Question 1: The Minimum Wage Act


Vin Green worked as a General Worker at Country Produce since
March 14, 2016. During his 4th week of employment his boss told the
workers that he was going to Florida and the supermarket would thus
be closed for 2 days (Thursday and Friday). The supermarket is not
operated on weekends. Later, a situation existed during the work week
of May 9th whereby Vin was required to work at the supermarket for 10
hours each day from Monday to Sunday for that week only- which was
more than his usual 40 hour work week for which he normally received
$6200.00 per week.
1. Calculate the minimum the employer can pay Vin for the
work-week that the business was closed although it was
not the fault of the workers.
2. Calculate the correct amount (minimum) to be paid by the
employer for the week in which overtime was done.

Question 2 : The Holiday With Pay Order


Mark Reddie commenced working at Never Rest Ltd. on March 5,
2013 as a Clerk. He was paid $9000.00 per week since his employment
and never got a raise. He spoke strongly to his Manager about this fact
and was told to resign if he did not like the wages. Mark got very upset
and struck the Manager in the face. He was dismissed on the spot, the
same day (Friday April 8, 2016)
1. Calculate specific amount due to Mark for all his vacation
leave as he never received any since his employment.
2. Mark also made a verbal request for his sick leave pay for
the period.

Part 2: Sick Leave Pay for the Period

Pay for sick leave not used during the year is discretionary on the part of the
employer and is not a given. It is a provision for recuperating from illness and is not
accumulated like vacation leave and should not be used as an extension of vacation
leave.

Question 3: The Maternity Leave Act

A female worker who is pregnant and is employed for three (3) years
was told by the Ministry of Labour that she is not eligible for
maternity leave. Examine the Act and discuss four (4) possible
reasons why this was legally possible.

Ans 3:

Under the Maternity Leave Act, 1979 a female worker may not be eligible for
maternity leave under the following conditions:

1. If the pregnancy for which the maternity leave is being requested is


her fourth pregnancy. Under the aforementioned act the employer only
obligated to give maternity leave with pay for only three (3)
pregnancies.
2. If the maternity leave is required before the 28th week of confinement.
Under the Maternity Leave Act a female employee must complete a
minimum of 28 weeks in order to qualify for maternity leave.
3. The employee will not qualify for maternity leave if they have not
completed 52 weeks of continuous service to the company up to the
time that the maternity leave is required.
4. The worker will not qualify for maternity leave if they have not advised
the employer in writing of the pregnancy by the 29th week and put in
an application for the maternity leave. The letter requesting the leave
should indicate an intent to return to work.
