On July 5, 2016, at approximately 1009 hours, Deputy Bustamante was dispatched to 140 Barwick Road, Debary (Florida Power and Light power

plant) in reference to a suspicious person taking photos and refusing to leave.

While enroute to the location, Deputy Bustamante located a male meeting the description provided on the corner of S. Charles R. Beall and

Barwick Road. Deputy Bustamante and Deputy Richardson made contact with a white male who had a multiple cameras on his person. Subject

was asked if he had been at the power company taking photos at which he stated he was across the street taking photos and indicated it wasn't

against the law to take photographs. Subject was advised it was not illegal to take photographs however it was suspicious due to the location.

Deputy Bustamante asked the subject if he could provide deputies with his identification so we could positively identify him. Subject became

passive aggressive stating he wasn't refusing to provide his name but he would give it to deputies if he was going to be arrested. Subject

12

continued to state it wasn't against the law for him to take photographs as he was across the street and not on the property. Subject continued to

13

refuse to give deputies his name or a form of identification upon request only stating he was a free lance journalist. Upon asking if he had any

14

credentials proving who he was at which point he stated no, that he had no form of identification on him. Subject continued to ask if he was being

15

detained as he had not committed a crime at which point Deputy Bustamante advised the subject he was being detained until deputies completed

16

the investigation regarding who he was and what he was doing at the power plant. Subject continued to refuse to provide identification and stated

17

he wish to speak to the supervisor. Deputy Bustamante advised him a supervisor would be contacted and enroute to speak to him. While deputies

18

waited for Sgt. Ford subject continued to speak to his Facebook audience via his camera on his glasses, and GoPro camera asking to have them

19

contact his attorney as he was being detained illegally. Subject was informed again he was being detained until deputies could positively identify

20

him and the investigation was concluded. Sgt. Ford arrived shortly on scene and spoke to the subject who identified himself as "Jeff". After briefly

21

conversing with "Jeff" the subject was released by Sgt. Ford.

Deputy Bustamante made contact with Karl Arndt (R1), the security guard from FPL, who stated the following: The male subject was observed

24

across the street photographing the power plant which they are not allowed to do. Arndt walked up to him and advised him to please leave and

25

even offered to give him a packet with information and some photos of the power plant but the subject refused only stating it wasn't illegal to take

26

photographs. After being asked to leave subject refused to leave the area, causing Arndt to contact their control room and subsequently the

27

sheriff's office. Arndt advised after he went back to the guard shack to call control about the subject he noted the subject had left and upon going

28

back out to the road to see where he had gone to he noticed a black SUV head west on Barwich. Arndt believed the subject had parked the

29

vehicle just north west of the power plant but still within the power plant property but couldn't confirm it as he didn't really see the vehicle there.

Due to the subject's demeanor, and refusal to leave the property upon requested Arndt and his supervisors requested law enforcement to be

31

contacted an a report completed. Arndt completed a sworn written statement indicating his accounts of the incident.

Deputy Bustamante made contact with Sean Chase (R1), the Production Manager at FPL, who stated he was concerned about the subject taking

34

photographs of the power plant and his hostile demeanor towards the security guard upon being asked to leave. Chase advised due to the current

35

events around the world, they are in heighten security when it comes to suspicious persons in the area photographing the location. Chase

36

requested a report be completed so they could document the incident. Chase was advised to update his "No Trespassing" signs and placing

37

others in areas that normally don't have them but belong to FPL so law enforcement could enforce them.

Deputy Bustamante was later informed by Sgt. Ford the subject's name was Jeffrey Marcus Gray (O1). No further action taken by Deputy

Bustamante. Report completed to document the suspicious person.

On 08-08-2016, at approximately 1016 hours, Deputy Richardson responded to Florida Light and Power plant, located at 140 Barwick Road,
Debary in reference to the report of a suspicious person.
Upon arrival, Deputy Richardson made contact with a white male at the intersection of S Charles R Beall Blvd and Barwick Road. The male told
Deputy Richardson he was taking pictures of the Florida Power and Light plant and asked if he was committing any criminal acts. Deputy
Richardson informed the male that taking pictures from a public area did not violate any criminal statutes. Deputy Richardson explained to the
male that however, it raises suspicion due to the area in what he was taking pictures of, and that was why deputies were talking to him. Deputy
Richardson asked if the male had his identification with him, and the male told him he did not and did not wish to provide deputies with his name
and information. Deputy Richardson informed the male that as a law enforcement officer he was requesting the male to identify himself, which
again he stated he did not want to provide his information to deputies and asked if he was free to leave. Deputy Richardson explained to the male
he was not free to leave due to him not provided deputies with his name. The male told deputies he was recording the encounter which was being
uploaded and streamed in real time to a social media page. The male further inquired about the deputies BWC and informed them he would be
requesting a public release of the deputies BWC footage. The male claimed that he was being unlawfully detained by law enforcement. Deputy
Richardson further more advised the male of his Constitutional Rights, which he advised he understood and did not wish to answer any questions.
Sgt Ford later responded to the scene upon the males request to speak to a supervisor. Upon Sgt Ford's arrival, the male identified himself as
"Jeff" and exchanged a handshake. After speaking with Sgt Ford for a few minutes the male was advised he was free to leave in which he did.
Sgt. Ford was later able to fully identify the male as Jeffrey Gray, via the DAVID system after obtaining his vehicle information while leaving the
area in which Gray was contacted.
No further action was taken by Deputy Richardson.

On 08-05-16, Sgt Ford was contacted by Deputy Bustamante to respond to the area of 140 Barwick Rd., which is the site of Florida Power And
Light power plant. Sgt Ford responded to the area and observed Deputy Bustamante and Deputy Richardson talking with a male on the sidewalk
at the intersection of Hwy 17/92 and Barwick Rd.. Deputy Bustamante apprised Sgt Ford of the situation. Sgt Ford met with this male on the
sidewalk area and introduced himself as Sgt Ford and the male introduced himself as Jeff and a handshake was exchanged. Sgt Ford informed
the male that the reason that deputies were dispatched and the fact that the power plant was considered a critical infrastructure area. Sgt Ford
asked the male if he was willing to provide his last name and he refused. During this conversation the male was asked if he was free to leave and
Sgt Ford told him he was free to leave.
During this contact with the male, Sgt Ford asked the male if he was recording Sgt Ford if he was recording Sgt Ford and he stated he was. Sgt
Ford informed this male that if he was recording Sgt Ford without consent this was against the law.
Sgt Ford observed this male get into a vehicle across the street and then drive this vehicle north bound on Hwy 17/92. Sgt Ford also departed the
area north bound on Hwy 17/92 and observed that the male was the driver and sole occupant of the vehicle Sgt Ford observed the license plate
of the vehicle to be L075NI. Sgt Ford informed VCSO Dispatch of the license number and requested registration information in an effort to further
identify this male. At that time emergency traffic was put out on the radio and Sgt Ford's request was delayed. Sgt Ford then returned to VCSO
District 6 and utilized DAVID system and checked the registration information based on the license number. The vehicle came back registered to
Jeffrey Marcus Gray. Sgt Ford viewed the DAVID photo of Gray and observed that it was the same male that he had previously been in contact
with. Sgt Ford provided this information to Deputy Bustamante so she could identify this male in her Incident Report that she was going to
prepare.
