Purpose: The witness will testify on the arrest made to

accused Antonio Mendoza for having possessed illegal drugs;
the testimony of PO1Cabansi is being presented and offered
to prove the following:

That he will testify as one of the witnesses for the
Prosecution;
That he is presently a member of the Philippine
National Police Criminal Investigation and Detention
Group;
That he was the one who acted as a poseur-buyer to
JuanchoDela Cruz;
That he was the one who effected the arrest of
accused JuanchoDela Cruz; and
And to prove such relevant matters.

you employed? In other words, what is your profession?

: I am a bona fide member of
the Philippine National Police.

: What is your rank as a member of the Philippine
National Police?
A

: PO1 maam.

: How long have you been in the service as a police
officer?
A
: I have been in service for almost 11 years now. I
started since 2004.

: Where are you designated, Mr. Witness?

A
: I am currently designated at the Police Station 8,
Baguio City, Maam.
Q
: You mentioned in your affidavit of arrest that you are a
member of the Philippine National Police Criminal
Investigation and Detention Group, is that right?
A

: Yes, Maam.

: Since when have you been serving as a member of
that group?
A

: I have been a member of the PNP CID since 2008.

: On the 8th of November 2015, were you working?

: Yes, Maam.

: Were you assigned any task on that day?

A
: We were assigned to conduct a quick surveillance
based on the report our confidential informant.

: And what is the result of your surveillance?

: We confirmed the truthfulness of the report of our

confidential informant against the accused.

: After confirming the report, what happened next?

A
:
I, together with SPO1 Leslie Raguindin, our
confidential informant Rolex JuristerDawaton, and the PDEA
men, conducted a meeting on how would our buy-bust
operation will run.
Q

: And what did you conclude in the meeting?

A
: That I will posed as the buyer, and after the accused
will hand me the merchandise (shabu), I will give the signal
to my comrades.

: Where did you conduct the buy bust operation?

: In his stall, near their house in Upper Quarry, maam.

: Will you tell us what happened then?

A
: We arrived in the area, I was in civilian attire, I saw
the accused about eight (8) meters and I approached him,
maam.

: And since you pretended to be the buyer, was there
any conversation made between you as the buyer and with
the accused JuanchoDela Cruz?
A

: Yes, maam.

: Can you tell the Honorable Court what was that
conversation?
A
: I was asked, "Anongkailanganko". I pretended to buy
kitchen utensils and said the secret code I will buy Magic
Sarap which is alleged to be the phrase used by customers
to refer to a 0.25 gram of methamphetamine hydrochloride,
commonly known asshabu.

: What happened when you informed the accused about
the secret word ?
A

: I handed him a P1,000 peso bill.

: What happened after that?

: He handed me a small plastic sachet.

: During that time, did you know what was contained in
the plastic?
A
: I suspected it to contain shabu your honor due to
the familiarity of the usual paraphernalia for the use of such
prohibited drug.

: What did you do next when you suspected that the
content of the plastic was shabu?
A
: I approached him and identified myself as a
policeman, I raised his left hand. Which was the pre-assigned
signal so that SPO1 Raguindin together with the rest of the
members of the PDEA rushed to the scene to execute the

arrest of JuanchoDela Cruz and confiscated the plastic

sachet.

fact shabu, was the arrest of the man effected?
A

: Yes, maam.

: The man who sold the Magic Sarap, do you see him
in the courtroom today?
A

: Yes, maam.

: What transpired when you arrested him?

A
: He identified himself as JuanchoDela Cruz. Thereafter,
I informed him of his constitutional rights.

: Did he make any response regarding his constitutional
rights?
A

: None, maam.

: Which police station did you bring the accused to?

: We brought him to the Police Station 8, Baguio City.

: Upon arrival at the Police Station 8, Baguio City, what
happened to the confiscated items?
A
: I submitted it to the desk officer on duty who then
submitted the same to the laboratory for analysis.

: Mr. witness, do you remember having executed any
statement regarding this case?

: Yes, maam.

: I am showing you an Affidavit of Arrest executed by
PO1 NiloBentresCabansi which was previously marked as
Exhibit B during the pre-trial. Will you go over this and
