Agreement

Lease Deed
This deed for lease, orally contemplated on November 01, 2015 is now reduced in
writing between parties and shall abide by the terms and conditioned mentioned
within:
Sri Biswanath Panda, H/o Sibani Satpathy aged about 54 years residing at 751/2724
south side of kalinga stadium Nayapalli, Bhubaneswar-751012,PSNayapalli,Bhubaneswar, Orissa, being the owner of the house hereinafter called the
(Lessor/Assignee) on the FIRST PART
And
Sri Muralidhara Nayak S/o Sri Manager Nayak aged about 36 years being the
partner of M Care, resident of Krishna Apartment, Plot Number 201, Dolamundai,
B.K.Road, Cuttack,Orissa, hereinafter called the lessee on the SECOND PART

Item-1

That, the description of this property is shop number B-1


in (Basement Floor) at
Janpath Tower
situated at Unit-2 Ashok Nagar Bhubaneswar-751009 Dist
Khurda about 600 sq.ft. (Approximately) belonging to the lessor
Sri Biswanath Panda

Item-2

That, whereas, the lessee approached the lessor to lease the


above mentioned property on these terms and conditions have
now been embodied in these lease deed.

Item-3

That, whereas, the offer of the lessee, has been found to be


acceptable to lessor, on those terms and conditions mutually
agreed upon and for which, the terms and conditions are now
being embodied under TERMS AND CONDITIONS as below:

TERMS AND CONDITIONS OF THIS AGREEMENT/ OR LEASE DEED WITNESSETH AS


FOLLOWS
CLAUSE-1

That, the lease shall be for a period of 5(Five) Years,


effective from November 01, 2015 and shall end on October 31,
2019.

CLAUSE-2 (a)

The monthly rent will be directly payable by the lessee by


cash/cheque to the lessor. According to the following schedule:
November 01, 2015- October 31 2016 -Rs 17,000 Per month
November 01, 2016- October 31 2017 -Rs 18,000 Per month
November 01, 2017- October 31 2018 -Rs 19,000 Per month
November 01, 2018- October 31 2019 -Rs 20,000 Per month

(b)

CLAUSE-3

The monthly maintenance charge as stipulated by the


management of Janpath tower is paid directly by the lessee to
the management of the janpath tower and the monthly rent is
not inclusive of the maintenance charges.

That, the Municipality tax of the said premises as payable in the


Municipal Administration, Bhubaneswar, and as well, with any
rise in between the aforesaid period of occupation shall be paid
by the lessor.

CLAUSE-4

That, the monthly rent shall be payable regularly by the first


week of the next month.

CLAUSE-5

That, the monthly rent shall not be adjusted against the security
deposit.

CLAUSE-6

That, in case of late payment after the first week of the month
there will be a late fee charge of Rs200.00 (Rupees Two hundred
only).

CLAUSE-7

That, in case of the return cheque from the bank due to any
reasons there will be a fee of Rs. 500.00 (Rupees Five hundred
only).

CLAUSE-8

That, in case of any default in the payment of the rent to the


lessor, for any consecutive two months, the tenancy of the
lessee shall be terminated. On the beginning of the third month,
the lessor will take the possession of the premises without any
further notice to the lessee and it is accepted that the lessee has
offered the consent to the lessor of disposing the belongings for
the settlement of all dues.

CLAUSE-9

That, This security deposit of Rs 1,00,000 (Rupees One Lakhs


only) is paid by the lessee to the lessor and it shall be refunded
to the lessee without any interest, in case there is no
outstanding dues of any nature as related to this as related to
this premises against the lessee at any time of the vacation of
the rented premises.

CLAUSE-10

That, the lessee shall not sublet either a part or whole of the
premises to any party under any circumstances.

CLAUSE-11

That, the normal minor maintenance of the premises including


the electrical will be undertaken by the lessee. The lessee will
keep the rented premises in proper upkeep, without any damage
to the walls or any installations.

CLAUSE-12

That, in no case the lessee will be allowed to carry out any


objectionable, unlawful or illegal activity inside the premises at
any point of time.

CLAUSE-13

That, the lessor or his representative shall be entitled to inspect


the rented premises during any working period of the day, if so
desire.

CLAUSE-14

That, the lessee is not entitled to carry out any construction


and/or alteration of the structure of the premises without
approval from the lessor. Any change made to the structure
without proper approval from the lessor, the lessee will bear the
total cost to bring the structure back to its original shape.

CLAUSE-15

That, the lessee will pay the electrical energy consumption


charge of the premises, regularly in time, as stipulated by the
appropriate supplying agencies (presently, CESU, Bhubaneswar)
without fail and with the lessee responsibilities.

CLAUSE-16

That, lessor is not responsible for any physical injury, loss of life
and/or personal belongings of the lessee due to fire. The lessee
may obtain an insurance policy or similar policy at his/her own
expense insuring lessees contents against fire, flood, vandalism,
theft, damage due to termites, natural calamity and any other
liabilities.

CLAUSE-17

That, the said premises will be vacated on a five months notice


by either side with any appropriate notice in writing and the
same will be counted from the date of the official
acknowledgement taken thereof by the other party.

CLAUSE-18

That, in case of breach of any of these terms of this deed by the


lessee the lease shall be rightfully terminated.

CLAUSE-19

That, after the expiry of the period of the lease, or in the event
of the leases earlier vacation on those terms and condition of
the agreement, the lessee will put back the lessor in smooth
possession of the said premises with restorations rendered in its
full shape, as was existing at the time of hand over.

CLAUSE-20

That, the lessee is being given the option, to keep this lease
renewed for any further period, on these terms and conditions of
this agreement, however, with the fixation of a fresh rent for
hiring
the
said
premises
along
with
the
use
of
conveniences/fittings to be mutually agreed upon and provided
that such an option of renewal is exercised by the lessee at least
2(two) months before the expiry of the lease deed and in which
case the rise in the rent structure shall be decided mutually.

CLAUSE-21

That, on the expiry of this period of this lease or in any event of


any earlier vacation, occurring in terms of this lease agreement
before the stipulated expiry of this lease period, the lessee will
vacate the said premises immediately on its notified date.
Falling to vacate the premises, the lessee considered to be the
trespassers to the said premises and shall be liable to pay the
compensation which shall not be less than Rs 1,000/- (One
Thousand only) per day.

CLAUSE-22

That, whereas, a list of articles (electrical fittings and public


health fittings a separate list enclosed in this agreement) being
handed over at the time of occupation and to be in the custody
of the lessee in working condition. In case of any loss or damage
to the said articles, the lessee shall have to repair good the
damages or pay the cost of the missing items, failing which, the
above cost is to be deducted from the security deposit money.

Clause-23

That, whereas, in the event of any dispute, in respect to the


lease deed the same shall be settled by mutual reasoning or by
the arbitrator appointed by mutual consent. In case, the dispute
is not settled as above, the same shall be subject to the
jurisdiction of the Bhubaneswar Court only for settlement.
