have not been given a final. The occupant says he owns various properties locally and manages them doing the work

Complainant states that the alleged violation can be viewed from the public park area at the rear of property. Inspector
may also contact him for additional information and access.
. 04/06/15 1st Inspection. Violation Verified. Observed structure from side walk and neighboring front setback. A man
stepped out of address 3539 and introduced himself as David Hector (415) 971-1133. David Hector referred to the
structure as an enclosed patio and sunroom. He mentioned the structure had been previously inspected by inspector
Hugo Barron and he said it was okay to continue its use without a building permit. I mentioned that typically enclosed
structures over 120 sq ft require a building permit but that I would research on any possible exemptions for enclosed
patios and sunrooms. He informed me he held to the option to reduce the structured size to 120sq ft. Mr. Hector also
mentioned there was an active litigation against his neighbors for harassment and gave to me a copy of supporting
documents. He also indicated his discontent with the City of Oakland progress on an open case two houses over. I
informed him I had little to no knowledge of the history of previous cases in his neighborhood. I assured Mr. Hector I
would do the research necessary before submitting a result my inspection. He then informed me of his plans to take
down the structure completely since he plans to build a 2nd unit in its location and is submitting plans for review in 2-3
weeks. I said I didnt see a reason for him to take it down if he already has plans to build the addition. And that it
would probably be pointless to even send out a notice. Michael Hector was aggravated by this statement quickly lost his
temperament and threatened me with a lawsuit if I attempted to send out a violation notice. I noticed he
misunderstood my statement and so I attempted to correct the situation but Mr. Hector was angry refused to accept
my explanation.
4/6/15 Unable to verify if unapproved structure is encroaching onto public park area. Property lines are not identifiable.
Also noted unapproved open storage of construction materials and other miscellaneous objects. Last active building
permit expired 2014. Open storage violation will be reviewed by E.Labayog before submittal. In 2013 there was a
Demolition permit for a detached garage which mentioned plans to create a patio. Our system doesn't show required
approvals, permits or inspections for the construction of the structure.
4/8/15 Mr. Hector contacted me through a phone call requesting my e-mail. He also asked to know the extent of my
research for 3539 Calandria Ave prior to my 1st inspection. I informed him that prior to a 1st inspection research time is
limited since I must be at my 1st inspection by 10:30am, and that research is typically done after if a violation is
observed as needed, if needed. He also falsely accused me of using a violation notice as threat and that I ordered him
to take down the structure. I explained and clarified any misunderstanding of my statement and I also apologized for
any unintentional miscommunication by my part. He acknowledged he is known to have a short temperament and he
apologized for making a poor assumption of the situation. He claimed the City of Oakland was in part responsible for his
behavior and that due to a long history of harassment he is likely to jump to conclusions Later that morning he sent
out an email to the building department heads still accusing me of ordering the demolition of his covered patio. He also
complained there should have been more research done on the properties prior to my 1st inspection.

Comment I.Ramirez removed from case by M.Taylor. 5/15/15 Received a call from Mr. Hector asking if I have received
his emails. I informed him M.Taylor has taken over the case. And that any new complaints must be make to the hotline
so they can create a case and schedule them for inspection
7-14-15 During the meeting in our office on Wednesday July 8 2015. Mr. Hector agreed to allow myself and Tim Low to
come to the property located at 3539 Calandria Ave. to inspect the concrete retaining walls between the properties of
3539 Calandria and 3529 Calandria to verify the height and possible surcharge. Also, we may possibly verify the
property line from the markers that he mentioned. I called Mr. Hector today around 10:45 AM to schedule an
appointment for July 15, 2015 and he stated that he spoke to his his wife after the meeting with our department and
they decided to oppose the inspection. He said that they feel that they are still being singled out by the City. He also
said that he did not have the actual survey, the neighbor next to him has it and they placed the markers. E. Labayog

9-11-15 Site inspected with Robert Walker, owner removed rear structure. Owner claims that he is doing work that
does not require permits. He has construction items stored in the open areas for the projects.

Spoke to Mr. Hector by phone and invited him file a Violation Appeal. He was not please with my answers regarding the
violation notice Inspector Barron issued him. He felt the inspector and I misused our authority in issuing him a Notice of
Violation for Blight and a deteriorated front lawn retaining wall.
9/12/14 : met the owner Mr. Hector verified that no violation in the construction of cmu walls , less than 4' and apart
more than 4' no surcharge was created, monitoring inspection for the rear open porch that was enclosed with windows
and doors to be used as a tool shed, owner stated that will submitt whithin the next month plans for a rear addition
and that temporary tool shed will be removed.
10/1/14: supervisor wilson, mnspector barron and park services manager brian carthan met today to discuss this case.

4/1/15 :The case was closed because a new complaint has been filed with an inspection to follow up. At the time of my
first inspection on 9/12/14, the complaint was about trash, debris and a front block retaining wall: these were all
abated at a later time by the owner. Concerning the detached structure seating at the rear: it appeared to me that was
an open porch which was enclosed with the purpose of storing building materials since the house was being remodeled.
For that reason the owner was not notified and also the owner mentioned that his intention was to submit plans to
expand his house and that detached structure will be used for the same purpose.
