Submitted envelopes must be closed, identified on the outside, with express

indication of the procurement proceedings for which they are submitted, signed by
the tenderer or by an authorized representative, and must include the name or
company name of the tenderer. Inside each envelope there shall be a separate
sheet containing a numbered list of its contents.
All companies must submit the documentation in Spanish language (sworn
translator).
All documents must be signed by the tenderer. Public documents and certificates
must be filed in original copies or notarized copies.

1.1.- Documento identificativo de la personalidad de quien firma la oferta o la
solicitud de participacin, as como, en el caso de que no acte en nombre propio o
se trate de una persona jurdica, el poder de representacin traducido al espaol.

1.2.- Informe expedido por la respectiva Misin Diplomtica Permanente espaola u
Oficina Consular de Espaa del lugar del domicilio de la empresa, en el que se haga
constar, previa acreditacin por la empresa, que figuran inscritas en el Registro
local profesional, comercial o anlogo o, en su defecto, que actan con habitualidad
en el trfico local en el mbito de actividades a las que se extiende el objeto del
contrato.
Certificate by the Spanish Diplomatic Mission certifying that they are filed with the
local professional, commercial, or equivalent register, or failing this, that they
habitually carry out business and trade transactions within the scope of the
activities covered by the subject of the procurement.
1.3.- Un informe de reciprocidad emitido por la respectiva Misin Diplomtica
Permanente espaola, en el que se haga constar que el Estado de procedencia de la
empresa extranjera admite a su vez la participacin de empresas espaolas en la
contratacin con la Administracin y con los entes, organismos o entidades del
sector pblico asimilables a los enumerados en el artculo 3 del TRLCSP, en forma
sustancialmente anloga. En los contratos sujetos a regulacin armonizada se
prescindir del informe sobre reciprocidad en relacin con las empresas de Estados
signatarios del Acuerdo sobre Contratacin Pblica de la Organizacin Mundial de
Comercio, siempre que dicha condicin de estado signatario del referido acuerdo en
informe de la Misin Diplomtica Permanente espaola u Oficina Consular de
Espaa del lugar del domicilio de la empresa.
Companies established in countries not belonging to the European Union shall have
to justify, by means of a report issued by the relevant Spanish representative office,
that the State of origin of the foreign company, in turn, supports the participation of
Spanish companies in the contracting with the Public Administration and authorities,
agencies or public sector entities similar to those listed in Article 3 of the TRLCSP, in
a substantially similar fashion. Such certificate must be enclosed with the
documentation submitted. In contracts subject to harmonized regulation, the
reciprocity report shall be omitted in connection with companies from countries that
are a party to the Public Procurement Agreement of the World Trade Organization.

3.1.- La oferta econmica, que se formular estrictamente con arreglo al modelo que
se adjunta en el PCAP.
En el caso de que el contrato vaya a ejecutarse en Espaa, la declaracin de
someterse a la jurisdiccin de los juzgados y tribunales espaoles de cualquier
orden, para todas las incidencias que de modo directo o indirecto pudieran surgir
del contrato, con renuncia, en su caso, al fuero jurisdiccional extranjero que pudiera
corresponder al licitante.
The financial offer, that must be signed, and the statement of submission to the
Spanish jurisdiction, with express waiver of any other jurisdiction (shall be in
accordance with the Annex III).
Each tenderer may only submit a single financial proposal, and that proposal shall
only include a single offer. Neither can candidates submit a proposal as members of a
joint venture if they have submitted a proposal individually or as members of another
joint venture. Contravening this ban shall cause the rejection and dismissal of all
duplicate offers.

III. OBLIGATIONS OF THE SUCCESSFUL TENDERER.

1.- Las empresas extranjeras que no tengan domicilio fiscal en Espaa, debern
presentar, certificacin expedida por la autoridad competente del pas en que se
encuentra establecida, acreditativa de hallarse al corriente en el cumplimiento de
sus obligaciones tributarias y que se halla al corriente en el cumplimiento de las
obligaciones sociales que se exijan en dicho pas. La acreditacin habr de referirse
a los ltimos doce meses y se presentar traducida al espaol.
Documentary evidence of being up-to-date with tax and Social Security obligations:
the accreditation shall relate to the last twelve months (and translated into
Spanish). If it is exempted from the tax, it shall submit a certificate of being
registered for the tax, in accordance with the above terms, and an official
exemption statement.
2.- Retencin en precio.
The 5 per cent of the amount of the awarded procurement, Value Added Tax
excluded, will be retained as a guarantee, available for the contracting authority in
accordance with the Annex IV.
