JUDICIAL AFFIDAVIT OF HAZEL JEAN SIMPAS
This Judicial Affidavit of Cyril Gerona, Witness, is executed to serve
as her direct testimony in the instant case.
This Judicial Affidavit is being offered to prove:
A) All the allegations in the Petition including all annexes appended
thereto and which were already marked as exhibits during the PreTrial of this case;
B) All other related matters, facts and circumstances relevant and
material to this case.
This Judicial Affidavit was taken at the office of Atty. Rhoan I.
Hiponia at Wheels Executive Suits, Wheels Building Corner JM Basa
St. Iloilo City.
Questions were propounded by Atty. Rhoan I. Hiponia and these
questions are numbered consecutively and each question is followed
by the answer of the witness.
Q.

Do you swear to tell the truth and nothing but the truth?

A.

I do.

Q. Are you aware that you may face criminal liability for false
testimony or perjury if you will not tell the truth?
A.

I am.

Q. Please state your name, age and address?

A. I am Hazel Jean Simpas, 43 years old, single, and residing at

Lapaz, Iloilo City.
Q.

What is your profession Ms. Witness?

A.

I am a Medical Doctor with specialization in Psychiatry.

Q.

Can you tell us your Educational background?

A. I graduated from Central Philippine University with a degree of

BS Psychology. I took Medicine at West Visayas State University
College of Medicine. Furthermore I underwent my special training in
psychiatry at Harvard University. Presently I am a Diplomate, Board
of Philippine Psychiatry.
Q.

Have you attended seminars in relation to your field of study?

A. Yes, I attended numerous seminars and trainings with regard to

clinical psychiatry.
Q. Can you narrate to us the trainings and seminars that you
attended?
A. I attended the seminar on Clinical Disorders, Personality
Disorders, Psychosocial Disorders, Neurologic Disorders, Borderline
Traits, Anti- Social disorders, Narcissistic Disorders, Suicidal attempts
and Procedures on Psychiatric Evaluation.
Q.

Did you take these seminars successively?

A. I attended these seminars every year because these kinds of

seminars are offered once a year.
Q. How long have you been in practice in the field of Medicine with
the specialization in Psychiatry?
A.

I have been practicing this profession for 13 years.

Q.

Were you able to testify in similar cases in the past?

A.

Yes, I have testified countless times.

Q.

The cases you mentioned, did you get favorable decision?

A. As far as I can remember there are already 15 cases that my

testimony persuaded the court and actually got a favorable decision.
Q.

Do you know Mr. Mark Lozano?

A.

Yes.

Q.

How did you know him?

A. He was the husband of Ms. Charmed Poe Lozano whom

requested this Psychiatric Evaluation.
Q.

When did you examine Mr. Mark Lozano?

A. I was not able to evaluate Mr. Mark Lozano in person as he

refused to be examined. However Ms. Charmed Poe Lozano
underwent evaluation on July 10 and 11, 2014. Furthermore, Ms.
Charmed Lozano handed to me the Psychological Report conducted
by Dr. Cyril Gerona. Lastly I based my Evaluation on Mr. Mark on the
Psychological Report and the Testimony of Ms. Charmed Poe
Lozano.
Q.

What is the result of your evaluation?

A. Based on the Psychological Report Mr. Mark Lozano was

diagnosed positive for DSM IV Diagnosis AXIS I- None, AXIS II AntiSocial and Narcissistic Disorder. The findings of the Psychologist
coincide with the testimony of Ms. Charmed Poe Lozano.
Q. What about Ms. Charmed Poe Lozano what is the result of your
evaluation?
A.

She is negative for any Personal or Clinical Disorders.

Q. Can you explain the effects of this disorder on the Marriage of

Mr. Mark and Ms. Charmed?
A. The presence of this disorder in Mark significantly impairs his
ability to meet the social norms associated with his obligations as a
husband and as a father. The presence of this Disorder prevents Mr.
Mark from fulfilling the essential obligations of Marriage. The
presence of the Antisocial and Narcissistic Personality Disorder
significantly impairs Mark's ability to adapt and tolerate the normal
demands of marriage and family life. This mental incapacity has no
definite treatment and considered incurable.
Q. What are your recommendations with regard to this matter?
A. I strongly recommend that it is better for the well-being of both
parties that their marriage be nullified.
