Gov.Wolfalsoannouncedthisweekthathesgivinguponabroadbasedtaxincrease

andreducedhisoverallspendnumberof$33.3billionbywellover$1billion.
Henotedhehassignedacompromiseliquorreformbillandthathewillsigneitherthe
SenateRepublicanortheHouseRepublicanpensionreformproposals(bothareincludedin
differentversionsof

(BrowneRLehigh)),assumingRepublicanscanagreeon
whichonetosendhim.

SenateandHouseRepublicansdonotagreeyetonanyschemetoexpandgamingin

amendingthebillonthesecondtrytoauthorize6newtypesofgaming,includingonlinegaming
ifCongressmakesitlegal,andwithoutvideogamingmachinesfortaverns.
However,thebillremainsintheHouseAppropriationsCommitteeawaitingafinalHouse
Floorvoteandisatleast3daysawayfromanyfinalactionbytheSenateandHousetomoveit
totheGovernorsdesk.

HouseRepublicansandGov.WolfdidteamuptourgetheSenatetoconcurinHouse
amendmentsto
SenateBill1071
(BrowneRLehigh),thepensionreformbillwhichmoves
schoolandstateemployeesfromdefinedbenefittodefinedcontributionplans.
TheSenate,however,voted31to19to
nonconcur
inHouseamendmentsandsendthe
billtoaconferencecommitteewiththeHouse.Sen.Cormanadding,justincasetheresan
agreementonpensions.
Inanycase,everyonehasacknowledgednothinginSenateBill1071willmakeany
differenceintermsoftheFY201617budgetanyway.Itsforthefuture.
TheHousethisweekdidpassataxamnestybill

Montgomery)theysaidcouldraise$150millionFY201617.TheSenateFinanceCommittee
isduetotakeupthebillMonday.
Therewasalsotalkofanincreaseinthecigarettetax,thebanksharestaxandevenanew
naturalgasgrossreceiptstax,inlieuofGov.Wolfsnaturalgasseverancetax,asotherrevenue
generatingoptions.
Butitsjusttalkandrumoratthispoint.

Gov.Wolf,HouseRepublicansandDemocratsThursdaydidteamupforan
announcementofaspeciallegislativesession
onopioidabuse,continuingthebipartisanship
displayedoverthelastfewmonthsinlocalopioidroundtablesacrossthestate.

8:00p.m.onSunday,June26inanticipationofgoodthingshappening.PerhapsontheGeneral
Fundbudgetvehicle

(AdolphRDelaware).
ThefullHouseisscheduledtocomebacktovotingsessiononMonday,June27at11:00
a.m.

TechnicallytheSenatehasadjournedtothecallofthePresidentProTempore,generally
interpretedasasixhourcall,butSen.CormansaidtheSenatewillprobablyreturntosession
MondayliketheHouse.
So,only4moredaystotheJune30budgetdeadlinewhichEVERYONEhassaidthey
willdoEVERYTHINGtheycantonotmiss.
Theydontagreeonpensionreform(wonthelpfillsholesanyway)orontheexpansion
ofgaming(wonthelpmucheither).
Wewillnodoubtbehearing,showmethemoney!intheCapitolBuildingoverthe
weekend.

sectorentitiesfordevelopment,financing,constructionandoperationofrecreation,lodgingand
ancillaryfacilitiesinPennsylvaniaStateParks.

Pennsylvania'ssystemof120StateParksisanincrediblyvaluableassetfromwhichthe
citizensoftheCommonwealthderivemultiplebenefits.
StateParksprovideopportunitiesforaffordableandhealthfuloutdoorrecreation,nature
interpretationandenvironmentaleducation,whileconservingimportantnatural,scenic,
aestheticandhistoricalvalues.
Theyalsomakemeaningfulcontributionstocommunityqualityoflifeandeconomic
development,generatingmorethan$1billioninlocalexpendituresacrosstheStateandreturning
$12.37ineconomicvalueforeverydollarinvested.

What'smore,Pennsylvania'sStateParkshavebeenrecognizedasoneofthe
bestmanagedsystemsinthenation,receivinga
NationalGoldMedalAwardforExcellenc
ein

ParkandRecreationManagement.
Thissuccessfulrecordofmanagementincludesoversightofmorethan130concession
operations.DCNRhasexistingauthoritytoenterintoconcessionorleaseagreements,including
longtermcontractsforlargescalerecreationfacilities.
ThroughtheirextensiveexperienceprovidingPennsylvanianswithqualityoutdoor
recreationopportunities,StateParkprofessionalshavelearnedwhichtypesofpublicprivate
partnershipsworkbest.
Accordingly,wequestionboththeneedforandvalueofaseparateentitylikethe
proposedBoard.
Webelieveitsfunctionsattheveryleastwouldduplicatedecisionmaking
responsibilitiesofStateParksprofessionals,andpotentiallycouldresultinrecommendationsthat
areinconsistentwiththemissionofPennsylvania'sStateParksandthebestprofessional
judgmentofStateParkmanagers.
Ourspecificconcernsincludethefollowing:

NewBoard:
UnderHouseBill2013,thenewlycreatedBoardwouldenjoyconsiderable
leverageandinfluence,andassuch,DCNRcouldfinditdifficulttorejecttheBoard's
recommendationsfordevelopmentprojects,eveniftheyconflictwithStateParkmanagement
goalsandpriorities.
Theaboveconcernisparticularlynoteworthy,whenobservingthatHouseBill2013

providesnocriteriafortheBoardtouseinitsreviewandapprovalofproposedprojects.
Thebillcontainsareferencetodevelopingguidelinesforsponsorstousewhen
submittingproposals,butdoesnotidentifyspecificfactorstheBoardwillconsiderinevaluating
suchproposals(e.g.,potentialeffectonexistingparkusers/uses,potentialimpactonnatural
resources/habitat,compatibilitywithparkcharacterandlocallanduses,leveloflongterm
maintenanceandreinvestmentrequired,demandforservice/amenitytobeoffered,etc.).
NoAdditionalFunding:
HouseBill2013wouldrequireDCNRtoprovideallnecessary
assistancetotheBoard,includingretentionoflegal,financialandtechnicalconsultants.The
additionalresponsibilitiesandrelatedcostsassociatedwiththeBoard'sinventory,solicitation,
andevaluationofproposedprojectscouldbesubstantial.Thelegislationprovidesnoadditional
sourceoffundingfortheseactivities.
LongTermMaintenanceCosts:
HouseBill2013alsoimposeslongtermmaintenancecosts
ontheCommonwealthbytransferringmanagementresponsibilitiestoDCNRafter25years
typicallywhensubstantialupkeepandrepairwillbeneeded.Thelegislationprovidesnosource
fundingfortheseobligations.
NoPublicInvolvement:
Althoughitwouldcreateanewprocessforapprovingpotential
developmentprojectsinPennsylvania'sStateParks,andsuchprojectsarelikelytobeof
considerableinteresttothepublic,HouseBill2013doesnotprovideopportunitiesforpublic
reviewandcommentaspartoftheBoard'sapprovalprocess.
Becauseoftheconcernsnotedabove,weareunabletosupportHouseBill2013,PN
3219.
WeencouragetheCommitteeandsponsors,ratherthanmovingforwardwiththis
legislation,insteadtoexploreworkingwithDCNRanditsRecreationalAdvisoryCommitteeand
ConservationandNaturalResourcesAdvisoryCounciltoupdatethestudyonStatePark
concessionandleaseoperationsconductedbyPennStatetenyearsago.
Suchareviewcouldprovidehelpfulinformationontheviewsandpreferencesofvisitors

regardingrecreationopportunitiesatStateParksandtheexperiencesofDCNRandparkagencies
inotherstateswiththeprivateoperationofparkinfrastructureandfacilitiesofallsizesand
categories.

concernregardingHouseBill2013.
Forinexcessof125years,Pennsylvaniahasbeenfortunatetohavehadleaderswith
enoughforesighttosetasidemorethan2millionacresofstateforestand121stateparksforthe
generalpublictoenjoyandappreciate.
Thisbillwouldencouragedevelopmentinareasoriginallyintendedasaccesstothe
naturalworldandhealthyoutdoorrecreationwouldplaceafinancial,staff,andresourceburden
onastateagencyforprivategainandwouldintroducenontraditionaluseofstateparksthatare
notsupportedbyrecentpublicsurveys.
In2009,theNationalRecreationandParksAssociationandtheAmericanAcademyfor
ParkandRecreationAdministrationhonoredPennsylvaniasstateparkswiththeirprestigious
GoldMedalAwardforExcellenceinparkmanagement.
ThisawardtotheDepartmentofConservationandNaturalResources(DCNR)wasin
recognitionforouragencyprofessionalsskillinplanningforandmanagingadiversestatepark
system.
DCNRalsoholdsthedistinctionofbeingtheonlytwotimewinneroftheNationalParks
ServiceandSocietyofOutdoorRecreationProfessionalsawardforourStatewide
ComprehensiveOutdoorRecreationPlan(SCORP),whichfor2016includes20
recommendationsand83actionsteps.
ThistophonorrecognizedtheDepartmentfortheircollaborativeapproachtorecreation
planning.Developmentoftheplanincludedcomprehensivedatacollection,withover10,000
surveyrespondentsasteeringcommitteerepresenting40agencies,organizations,and
commissionsthreepublicinputmeetingsandonlinepublicfeedbacksessions.
TheprofessionalstaffattheDepartmentofConservationandNaturalResources
consistentlydemonstratesanunderstandingofthechangingneedsofrecreationinPennsylvania.
Forexample,inrecentyearsasmallnatureinnwasbuiltatBaldEagleStatePark,andan
existingfacilityatCookForestStateParkwasconvertedintoabedandbreakfast.
Currently,morethan200fullservicehookupscanbefoundin14stateparks,alongwith
hundredsofothercampsites,moderncabins,campingcottages,yurts,andrusticcabins.

TheDepartmentalsohassignificantexperiencewithpublicprivatepartnershipswith138
concessionairescurrentlyoperatinginthesystem,representingskiareas,whitewaterrafting,
foodconcessions,boatrentals,andmore.
Additionally,therearemorethan50friendsgroupsacrossthestateworkingin
cooperationwithDCNRinpublicprivatepartnerships.Thesegroupsrepresentdedicated
volunteerscommittedtotheconservationandstewardshipofourstateownedlands.
HouseBill2013sidestepsthelonghistoryofprofessionalplanningandmanagement
demonstratedbytheDepartmentofConservationandNaturalResourcesbyopeningourstate
parkstoprivateinterestbankrolledbytaxpayerdollars.
HouseBill2013proposestoopenourstateparksforprivatedevelopmentrangingfrom
hotelstoamusementparkstoofficebuildings.
Accordingtothebill,constructioncostofthesenew,commercialfacilitieswouldbe
augmentedthroughtheDCNRbudget,therebydivertingfundsfromneededcapital
improvementstoexistingstructuresalreadyidentifiedbyparkstaff.
Thisisinstarkcontrasttopublicopiniononhowpublicdollarsshouldbeinvested.
TheSCORPsurveyfoundthehighestfundingpriorityidentifiedbysurveyrespondents
asitrelatestoparkdevelopmentwastomaintainexistingparkandrecreationareas,followed
closelybyprotectingwildlifeandfishhabitat,andacquiringadditionalopenspace.
Maintainingcurrentfacilitieswasmoreimportanttothecitizensofthestatethan
developingnewfacilities.
HouseBill2013removesDCNRsabilitytomakedecisionsaboutdevelopmentinstate
parks,yetplacesastaffingburden(withnoassociatedadditionalrevenuetofundsaidstaff)on
parkstooverseethenewboardproposedbythebill,toresearchideaspresentedbytheboard,
andtooverseeconstructionandoperationofthesenewfacilities.
ThebillalsorequiresDCNRtoinvestalreadylimitedfundstosubsidizeand/orbuild
whateverprojectsthenewboardapproves.
Atpresent,onlyabout$20millionayearisallocatedtostateparksformajorrepairsand
newcapitalprojectslikebathrooms,upgradedcampgrounds,additionalcabins,and
improvementstorecreationalfacilities.
Allofthesealreadylimitedfundscouldbedivertedforprivategainatacosttothe
generalpublicifHouseBill2013weretobeenacted.
Resortlikedevelopmentshavealonghistoryoffailureinstateparksacrossthenation.
Toooften,concessionairesdonotreinvestintheinfrastructuretheyarerenting,placingaburden
onthetaxpayertodoso.
Andthecreationofacontractualrelationshipthroughapublicprivatepartnershipisnota
guaranteeofsuccess.
Forexample,atDentonHillSkiAreathestateisnowfacedwithahugeprojectatthe
parkaftertheconcessionairedefaultedonhisobligations.
Creatingresortsinstateparkswouldcreateanunfairdisadvantageforthestatesprivate
resortssuchasatMountPocono,Nemacolin,GatewayLodge,andnumerousothersaswellas
smallinnsadjacenttostateparks.
AquickGooglesearchreveals103resortsinthestate,astrongindicationthatwhen
feasibletheprivatesectorwillinvestintheacquisitionanddevelopmentoflodgingsand
recreationalfacilities.
Thiscurrentprivateinvestmentapproach,whichrelieslessontaxpayerinvestmentand

moreonprivateentrepreneurship,generatesmorerevenuefortheCommonwealththana
DCNRsubsidizedresortthatpullsfromanalreadystrainedparksbudget.
Privateinvestmentincommunitiesoutsideofstateparkscanboostlocaleconomies,
providesanincreasedtaxbase,andismorefittingtotheintentionofstateparks.
Ifthelegislaturetrulywantstoaccommodatethepeopleofthecommonwealth,the
investmentofadditionaldollarsinthedevelopmentofstateparkcabins(whichwasidentifiedby
thepublicasthetopinvestmentneedwhenfundsarebeinginvestedinthecreationofnew
infrastructure)andanincreaseintheallocationofmaintenancedollarswouldprovideagreater
returnthantheproposeddiversionofpublicfundstoprivateinterest.
Wewouldalsoencouragethestatetoinvestinthecreativereuseofbuildingscurrently
existinginstateparks,suchaswasdonewiththeInnatCookForest.
Insummary,thePennsylvaniaParksandForestsFoundationopposesHouseBill2013
andurgesyoutoopposethisbillaswell.
TheStatewideComprehensiveOutdoorRecreationPlanisbutoneyearoldandalready
muchworkhasbeendonetomoveforwardtheaggressiveagendaapprovedbythepeople.
Theplanrecognizedthatwehaveachangingpopulationweareaging,becomingmore
urban,andaremoreethnicallydiverse.
Withthesefactorsinmind,therecreationcommunityandtheDepartmentof
ConservationofNaturalResourcesisworkingtoengagethechangingfaceofthepeopleofthe
state.
Pennsylvanianslovetheirstateparksandforests,asdoweatthePennsylvaniaParksand
ForestsFoundation.
Asanorganization,wearededicatedtothestewardshipofourparksandforests.
Weinvestvolunteerlaborandprivatedollarsintotheirconservationandstewardshipand
firmlybelievetheyshouldbeaccessibletoeveryPennsylvanian.
Weopposeanydiversionofalreadylimitedallocationsfromagencyprofessionalswho
havealreadyprovenonanationalstagetheirexpertiseinparksmanagement.
Wefurtheropposethedevelopmentofincompatibleactivitiesandfacilitieswithinour
stateparks.Resorts,amusementandwaterparks,offices,outdoorsportsfacilities,andgolf
coursesexistoutsideofstateparksinmoreappropriatesettings.
Ourstateparksandforestsweresetasidetoconserveournaturalworldandthevery
personalrelationshipgenerationshavedevelopedwiththem.Inthesedaysthatseemtomove
everfaster,nowisnotthetimetolosethevaluablesanctuariessomanypeoplehaveworkedso
hardtoprotect.

Despitenearlyacenturyofcooperationbetweentheownersofprivatemineralrights
andthefederalgovernment,extremeenvironmentalgroupsrepeatedlyattemptedtoshutdown
energyproductionintheAlleghenyNationalForest,CongressmanGlennThompsonsaid.
TheCooperativeManagementofMineralRightsActwillmaketheseaffirmativecourt
rulingslaw,protectingjobsinourcommunitieswhilereaffirmingtheimportanceofprivate
propertyrights,saidThompson,amemberoftheU.S.HouseNaturalResourcesCommittee.
TheCooperativeManagementofMineralRightsActwillputtorestanissuethathas

createdgreatuncertaintypertainingtoprivatemineralrightsintheAlleghenyNationalForest.I

MitigationBankingismostlynewtoPennsylvania,butispopularandhighlyutilizedin
otherareasoftheU.S.,saidElliottBoullion,PresidentandCEOforRES.Simply,itisthe
restoration,creation,enhancement,orpreservationofawetland,stream,orotherhabitatarea
undertakenexpresslyforthepurposeofcompensatingforunavoidableresourcelossesin
advanceofdevelopmentactions,whensuchcompensationcannotbeachievedatthe
developmentsiteorwouldnotbeasenvironmentallybeneficial.Mitigationbankingata
watershedscalehasbeenshowntobeamoresustainablemitigationapproach.
Thelackoflargescalemitigationbanksandwetlandandstreamcreditsupplyin
Pennsylvaniahasbeenachallengethatfederal,stateandlocalresourceagencieshavebeen
workingtogethertoaddress,addedBoullion.TheRobinsonForkMitigationBankisthe
largestmitigationbanktobeapprovedinPennsylvaniaandthefirsttodeliverecologicaloffset
solutionstosouthwesternPennsylvania.REScontinuestoinvesttomakemitigationresources
availabletosupporteconomicdevelopmentactivitiesacrosstheCommonwealth.

TheRobinsonForkMitigationBankprovidespositiveecologicalandeconomicbenefits
forPennsylvanians.
RESinvestmentinecologicalrestorationimprovesthedegradedstateofafragile
ecosystembyrestoringandpreservingover136,000linearfeetofselfsustaining,functional
headwaters,mainstemstreamsandtheirtributariesandassociatedwetlandsandriparian
corridorsintheUpperOhioRiverSubbasinandinWashingtonCounty.
RobinsonForkMitigationBankecologicalrestorationprojectactivitieswilloccupya
significantportionoftheRobinsonForkWatershed,nearly7squaremiles,andareplannedto
resultinnetgainsofoveramileofnewstreamsand46acresofnewwetlands.
Ecologicalrestorationactivitieswillcreateanintegratedstreamandfloodplainsystem
restorelocalizedgroundwateraquifersreconnectfloodplainstothewatertableandstreams
optimizeanddiversifyhabitatandcreateahydrologicsystemthatallowsfortheretentionof
nutrients,streambedmaterialandorganiccarbon.
Theplannedrestorationapproachwillincreaseecologicalcomplexityandlongterm
hydraulicstabilityatthesite.
Thisecologicalrestorationprojectbalancesenvironmentalstewardshipandeconomic
development.Theprojectprovidesadirectsourceofreplacementofaquaticenvironmental

resourceimpactswithintheOhioRiverSubbasin.
WetlandandstreammitigationcreditsareavailabletoPermitteeswhoseprojectsrequire
ecologicaloffsetstocomplywithregulatoryagencypermittingconditions.
Inaddition,Sen.CameraBartolotta(RWashington)said,"Todaysannouncement
providesauniqueexampletoallofPennsylvaniahowwecanutilizeprivatesectorfundsto
promoteprivateinvestmentthatwillimproveourenvironment.Thisisthetypeofresponsible
investmentthatwillimproveourlocalwaterwaysandencouragerecreationandeconomic

anInteragencyReviewTeamcomprisedoftheBaltimore,PhiladelphiaandPittsburghDistricts
oftheU.S.ArmyCorpsofEngineers,theDepartmentofEnvironmentalProtection,theU.S.
EnvironmentalProtectionAgency,theU.S.FishandWildlifeService,theU.S.Departmentof
AgricultureNaturalResourceConservationService,theFishandBoatCommissionandthe
GameCommission.
Eachoftheseenvironmentalprotectionagenciesprovidedirectinputonhowthebankis
createdtherefore,closelyregulatingthisindustryandensuringthataholisticenvironmental
projectisbuilt.

Approximatelysixacresofminescarredlandthathadbeenstripminedinthepastwill
alsobereclaimedwithnewvegetationandmitigateapotentialsourceofacidminedrainage.
Workisexpectedtobecompletedbytheendoftheyear.
ThisgrantnotonlyaddsanotherparceltothelonglistofsitesthattheEarth
Conservancyhassuccessfullyreclaimed,italsoimprovespublicsafety,saidSen.Yudichak.
Highwallsareparticularlydangerous.Thisprojectaddressesalengthyhighwall,which
atsomepointsrisetoabout30feet,asthesevereslopeofthematerialmakesthemproneto
collapse,saidMichaelDziak,President/CEOoftheEarthConservancy.Thisiswhytheyarea
priorityintheabandonedminelandreclamationprogram,andwhywearepleasedtopartner
withthePennsylvaniaDepartmentofEnvironmentalProtectiononthisproject.
Thecooperativeeffortamongthestatelawmakerswasvitalintheefforttosecurethis

TheU.S.EnvironmentalProtectionAgencyandtheDepartmentofJusticeThursdayannounced
D.G.YuenglingandSonInc.,hassettledCleanWaterActviolationsinvolvingitstwo
largescalebreweriesnearPottsville,SchuylkillCounty.
InaconsentdecreefiledinfederalcourtinHarrisburg,Pennsylvania,thecompanyhas
agreedtospendapproximately$7milliontoimproveenvironmentalmeasuresatitsbrewery
operationsafteritallegedlydischargedpollutantsintotheGreaterPottsvilleAreaSewer
Authoritymunicipalwastewatertreatmentplant.
Yuenglingwillalsopaya$2.8millionpenalty.
Inaddition,theconsentdecreeincludesarequirementtoimplementanenvironmental
managementsystemfocusedonachievingCWAcomplianceatthefacilities.Yuenglingmust
hireathirdpartyconsultanttodeveloptheEMSandathirdpartyauditortoensureproper
implementationatthefacilityoperations.
ThecompanyallegedlyviolatedCleanWaterActrequirementsforcompaniesthat
dischargeindustrialwastetomunicipalpublicallyownedwastewatertreatmentfacilities
numeroustimesbetween2008and2015.
Companiesmustobtainandcomplywithpermitlimitsondischargesofindustrialwaste
thatgoestopublictreatmentfacilities,whichinmanycasesrequirepretreatmentofwaste
beforeitisdischarged.
ThecasewasreferredtoEPAbytheGreaterPottsvilleAreaSewerAuthority.
YuenglingisresponsibleforseriousviolationsofitsCleanWaterActpretreatment
dischargelimits,posingapotentialrisktotheSchuylkillRiverwhichprovidesdrinkingwaterto
1.5millionpeople,saidEPARegionalAdministratorShawnM.Garvin.Thishistoryof
violationsandfailuretofullyrespondtoordersfromtheGreaterPottsvilleAreaSewerAuthority
andEPAtocorrecttheproblemsresultedinthisenforcementaction.
Itisvitalthatcompaniesusingmunicipalwastewatertreatmentfacilitiesstrictlyfollow
pretreatmentguidelinesandpermitlimitsfortheirwastewater.Itiswhatgoodneighborsexpect,
anditiswhatthelawrequires,saidAssistantAttorneyGeneralJohnC.Crudenforthe
DepartmentofJusticesEnvironmentandNaturalResourcesDivision.Thissettlement
requiresYuenglingtoputintoplaceanenvironmentalmanagementsystemdesignedtomanage
compliancewiththeCleanWaterActinasystemic,planned,anddocumentedmannerto
establishatopdown,preventionfocusedapproach.Thesettlementalsomandatesindependent
auditsofYuenglingscompliancewiththeconsentdecree,amongotherrequirements.
Inacomplaintfiledconcurrentlywiththesettlement,theUnitedStatesallegedthat
Yuenglingviolatedpretreatmentpermitrequirements,includingdischargelimitsforbiological
oxygendemand(BOD),phosphorus,zincandpHtotheGPASAtreatmentplant,atleast141
timesfrom2008to2015.
Pretreatmenthelpsremoveorchangethecompositionofpollutantsinwastewater.
Unpermittedorexcessiveindustrialdischargesmayinterferewiththeoperationofpublic
wastewatertreatmentplants,whicharegenerallydesignedtohandlesewageanddomesticwaste,
leadingtothedischargeofuntreatedorinadequatelytreatedwastewaterintolocalwaters.
Inadditiontothemonetarypenalty,Yuenglinghasalsoagreedtotakemeasuresthatwill
preventfutureviolationsincluding:

itwiththestakeholders.Ibelieveitrepresentsareasonablecompromiseandmostimportantly,
opensupthepossibilityofprovidingnewoutletsforourconstituentswhoareeagertoseetheir

forviolationsoftheSolidWasteManagementAct.
TheactionwastakenafterinspectorsforDEPsWasteManagementfoundthatlarge
quantitiesofuntreatedregulatedmedicalwasteweretransportedtoWasteManagementInc.s
Monroevillelandfill.
ThelandfilloperatorsalertedDEPtotheproblemwhentheynoticedmedicalwaste
mixedinwithtrashinmunicipalwasteshipmentsfromvariousUPMCfacilities.Thatprompted
DEPinspectorstovisitthelandfillandscreenshipmentsastheyarrivedfromseveralmedical
facilitiesintheregion,includingtwohospitalsintheAlleghenyHealthNetwork(AHN).

Inspectorsobservedtheincomingmunicipalwasteincludedmedicalwastesuchas
bloodydressings,bodyfluidsandsharps(needles).
Acontractorhiredbythehospitalsremovedthemedicalwastefromthelandfilland
disposedofitatanauthorizeddisposalfacility.
DEPinspectorsconductedfollowupinspectionsatanumberofUPMCfacilitiesandthe
twoAHNhospitals.Thoseinspectionsrevealedadditionalviolationsincludingimproper
labeling,storageandhandlingofregulatedmedicalwaste.
UnderDEPregulations,medicalwasteincludesmaterialsuchasdressings,sharps,
tubing,containers,andbodyfluids.Regulatedmedicalwastemustbeseparatedfrom
noninfectiouswaste,appropriatelylabeled,andtreatedtorenderitnoninfectiouspriorto
disposal.
DEPfinedAHNatotalof$86,900onJuly7,2015forsimilarviolationsoftheSolid
WasteManagementActatWestPennHospitalandForbesRegionalHospital.
AsaresultoftheDEPactions,UPMCandAHNhaveupdatedtheirpoliciesandtraining.
DEPcontinuestoworkwiththehospitalstoensuretheirmanagementpracticesareinfull
compliancewiththerulesandregulationsgoverningthepropermanagementofregulated
medicalwaste.
DEPinspectorshaveconductedfollowupvisitstothefacilitiesandwillcontinueto
investigateandpursueenforcementmeasuresifandwhenadditionalviolationsoccur.

TheOfficeofAttorneyGeneralThursdayannouncedthearrestofEricSpatt,theformerowner
andpresidentofaLackawannaCountybusinesswhoisaccusedofimproperlystoringhazardous
waste.
ThisallegedconductcontributedtoamassivefireatSpatt'sformerbusiness,Scranton
Cooperage,thatputfirefighters,emergencypersonnelandothersatrisk.
ThecriminalchargesfiledagainstSpatt,52,followedanextensiveinvestigationbythe
OfficeofAttorneyGeneral'sEnvironmentalCrimesUnit.
TheinvestigationdeterminedthatSpattin2000receiveddocumentationmakinghim
awarethatwastesodiumchloritewasapotentiallyhazardoussubstance.Butheallowedstorage
drumscontainingthesubstancetobestoredathisbusinessforapproximately13years,allowing
thedrumstodeteriorate,investigatorsallege.
"Theconductofthisindividualputhundredsofpeopleingravedanger,"Attorney
GeneralKanesaid."Thereisareasonthereareregulationsgoverningthestorageofdangerous
waste.Wewillcontinuetoprosecutethepeoplewhoignorethoserulesandputothersatrisk."
Accordingtoacriminalcomplaint,Spatt'sbusinessreconditionedvarioustypesofused
containers,includingstoragedrums.Thebusinesswaslocatedat1264MidValleyDrive,Jessup.
ThefireignitedatthebusinessonJune27,2014,requiringaresponsefrommorethan

200firefightersandemergencypersonnel.Firefightersatonepointhadtoevacuatetheareaof
thefireduetoexplodingdrums.
Thefirealsocausedtheevacuationofanearbyhousingdevelopment,investigatorsstated
inacriminalcomplaint.
TheOfficeofAttorneyGeneral'sinvestigationincludedareviewofanenvironmental
cleanupoftheScrantonCooperagesite,whichconfirmedwastesodiumchloritewaspresenton
theproperty.
ThestateDepartmentofEnvironmentalProtection,whichfiledacomplianceorder
againstSpattin2008,furtherconfirmedthatSpatthadneverappliedfororreceivedapermitto
store,process,treatordisposeofsolidwasteatthebusiness.
Thatconductallegedlyledtothefire,whichwasignitedwhentheplantmanagerat
ScrantonCooperageaccidentallypuncturedastoragedrumcontainingsodiumchloriteashewas
operatingaforklift,investigatorsstated.
Additionally,accordingtothecriminalcomplaint,investigatorsdeterminedSpattin2000
hadreceivedamaterialsafetydatasheet,whichidentifiedwastesodiumchloriteasapotentially
hazardoussubstance.
Thedocumentationalsoincludedinformationonhowthesubstanceshouldbestored,
includingthefactthatitsshelflifeisamaximumoftwoyears.
Spatt,420NorthSpyRoad,SouthAbingtonTownship,ischargedwiththreecountseach
offailuretomanagehazardouswasteandunlawfulconduct,aswellasonecounteachofcausing
catastrophe,riskingcatastrophe,failuretopreventcatastropheandrecklesslyendangering
anotherperson.
Hisbailwassetat$100,000unsecuredfollowingapreliminaryarraignmenttoday.A
preliminaryhearingistentativelyscheduledforJune29.
TheOfficeofAttorneyGeneralthankedthestateDepartmentofEnvironmental
Protectionforitsassistancewiththisinvestigation.
TheOfficeofAttorneyGeneralassumedjurisdictionofthiscaseafterreceivingaformal
referralfromtheLackawannaCountyDistrictAttorney'sOffice.
ThiscasewillbeprosecutedbySeniorDeputyAttorneyGeneralBrianCoffeyofthe
OfficeofAttorneyGeneral'sEnvironmentalCrimesUnit.
Apersonchargedwithacrimeispresumedinnocentuntilprovenguilty.

Atthistime,theextentandsourceofthecontaminationisnotyetknown.DEPis

workingexpedientlytoinvestigateprivatewellsinthearea,removethemfromserviceand
determinealongtermsolution,saidSoutheastRegionalDirectorCosmoServidio.Itis
importanttoreiteratethatallpublicmunicipalwaterintheareameetstheEPAHealth
Advisory.
OnMay19,2016,EPAissuedaLifetimeHealthAdvisoryLevel(HAL)of70partsper
trillion(ppt)forthecombinedconcentrationofperfluorooctanesulfonate(PFOS)and
perfluorooctanoicacid(PFOA)indrinkingwater.
Asaresult,DoylestownTownshipMunicipalAuthorityremoveditsCrossKeyspublic
watersupplywellfromserviceafterPFOSandPFOAwerefoundtobeabovetheEPAsnew
HAL.
DEPSoutheastRegionalOfficeimmediatelytookstepstobeginathoroughinvestigation
ofthesurroundingarea.
Privatewellownersandcommunitywellownersservinghighlysensitivepopulations,
suchasnursinghomesanddaycares,withinapproximately1mileoftheimpactedCrossKeys
publicwellwillbecontactedtoschedulewatersamplingforPFCs.
Bottledwaterwillbeimmediatelyprovidedtoanyresidencewhosesamplesexceed
EPAsHealthAdvisoryLevelforPFCs.
Initialsamplingresultswillformthefoundationforfurtheranalysisoftheextentof
contaminationinthearea,potentialremediationoptionsandlongtermsolutionsforresidents.
Activitiespertainingtothisinvestigation,includingsamplingandanynecessarybottled
waterdistribution,arefullyfundedbyDEPsHazardousSitesCleanupFund.
UndertheSafeDrinkingWaterAct,DEPdoesnotregulateprivatewells.AlthoughDEP
istestingforPFCs,itisrecommendedthatallPennsylvaniaresidentswithaprivatewellhave
theirwellwatersampledevery3to5yearsforavarietyofchemicalcompoundstoensurethe
waterissafetodrink.

drinkingwatertests.

Weatherconditionsandotherunexpectedeventscoulddelayorcancelthisspray
operation.IfconditionsdonotallowapplicationonJune28,2016,thefollowingeveningwill

Cleanandchlorinateswimmingpoolsnotinuseandremoveanywaterthatmaycollecton
poolcovers.Ifaresidenthasstagnantpoolsofwaterontheirproperty,theycanbuyBTI
productsatlawnandgarden,outdoorsupply,homeimprovementandotherstores.Thisnaturally
occurringbacteriumkillsmosquitolarvae,butissafeforpeople,pets,aquaticlifeandplants.
Additionally,thesesimpleprecautionscanpreventmosquitobites,particularlyforpeople
whoaremostatrisk:
Makesurescreensfittightlyoverdoorsandwindowstokeepmosquitoesoutofhomes.
Considerwearinglongsleevedshirts,longpantsandsockswhenoutdoors,particularlywhen
mosquitoesaremostactiveatdawnanddusk,orinareasknownforhavinglargenumbersof
mosquitoes.
Whenpossible,reduceoutdoorexposureatdawnandduskduringpeakmosquitoperiods,
usuallyAprilthroughOctober.
Useinsectrepellentsaccordingtothemanufacturer'sinstructions.Aneffectiverepellentwill
containDEET,picardinorlemoneucalyptusoil.Consultwithapediatricianorfamilyphysician
forquestionsabouttheuseofrepellentonchildren,asrepellentisnotrecommendedforchildren
undertheageoftwomonths.

SignificantchangesinPennsylvaniaselectricitygeneration
mixarewellunderway.Theavailabilityoflowcost,
abundantnaturalgascombinedwithanincreaseinrenewable
energybuildandcontinuedinvestmentinenergyefficiency
arecontributingtothecreationofamorediversifiedenergy
portfolio.
In
anupdatedanalysis
fromenergymarketresearchfirm
BloombergNewEnergyFinanceandthe
BusinessCouncil
forSustainableEnergy
,itwasfoundthatwhilecoaland
nuclearmakeupthemajorityofthestateselectricitygeneration,theexpansionofrenewable
energyandadditionalopportunitiesinenergyefficiencyputPennsylvaniaatthecenterofthe
cleanenergytransformationoccurringnationally.
ThesedevelopmentsmakePennsylvaniaanattractivestateforcleanenergyjobcreation
andinvestmentandwellpositionedforfuturecleanairandclimatechangeregulations.
Risinginstatenaturalgasproductionhashelpedkeeppowerpricesdownin
Pennsylvania,whilecoalfiredgenerationhasdecreasedandthestatehasbuiltmorethana
gigawattofnewrenewableenergycapacity,saidNathanSerota,BNEFAssociateforUSSolar
andEnergyEconomics,andcoauthorofthereport.Atthesametime,theCommonwealthhas
beenhittingitscleanenergyandenergyefficiencytargetsinstride.
BNEFsanalysisnotesthatsustainableelectricitysourcesincludingnaturalgas,small
hydroandonshorewindarealreadyamongthecheapestoptionsforgeneratingelectricityinthe
state.Wastetoenergyandcombinedheatandpowerarealsocompetitive,basedontheanalysis
lowendranges.
From2010to2015,coalsshareofPennsylvaniaselectricitymixfellfrom48percentto
30percent.
Meanwhile,naturalgashasbeenthefuelofchoiceforbuildingnewpowerplantsinthe
Commonwealth,accountingfor81percentofcapacityadditionsbetween2000and2015andthe
gasificationofthestatespowersectorissettocontinue.
Apotentialdriverofadditionalnaturalgasdemandmaycomefromcombinedheatand
power(CHP)plants,asapolicytoencourageinvestmentinCHPiscurrentlyunderconsideration
atthePublicUtilityCommission.
BNEFsreportwasdevelopedinpartnershipwiththe
BusinessCouncilforSustainable
Energy

BNEFhighlightedseveralkeysustainableenergypoliciesintheKeystoneState.
Pennsylvaniahasamandatoryalternativeenergyportfoliostandard(AEPS)requiring8
percentofretailsalestocomefromTierIrenewableresourcesby2021,BNEFnotes,adding
thatIn2015,renewablesprovided4percentofinstategeneration,justbelowthe2015interim
targetof5percentofretailsales.

BNEFalsopointstotheCommonwealthsEnergyEfficiencyResourceStandard(EERS),
notingthatenergyefficiencyspendinghasresultedinallofthestatesutilitiesachieving
2TWh/yrcumulativelythroughMay2015,withreportedbenefitcostratioof1to1.64and,
statewide,utilitieshavealreadyposted93percentoftheenergysavingsneededtomeettheir
mandatory2015EERStarget.

ThismarksthefirstofseveralproceduralnotificationsExelonwillmakeinthecoming
monthstoinformregulators,gridoperatorsandstateagenciesoftheplantretirements.
Exelonannouncedplanstoclosetheplantsearlierthismonth,giventhelackofprogress
onIllinoisenergylegislation.TheClintonPowerStationinClinton,Ill.,willcloseonJune1,
2017,andtheQuadCitiesGeneratingStationinCordova,Ill.,willcloseonJune1,2018.
Weworkedformorethantwoyearstofindasolution,butnowitistimetotakethe
necessarystepstoretiretheplants,saidChrisCrane,ExelonpresidentandCEO.Weare
committedtoworkingwithallstakeholderstoensuretheplantsareshutdowninaresponsible,
safeandtransparentway.
QuadCitiesandClintonhavelostacombined$800millioninthepastsevenyears,
despitebeingtwoofExelonsbestperformingplants.
Employeeswillsafelyoperatethefacilitiesuntiltheretirementdates,withstaff
transitionsexpectedwithinsixmonthsafterretirement.Exelonemploysnearly700workersat
Clintonand800workersatQuadCities.
Retiringthesestationswillhaveasignificanteconomicandenvironmentalimpactonthe
region.Theplantssupportapproximately4,200directandindirectjobsandproducemorethan
$1.2billionineconomicactivityannually.Astatereportfoundthatclosingtheplantswould
increasewholesaleenergycostsfortheregionby$439millionto$645millionannually.

Vanessa,whotragicallylostherlifeonDecember26,2014.
ArecentgraduatefromWestChesterUniversitywithadegreeineducation,Vanessawas
passionateabouttheoutdoorsandlovedexploringthelakes,rivers,andforestsoftheregionwith
herfriendsandfamily.
TheConservancyestablishedthisscholarshipinVanessasmemoryandtohonorher
dreamofbecominganeducator.

Thehikingdistancedoesntdiffermuchbetweenthetwo,butthesteeperoneisalittle
rougher,alittlerockier,andalotwetter.Whicheverroutetheychoose,hikerswillbegladthey

LehighCountyandNewHanoverTownshipinMontgomery

Countyaftersmallpopulationsofthepestwerefound.
Themostrecentdetectionsareinmunicipalitiesadjacenttopreviouslyquarantinedareas.
ThepesthadnotbeenfoundintheUnitedStatespriortoitsinitialdetectioninBerks
Countyinthefallof2014.
Whilenoonewantstohearthatthereareadditionalfindings,thisaffirmsthatour
surveillanceeffortsareworking,saidAgricultureSecretaryRussellRedding.Itisextremely
difficulttoeradicatethesepestsbutthankstotheongoingsurveyeffortsandcommitmentby
local,state,andcommunitymembers,whohavebeenworkingtogethercontinuouslytofindthe
pestintheearlystages,weareminimizingtheimpactofthespecies.Newdetectionsallowthe
controlprogramtotargetitsoutreachandcontrolefforts,workingtoendthespreadofthe
insect.
Areaswherethepesthasbeenfoundarenowunderquarantine.Thegeneralquarantine
restrictsmovementofanymaterialorobjectthatcanspreadthepest.
Thisincludesfirewoodorwoodproducts,brushoryardwaste,remodelingor
constructionmaterialsandwaste,packingmateriallikeboxes,grapevinesfordecorative
purposesorasnurserystock,andanyoutdoorhouseholdarticleslikelawnmowers,grills,tarps
andotherequipment,trucksorvehiclestypicallynotstoredindoors.
ThelastdetectionofthepestwasconfirmedinNovember2015.
Inadditiontothenewareaswheretheinvasivehasbeenfound,thequarantinealso
includes:

surveyworkbeganMay1,2016toidentifyadditionalchallengesandimprovementswiththe

Eightcrewsand34volunteershaveplacedmorethan2,200bandsonAilanthustrees,
removingmorethan14,000eggs.Todate,39propertieshavebeentreatedinthequarantinearea,
removingmorethan3,300Ailanthustrees.

BusinessesinthegeneralquarantineareaneedtoobtainaCertificateofLimitedPermit
fromthedepartmentinordertomovearticles.LocalDepartmentofAgricultureinspectionstaff
canworkwithbusinessestoensuretheyarecomplyingwithquarantinerestrictions.
Criminalandcivilpenaltiesofupto$20,000andprisontimecanbeimposedfor
violationsbybusinessesorindividuals.
TheSpottedLanternflyisaninchlongblack,redandwhitespottedpestandisnativeto
China,India,JapanandVietnam.ItsaninvasivespeciesinKorea,whereithasattacked25plant
specieswhichalsogrowinPennsylvania.

SpottedLanternfly,Lycormadelicatula,attacksgrapes,apples,pinesandstonefruits.It
oftenattachestothebarkofTreeofHeaven(Ailanthusaltissima),aninvasivespeciessimilarto
Sumacthatcanbefoundaroundparkinglotsoralongtreelines.
Adultsoftenclusteringroupsandlayeggmassescontaining3050eggsthatadhereto
flatsurfacesincludingtreebark.Freshlylaideggmasseshaveagreywaxymudlikecoating,
whilehatchedeggsappearasbrownishseedlikedepositsinfourtosevencolumnsaboutaninch
long.
TreesattackedbytheSpottedLanternflywillshowagreyorblacktrailofsapdownthe
trunk.
AllPennsylvaniansareencouragedtowatchfortheSpottedLanternflyandofferedthe
followingsuggestions:
DuringthemonthsofJulythroughDecember,whentheadultsareactive,conductaquick
inspectionofyourvehicleanytimeyoumoveinornearaquarantinearea,tofindanyspotted
lanternflyhitchhikers.
Ifyouseeeggsontreesorothersmoothoutdoorsurfaces:Scrapethemoff,doublebagthem
andthrowtheminthegarbage,orplacetheeggsinalcoholorhandsanitizertokillthem.
Ifyoucollectaspecimen:First,placethesampleinalcoholorhandsanitizerinaleakproof
container.Then,submitthespecimentoyourcountyPennStateExtensionofficeortothe
departmentsEntomologyLabforverification.Dontmovelivespecimensaround,evenwithin
