SPECIAL PROCEEDING NO. 12345 FOR: PROBATE OF WILL AND ISSUANCE OF
LETTERS TESTAMENTARY

The petitioner through undersigned counsel, and to this Honorable Court respectfully alleges:
1. That petitioner is a Filipino citizen, residing at 77 Woodville Street, Alaminos City,
Pangasinan, Philippines and the sister of the deceased CANDIDA R. CRUZ;
2. That the petitioner has been appointed by the testator as sole executor, to which the
petitioner consents to;
3. That on December 10, 2015, CANDIDA R. CRUZ died in Alaminos City, Pangasinan,
Philippines;
4. That on January 1, 2015 she executed a notarial will in English, a language known to her. A
copy of said notarial will is hereto attached as Annex A, as her last will and testament;
5. That the deceased left properties, both real and personal, with an estimated value of three
million pesos (3,000,000 php);
6. That he left as his only heirs the herein petitioner, MARIA FLOR , her sister, and DAISY, her
mother, both surnamed REYES, both of legal age, and residents of 77 Woodville Street,
Alaminos City, Pangasinan, Philippines;
7. That letters testamentary are prayed for MARIA FLOR, who is named as the sole executrix in
the will.

PRAYER
WHEREFORE, it is respectfully prayed that, after due notice and publication, this Honorable
Court fix the date for the probate of said will and that letters of testamentary be issued in favor
of the herein petitioner and thereafter the properties of the deceased be adjudicated in
accordance with the said will.

VERIFICATION AND CERTIFICATION

I, Maria R. Cruz, of legal age, single and a resident of #77 Woodville Street, Alaminos City,
Pangasinan under oath, depose:
I am the petitioner in the foregoing proceeding; that I caused the preparation of the foregoing
Answer; that I have read its contents; and that the same are true and correct of my own direct,
personal knowledge.
Further, pursuant to Rule 7 of the 1997 Rules of Civil Procedure and existing Supreme
Court circulars, I hereby certify that I have not heretofore commenced any other action or
proceeding involving the same issues in the Supreme Court, the Court of Appeals, or any other
tribunal or agency; that to the best of my knowledge, no such action or proceeding is pending in
the Supreme Court, the Court of Appeals, or any other tribunal or agency; and that if I should
hereafter learn that other similar or related actions or proceedings has been filed or is pending
before the Supreme Court, the Court of Appeals, or any other tribunal or agency, I undertake to
report that fact within five (5) days therefrom to this court.
