This matter comes before the court on the emergency motion of plaintiffsappellants for an injunction pending appeal. They seek to enjoin all activity relating to
the Albuquerque Rapid Transit (ART) project on Central Avenue in Albuquerque, New
Mexico, pending their appeal. The Federal Transit Administration and the City of
Albuquerque are directed to file responses to the motion by 4:00 pm MDT on Tuesday,
August 2, 2016. The City is specifically directed to include in its response information
on the nature and timing of any demolition or construction related to the ART project that
is planned between now and the close of business on Wednesday, August 10, 2016.

In the meantime, to allow the court sufficient time to review the parties motion
and responses, the court temporarily enjoins defendants-appellants from taking any action
on the ART project until further order of the court.
