Dear Mr. Trevithick,
This is in response to your 21 June 2016 Freedom of Information Act (FOIA) Request.
‘Your request was received on 22 June 2016, assigned cases number 2016-03480-F and seeks the
followin;
“Amy reports, briefings or correspondence the individuals tasked with preparing this
infographie used to obtain the data presented therein.
~ Any additional comespondence between those individuals and the relevant parties at
388th Fighter Wing or any other element consulted during the preperation of this
infographic.”
The Air Combat Command Public Affairs office found five pages of responsive records
which are attached. In each of the five pages, names have been redacted using FOIA Exemption
6 to protect the privacy of individuals involved.
FOIA Exemption 6 permits an agency to withhold information contained within
“personnel and medical files and similar files the disclosure of which would constitute a clearly
unwarranted invasion of personal privacy.” See S U.S.C. § $52(b)(6): NARA v. Favish, $41 US.
157. 171 (2004); DOJ v. rters Comm., 489 U.S. 749, 773-75 (1989). The term "similar
files" is broadly interpreted, sueh that Exemption 6 protects fiom disclosure all information that
“applies to a particular individual” in the absence of a public interest in disclosure. Dept of State
xv. Washington Post Co.. 456 U.S. 595, 602 (1982). Accordingly, it is not the nature of the files in
‘which the information is contained, but rather the balance of public and private interests that
determines the Exemption's scope. Washington Post. 456 U.S. at 599-600.
Department of Defense $400.7-R_AFMAN 33-302, indicates that fees be assessed for
processing this request: however, fees are not assessed in this instance.Ii you interpret this “partial denial” response as an adverse action, you may appeal it in
viting to the Secretary of the Air Force or submit your appeel on line at the Air Force's Public
Access Link: https://www.cfoia.af mil/palMain.aspx. The appeal must reference your FOIA case
mumber and must provide your reasoning for the appeal, If writing, your appeal should be
postmarked no later than 90 calendar days from the date of this letter. Address your letter as
