nog niet te betalen. Als u wilt opzeggen, kunt u dat het beste doen per aangetekende
brief of briefkaart uiterlijk zes dagen nadat uzelf de overeenkomst hebt ondertekend. Uw brief of briefkaart komt dan op tijd aan.

Opzegging moet gebeuren aan het volgende adres (voor de naam en het adres van de onafhankelijke distributeur verwijzen wij u naar de voorzijde
van de bestelbon):
