ORDER AND JUDGMENT *
Before SEYMOUR, McKAY, and BRORBY, Circuit Judges.
After examining the briefs and appellate record, this panel has determined
unanimously that oral argument would not materially assist the determination of
this appeal. See Fed. R. App. P. 34(a)(2); 10th Cir. R. 34.1(G). The case is
therefore ordered submitted without oral argument.
pleading guilty to illegal re-entry into the United States after deportation in
violation of 8 U.S.C. 1326 (a) and (b)(2). The district court sentenced Mr.
Mendias-Chavez to sixty months in prison. The district courts sentencing
calculation included a sixteen-level enhancement for Mr. Mendias-Chavezs prior
conviction of an aggravated felony. See 8 U.S.C. 1326(b)(2); United States
Sentencing Guidelines Manual 2L1.2(b)(1)(A). We have jurisdiction pursuant
to 28 U.S.C. 1291 and affirm.
