SECTION I: INSTRUCTIONS TO APPLICANTS

A. General
1. Scope of
Application

1.1. This Prequalification Invitation document as indicated in


Section II, Application Data Sheet (ADS), is issued by Dubai
Municipality hereinafter
The Employer to Applicants
interested in tendering for the Scope of Works for project
DS233- Deep Tunnel Stormwater System Contract 233-03,.as
described in Part 2 Work Requirements.

2.1. The Scope of Works is funded directly by the Government of


Dubai and Dubai Municipality.

3. Corrupt &
Fraudulent
Practices

3.1. The Employer requires that Applicants observe t h e highest


standard of ethics during the procurement and execution of
the scope of works. In pursuit of this policy, the Employer:
(a) defines, for the purposes of this provision, the terms
set forth below as follows:
i.

Corrupt Practice shall mean the offering,


giving, receiving, or soliciting of anything of value to
influence the action of a Public Official in the
procurement process or in contract execution; and

ii.

Fraudulent
Practice
shall
mean
a
misrepresentation of facts in order to influence a
procurement process or the execution of a contract
to the detriment of the Employer, and includes
collusive practices among Applicants (prior to or
after tender submission) designed to establish
tender prices at artificial, non-competitive levels and
to deprive the Employer of the benefits of free and
open competition;

(b) may, at its sole discretion, reject a proposal for


prequalification if it determines that the Applicant
recommended for prequalification has engaged in Corrupt
or Fraudulent Practices in competing in the Tendering
processes for these works.

4. Eligible
Applicants

4.1. An Applicant shall be locally registered civil engineering


contractors or joint ventures (which may include a locally
registered civil engineering contractor and an international
tunneling contractor (refer to Section III.C.1 for further
requirements).
4.2. Prequalification will be based on a combination of pass-fail
criteria along with a scoring system of the Applicants
qualifications as demonstrated by the Applicants responses
in the attached Prequalification Application Submission Sheets
and other requested documentation. Specific requirements for
joint ventures are also set forth in Section III, Qualification
and Short-List Criteria. The Employer reserves the right to
waive minor deviations from the criteria, if they do not
materially affect the capability of an Applicant to perform the
work.
4.3. The Applicant that is under a declaration of ineligibility by the
Employer in accordance with ITA 3.1, as at the date of
submission of the Prequalification Application or thereafter,
shall be disqualified.
4.4. Government-owned entities in Dubai shall be eligible only if
they can establish that they are legally and financially
autonomous, and operate under commercial law, and that they
are not dependent agencies of the Employer.
4.5. Applicants shall provide such evidence of their continued
eligibility satisfactory to the Employer, as the Employer shall
reasonably request.
4.6. The Applicant (including all members of a joint venture and
design consultant) must not be associated in a working
relationship with the consultant or any other entity that has
prepared the design, specifications, and other pre-qualification
and bidding documents for the Project, or with an entity that is
proposed as Engineer for the Contract. Any such association
may result in the disqualification of the Applicant.
4.7. If any conflict of interest or potential conflict of interest between
Applicants, their subcontractors or advisers and those of the
Employer becomes apparent, Applicants shall immediately
inform the Employer, when the Employer shall, at its absolute
discretion, decide on the appropriate course of action. If the
Employer becomes aware of any conflict of interest or potential
interest that the Applicant has not declared to the Employer, the
Employer may at its absolute discretion disqualify the Applicant
from consideration.

5. Eligible Goods
and Related
Services

5.1. In preparation of the Prequalification Document Applicants shall be


aware of and observe the Government of Dubais rules and
regulations.

B. Contents of the Prequalification Document

6. Sections of
Prequalification
Document

6.1. The document for the prequalification of Applicants (hereinafter,


Prequalification Document) consists of Parts 1 and 2 which
comprise all the sections indicated below, and should be read in
conjunction with any addenda issued in accordance with ITA 8.

Section III: Qualification and Short-List Criteria
Section IV: Application submission sheet and Forms

PART 2. Works Requirements


This Section contains a description of the work, the construction
period definition, and a drawing to indicate the scope of the project.
6.2. The Employer accepts no responsibility for the completeness of
the Prequalification Document and its addenda unless they were
obtained directly from the Employer.
6.3. The Applicant is expected to examine all instructions, forms, and
terms in the Prequalification Document and to furnish all
information or documentation required by the Prequalification
Document.
7. Clarification of
Prequalification
Document

7.1. Applicants requiring clarification of the Prequalification Document


shall contact the Employer in writing at the address indicated in
the ADS. The Employer shall respond in writing to any request for
clarification provided that such request is received no later than
ten (10) days before the deadline for submission of Applications.
The Employer shall communicate to all Applicants full details of
the clarification but without identifying its source. Should the
Employer deem it necessary to amend the Prequalification
Document as a result of a clarification, it shall do so following the
procedure outlined in ITA 8 and in accordance with the provisions
of ITA 17.2.

8. Amendment of
Prequalification
Document

8.1. At any time prior to the deadline for submission of Applications,


the Employer may amend the Prequalification Document by
issuing Addenda.
8.2. Any Addendum issued shall form part of the Prequalification
Document and shall be communicated in writing to all
Applicants.
8.3. To give prospective Applicants reasonable time to take an
addendum into account in preparing their Applications, the
Employer may, at its discretion, extend the deadline for the
submission of Applications.
C.

Preparation of Applications

9. Cost of
Applications

9.1. The Applicant shall bear all costs associated with the preparation
and submission of its Application. The Employer shall in no case
be responsible or liable for those costs, regardless of the conduct
or outcome of the preliminary proposal prequalification and shortlist process.

10. Language
of
Application

10.1. The Application as well as all correspondence and documents


relating to the Prequalification exchanged by the Applicant and the
Employer, shall be written in the language specified in the ADS.
Supporting documents and printed literature that are part of the
Application may be in another language, provided they are
accompanied by an accurate translation of the relevant passages
in the language specified in the ADS, in which case, for the
purposes of interpretation of the Application, the translation shall
govern.

11. Documents
Comprising
the
Application

11.1. The Application shall comprise the following:


a. Application Submission Sheet, in accordance with ITA 12;
b. Documentary evidence establishing the Applicants eligibility to
prequalify, in accordance with ITA 13;
c. Documentary
evidence
establishing
the
qualifications, in accordance with ITA 14; and

Applicants

d. Any other document required as specified in the ADS.


e. Commercialization of the Application is to be avoided.

12. Application
Submission
Sheet

12.1. The Applicant shall prepare an Application Submission Sheet


using the forms furnished in Section IV: Application submission
sheet and Forms. These forms or documents (e.g. CV) shall be
completed without any alteration to the format.

13. Documents
Establishing
the Eligibility of
the Applicant

13.1. To establish its eligibility in accordance with ITA 4, the


Applicant shall complete the eligibility declarations in the
Application Submission Sheet and Forms ELI 1.1 and 1.2,
included in Application submission sheet and Forms.

14. Documents
Establishing
the
Qualifications
of the
Applicant

14.1. To establish its qualifications to perform the scope of works in


accordance with Section III, Qualification and Short-List Criteria,
the Applicant shall provide the information requested in Section
IV, Prequalification Application Submission Sheet and Forms.

15. Signing of the


Application

15.1. The Applicant shall prepare the documents comprising the


Application as described in ITA 11. Application shall be typed
or written in indelible ink and shall be signed by a person, or
persons, duly authorised to sign on behalf of the Applicant. In the
case of JV, all Parties must sign the documents.

D.

Submission of Applications

16. Uploading and


Identification of
Applications

16.1. The Applicant shall upload the application on DM online system


and bear the specific identification of this prequalification as
indicated in the ADS (ITA 1.1).

17. Deadline for


Submission of
Applications

17.1. Applications shall be received by the Employer online no later


than the submission closing date as indicated, in Section II ADS (ITA 17.1).
17.2. The Employer may, at its discretion, extend the deadline for the
submission of Applications by amending the Prequalification
Document in accordance with ITA 8, in which case all rights and
obligations of the Employer and the Applicants subject to the
previous deadline shall thereafter be subject to the deadline as
extended.

18. Late
Applications

18.1. Any Application received by the Employer after the deadline for
submission of Applications prescribed in ITA 17 shall be
rejected as non-compliant t o D M and shall remain unopened.

19. Opening of
Applications

19.1. The Employer shall prepare a record of the opening of


Applications, and this shall include, as a minimum, the name
of the Applicant. A copy of the record shall be kept by the
Employer.
E.

20. Confidentiality

Procedures for Evaluation of Applications

20.1. Information relating to the evaluation of Applications, and


recommendation for prequalification, shall not be disclosed
to Applicants or any other persons not officially concerned with
the prequalification process until the notification of the
outcome of the prequalification process is made to all
Applicants.
20.2. From the deadline for submission of Applications to the time
of notification of the results of the prequalification in
accordance with ITA 28, any Applicant that wishes to contact
the Employer on any matter related to the prequalification
process, may do so, but only in writing.

21. Clarification
of
Applications

21.1. After the Application submission closing date, the Employer


may ask any Applicant for a clarification. The Applicant
shall submit its reply within three (3) calendar days from
receipt of the clarification request, or by the date and time set
in the Employers request for clarification. Any request for
clarification and all replies shall be in writing.
21.2. If an Applicant does not provide the clarification as
requested within three (3) days after the clarification date or
by the date and time set in the Employers request for
clarification, its Application may, at the sole discretion of the
Employer, be rejected as non-compliant.

22. Responsiveness
of Applications

23. Domestic

24. Subcontractors

22.1 The Employer may reject any Application which does not address
the requirements of the Prequalification Document.

23.1. Unless otherwise specified in the ADS, a margin of preference


for domestic Applicants shall not apply in the tendering process
resulting from this prequalification.

24.1. Applicants planning to sub-contract any of the key


activities indicated in Section III, Qualification and Short-List
Criteria, shall specify the activity or parts of the scope of works
to be sub-contracted in the Application Submission Sheet and
clearly identify such activities and the proposed specialist subcontractor(s) in Form ELI-1.2 in Section IV. Such proposed
specialist sub-contractor(s) shall meet the corresponding
qualification requirements specified in Section III, Qualification
and Short-List Criteria.
24.2. The Employer does not intend to let contracts for certain
specific parts of the scope of works with contractors selected
in advance by the Employer. That is, there will be no
Nominated Contractors, unless otherwise stated in the ADS.

F.

Evaluation of Applications and Shortlisting of Applicants

25. Evaluation of
Applications

25.1. The Employer shall use all the factors, methods and
criteria defined in Section III, Qualification and Short-List
Criteria to evaluate the qualifications of the Applicants and any
specialist sub- contractors. The Employer reserves the right to
consider other factors or waive minor deviations in the
qualification criteria if they do not materially affect the
capability of an Applicant to perform the scope of works.
25.2. Only the qualifications of specialist sub-contractors that have
been identified in the Application may be considered in the
evaluation of an Applicant. However, the general experience and
financial resources of sub-contractors may not be added to
those of the Applicant for purposes of prequalification of the
Applicant.
25.3. Unless otherwise indicated in the ADS, this Prequalification
Document shall be for a single contract of DS233 -03- Deep
Tunnel Stormwater System project.

26. Employers
Right to Accept
or Reject
Applications

26.1. The Employer reserves the right to accept or reject any


Application, and to annul the Prequalification Process and reject
all Applications at any time, without thereby incurring any liability
to the Applicants.

27. Prequalification
and Short
Listing of
Applicants

27.1. Applicants whose applications have met or exceeded the


specified threshold criteria shall, to the exclusion of all others, be
prequalified by the Employer. The Employer reserves the right
to invite a short-list of qualified Applicants to Tender.

28. Notification of
Short Listing

28.1. Once the Employer has completed the evaluation of


the Applications, it shall notify all Applicants in writing of the
names of applicants who have been prequalified

29. Invitation to
Tender

29.1. After the notification of the results of the prequalification, the


Employer shall invite three or not more than four Tenders from
the short-listed Applicants that have been prequalified for the
scope of works.

29.2. Tenderers shall be required to provide tender security


acceptable to the Employer in the form and in the amount
specified in any subsequent tender documents. Also, the
successful tenderer shall be required to provide a performance
security in the form and in the amount specified in any
subsequent tender documents.
29.3.
30. Changes in
Qualifications of
Applicants

30.1 Any change in the structure or formation of an Applicant after


being prequalified in accordance with ITA 27, and invited to
tender for the project shall be subject to written approval of the
Employer. Such approval shall be denied if, as a consequence of
the change, the Applicant no longer substantially meets the
qualification criteria set forth in Section III, Qualification and
Short-List Criteria, or, if in the opinion of the Employer, a
reduction in qualifications lowers the ranking of the Applicant.
Any such changes shall be submitted to the Employer not later
than fourteen (14) calendar days after the date of the Invitation to
Tender.

31. Submissions

31.1. Applicants must limit their submissions to the minimum required


pages in their application. This page limit does not apply to
attachments specifically requested in the Application
Submission Forms, such as Articles of Incorporation or
independently audited financial statements. Where provisions
are made for the answers, they must be typed in the relevant
boxes/space provided in this document. No additional
attachments are permitted other than any specific information
requested (for example the audited financial information, etc.).
31.2. All written Applications, submissions, questions, queries,
communications and the like between Applicants and the
Employer must be in English. Applicants must answer all
questions as accurately and concisely as possible, and
monetary values must be stated in Arab Emirates Dirhams
(AED). Failure to furnish the required information, make a
satisfactory response to any question or supply required
documentation will have an impact on the Applicants score
or the Applicant may not be invited to participate further.

SECTION III. QUALIFICATION AND SHORT-LIST CRITERIA


A.

General
This section identifies the qualification and short-list criteria and compliance
requirements that the Employer shall use to evaluate the Prequalification
Applications. The associated application forms are contained in Section IV of this
Prequalification Document. To be prequalified, an Applicant must demonstrate to the
Employer that it substantially satisfies the requirements regarding experience,
personnel, financial position and litigation history, specified herein.
The following terminology and definitions shall apply when used in conjunction with
these qualification criteria:

(a)

Main Contractor defined as the chief contractor who will enter into a direct
Design-Build contract with the Employer for a project and who will have full
responsibility for project completion. A main contractor undertakes to perform
a complete contract, and may employ (and manage) one (1) or more
subcontractors to carry out specific parts of the contract.

(b)

Lead Partner the party nominated by the Joint Venture as the lead entity of
the partnership.

(c)

Design Engineer the lead design engineer who will complete the final
design for the project and is a sub-contractor to the Main Contractor.

(d)

Minimum value is either the total contract value, when the Applicant was
acting as a sole contractor, or the share of the total contract corresponding to
its share of the Joint Venture participation when the Applicant was a member
of a Joint Venture team.

(e)

The last ten (10) years this shall be understood as the period commencing
on 1 January of the year ten (10) years prior to the current year up to the
deadline for submission of the Applications.

C.

Qualification Criteria
The Applicant shall meet the following criteria which supplement the compliance
requirements listed in the Compliance Summary Table in Section III, Subsection B.

1. Eligibility
(a)

Applicants shall meet the eligibility criteria given in the compliance summary
table.

2. Licenses and Registrations


(a)

Applicants should also be registered in one of the professional or trade


registers in the country of their principal place of business and relevant to
the nature of this prequalification.

(b)

Applicants should note that in addition to successful prequalification they will


be required to meet all mandatory registration and license requirements in the
Emirate of Dubai at the time of award of contract. For such registration
requirements, kindly contact Contract and Purchase Department (CPD). DM
will, upon request, provide whatever assistance and support it can to facilitate
and escalate such registration and license application. Successful bidder
shall not be considered for the award of Contract unless the registration
process is completed.

3. Declaration
(a)

Where an Applicant represents an existing Joint Venture or has formed a


new Joint Venture for a project, evidence of a pre-tendering agreement for
the Joint Venture will be required.
The points noted below summarise the requirements for Joint Ventures and
the parties within Joint Venture agreements, with reference to the other
subsections of Section III.

(b)

For Joint Ventures, the Lead Partner, undertaking more than 40% of the
contract value and other partners must each satisfy the respective
minimum qualification requirements, indicated under Section III,
Subsections B and C.
The Joint Venture must satisfy collectively the criteria for personnel
capability and financial position stated.
Individual partners must each satisfy the requirements for audited balance
sheets and litigation.
The full physical requirements for comparable nature and complexity shall
be met collectively by the Joint Venture.

4. Historical Contract Non-Performance


(a)

(b)

History of Non-Performing Contracts: The Applicant shall provide accurate


information that non-performance of a contract did not occur within the last
f i v e ( 5 ) years prior to the deadline for Application submission based on
all information on fully settled disputes or litigation. A fully settled dispute
or litigation is one that has been resolved in accordance with the dispute
resolution mechanism under the respective contract and where all appeal
instances available to the Applicant have been exhausted.
Failure to Sign Contract: The Applicant shall provide accurate information
regarding its failure to sign a contract after submitting a tender security and
certify that this has not occurred in the past five (5) years. Any deviation should
be explained in the referenced application form.

(c)

Litigation History: The Applicant shall provide accurate information on any


current or past litigation, arbitration, mediation or adjudication resulting from
contracts completed or under execution by him over the last f i v e ( 5 ) years.
A consistent history of settlement awards against the applicant or any partner
of a joint venture may result in failure of the application.

5. Financial Situation
(a)

The audited financial statement for the last f i v e ( 5 ) years shall be


submitted and must demonstrate the soundness of the Applicant's
financial position, showing their long-term profitability. Where
necessary, the Employer will make inquiries with the Applicant's bankers.

(b)

Based on its audited financial statements for the last five (5) years, the
Applicant shall submit Statement of cash flows to demonstrate a sound
cash and cash equivalent.

(c)

Based on its audited balance sheets, the Applicant shall demonstrate


the current soundness of the Applicants financial position and its
prospective long term profitability as measured by their average
coefficient of Current Ratio (Current Assets/Current Liabilities). The
Current Assets/Current Liabilities ratio shall be 1.5.

(d)

Based on its audited balance sheets, the Applicant shall demonstrate


the current soundness of the Applicants financial position and its
prospective long term profitability as measured by their average coefficient
of Debt Ratio (Total Debt/Total Assets). The Total Debt/Total Assets ratio
shall be 0.66.

(e)

The Main Contractor or the combined parties comprising the Joint


Venture shall have a minimum average annual construction turnover
(defined as billing for works in progress and completed) over the last
five (5) years of AED 3500 million.

6. Experience
(a)

The Applicant shall demonstrate its technical expertise and its


successful track record in completing projects similar in scope of work as
delineated in Part 2, Section V of this Prequalification Invitation, within the
last ten (10) years, for which the Applicant had overall delivery
responsibility. The last ten (10) years shall be understood as the period
commencing on 1 January of the year t e n (10) years prior to the
current year up to the deadline for submission of the Applications.

(b)

The Applicant shall submit full details of projects using the experience
requirements and guidelines presented in the following table for projects
that the Applicant considers to be similar in nature to Deep Tunnel
Storm Water System project scope, using Forms EXP 6.1 and EXP
6.2.

(a)

The Applicant must clearly demonstrate its ability to assign competent


personnel to the contract and that they possess relevant experience on
past projects similar in scope and size to the Contract, as delineated in
Part 2, of this invitation.

(b)

To demonstrate its understanding of the staffing requirements of the


project, the Applicant shall submit a project organisational structure in the
form of a diagram with explanatory notes as required in Form EXP 7.1.
The organisation structure should:

Identify key positions

Identify specific roles and a brief list of responsibilities of each position

Show lines of Employer and reporting relationships,

Identify key positions to be held by each Joint Venture partner


(if applicable)

To demonstrate the Applicants compliance with these criteria, the


Applicant shall submit professional Curricula Vitae (CVs) for staff who meet
the stated requirements for the key positions presented in the following
Key Personnel Table who have the following responsibilities as
summarized below:
The Principal-In-Charge will be the executive with responsibility for
monitoring the Project performance and relationship with the
Employer.

The Project Manager who will have overall responsibility for design
and construction of the Project.

The Project Engineer who will be a liaison between the Design


Manager/Engineer of Record, construction team, and Employer.

The Quality Control System Manager who will be responsible for


delivering a quality project and compliance with the Tender
Documents.

The Project Design Manager/Engineer of Record who will be


responsible for final design and key design activities and decisions
for the Project.

The Lead Geotechnical Tunnel and Shaft Design Engineer who will
be responsible for the final design of the tunnels and shafts as well
as review of ground conditions relative to the design during
construction of the underground works.

The Construction Manager Tunnel/Shaft who will be responsible


for implementation of the design during construction and
construction activities for the underground works.

The Construction Manager Civil who will be responsible for


implementation of the design during construction and construction
activities for the near surface works.

The Equipment Manager/Superintendent who will be responsible for


setting up, operating and maintaining critical construction
equipment, including the tunnel boring machines, excavated
materials handling systems, ventilating systems, water treatment
systems, and maintenance

The Safety Engineer or Officer who will be responsible for overall


site safety.

The Construction NOC Engineer who will manage the permitting


process and will act as a liaison between the public agencies,
private property owners, the Employer and the DB Team.

(d)

For specific positions essential to implementation of this project,


Applicants shall provide the name of the candidate qualified to meet the
specific requirements stated for the positions included on Form EXP 7.2.

(e)

For each key position presented in the Key Personnel Table, the Applicant
shall supply information (in Form EXP 7.3) on each candidate who
should meet the experience requirements specified in the key personnel
table.

8. Project Assurances
(a)

The Employer requires that all work undertaken on its behalf is carried out
safely for all parties and with particular regard to the welfare and wellbeing
of its employees and workers when operating on sites and other areas
under the management of the Design-Build Contractor. The Applicant shall
state how it will allocate adequate resources to enable it to fulfil its statutory
obligations for Health, Welfare and Safety. In this regard, the Applicant
shall provide evidence in the form of an existing written Health, Welfare &
Safety Policy and Plan and shall provide the information requested on
Form HSE 8.1. Additionally, the Applicant shall provide details of their
requirements for internal welfare arrangements or external welfare
arrangements where it draws on significant labour from labour agencies
within the Emirate of Dubai and its plan to address the lack of skilled tunnel
labour in the Emirate of Dubai.

(b)

The Employer additionally is committed to ensure a high quality of life for


Dubais citizens by protecting the environment and by delivering its services
in a way that respects the earths natural ecosystems. The Employer aims
to work with its contractors and suppliers to help them improve their
environmental performance and ensure that, when working for the Employer,
they adopt equivalent environmental standards. The Employer therefore
expects its contractors to show evidence of their commitment to the
environment by having an environmental policy, which has been endorsed,
at the highest level in the company. As a minimum, the Applicant must
demonstrate that it has an established and written Environmental
Management Policy and provide the information requested on Form HSE
8.1.

(c)

The Employer expects its Design-Build contractors to demonstrate their


commitment to maintaining a rigorous Quality Management System, which
is endorsed at the highest level in the company. As a minimum, the
Applicant must provide evidence of any quality certifications that it
possess and to provide the information requested on Form QM 8.2.

9. Resources, Plant & Equipment


(a)

The Applicant is to provide evidence that it possesses, or has access to,


sufficient qualified resources and equipment, available, or who will become
available if the Applicants tender is successful, to deliver the project for
which i t seeks Prequalification. In this regards, as a minimum the
Applicant must provide the information requested on Form RS 9.1.

10. Management Approach


(a)

This series examines the Applicants approach to the management of similar


contracts. The Applicant is therefore required to answer the management
approach questions included on Form MAQ 10.1.

(b)

Submit a description of the design-build teams concepts for managing the


stormwater design and construction of the Project which demonstrate the
Applicants understanding of the objectives and challenges of this project. Do
not include statements that commit the team to any particular design or
construction approach. Rather, describe how the DB team would be

structured to best manage their activities and satisfy the needs of the Project.
The following shall be included as a minimum in the proposed conceptual
management plan:

A discussion of how the design and construction processes interface


and how the proposed organization will function (e.g., design,
construction, procurement, and quality control) as an integrated
design-build team.

A discussion of the work elements that are critical to the Projects


success and how the team plans to manage and address these
elements.

A discussion of how the disputes and disagreements among the


Proposers team will be resolved.

A discussion of the most significant risks inherent in the Project, both


design and construction, and how the team plans to manage the work
to mitigate these risks.

The intended approach or plan for establishing and maintaining


quality control in prosecuting the work, both design and construction.

The proposed conceptual management plan shall be limited to fifteen (15) pages.
D.

Preliminary Proposal Evaluation Process

The Preliminary Proposal (prequalification) process is intended to enable Proposers to


demonstrate their qualifications to perform the Project and enable Dubai Municipality to
evaluate those qualifications in arriving at a shortlist of firms to whom Requests for Final
Proposals will be issued. Preliminary Proposals should include specific information that will
demonstrate the Proposers qualifications and experience relevant to the Project
requirements. The format for the presentation of such information is described in Section I.
It is not the intent of Dubai Municipality to receive Project-specific design or engineering
recommendations as part of the Preliminary Proposal.
Preliminary Proposals will be evaluated to determine whether the design-build team has met
the minimum requirements specified as indicated in Section III. The Preliminary Proposals
from teams that meet the minimum eligibility requirements will then be evaluated and ranked
based on the design-build teams qualifications and plans in the categories described below.
The relative weight of each category is also provided.

The qualifications and performance history of the design-build team in completing other
recent, similar projects - 30%.

The professional qualifications and experience of the key individuals of the design-build
team to be assigned to the Project - 25%.

The conceptual management plan of the design-build team approach to manage the
design and construction of the Project 35%.

The safety programs established and the safety performance of the design-build JV
partners or major firms - 10%.

Dubai Municipality reserves the right to conduct an independent investigation of any


information, including prior experience, identified in an Initial Proposal by contacting project
references, accessing public information, contacting independent parties, or any other

Proposer during the evaluation of the Proposers Initial Proposal.
E.

Final Proposal Evaluation Process

A Request for Final Proposals (RFP) will be extended to the design-build teams that are
selected as finalists during the Preliminary Proposal phase. These finalists will be provided
with detailed requirements for the preparation and submittal of the Final Proposal comprised
of technical and price proposals. These requirements will include identification of specific
criteria for design and construction of the Project.
The Dubai Municipality will prepare a Geotechnical Baseline Report (GBR-B) defining
anticipated geotechnical conditions for tunnel and shafts. The report will be provided in the
RFP and may be modified during the Final Proposal development process (GBR-C).
Final Proposals must be responsive to the criteria identified in the RFP. Proposers will be
given a reasonable amount of time to understand the preliminary design and contract
requirements before confidential collaboration meetings with each team will be held to
discuss the technical aspects of the work thoroughly and establish an environment that
supports innovative approaches by each DB team and to seek clarification and suggest
changes to the criteria prior to submission of the Final Proposal.
Final Proposals will be evaluated for aspects that are judged to be fundamentally
incompatible with the Project objectives, including those that are considered exceptionally
risky or likely to cause Project failure. Final Proposals that are deemed unlikely to meet the
following minimum criteria may be deemed nonresponsive and rejected without further
evaluation:

Provisions for a safe working environment

Provisions for adequate prevention and control of water intrusion to underground work
spaces

Successful completion of the Project in an acceptable time frame

Compliance with environmental stipulations and permit conditions

The criteria and respective weighting for each criterion to be used in the Final Proposal
selection process will be provided in the RFP. While the Dubai Municipality reserves the
right to adjust the criteria and relative weights at any time prior to issuing the RFP, it is
anticipated that Final Proposals will be evaluated in accordance with the following general
criteria and percentage weighting for each criterion:

Proposed Price (45%). The total proposed price to deliver the completed Project,
including without limitation design, equipment, materials, labor, project management,
administration, overhead, and profit.

Design and Construction Plan (45%). The plan for design and construction of the
Project, including development of the design drawings and specifications and definition
of the means, methods, techniques, sequences, and procedures of construction, in
sufficient detail to establish the basis for the proposed price. This plan should describe
the Project elements in sufficient detail and clarity, with drawings and specifications, to
confirm the locations, shapes, dimensions, durability, and reliability of the tunnels,
shafts and the other various elements proposed to be constructed to meet the Project
requirements. This plan also should define practical and effective means to control

water intrusion to underground work spaces, define the intended method for TBM cutter
head interventions, define excavated material handling and disposal processes, define
the intended method of temporary support and achieving water tightness of shafts,
define the intended method for interconnection of adjacent construction shafts if
required,, the connection between at Sheikh Zayed Road construction shaft (Contract
DS 233-02) at Interchange No. 10 with the Contract DS233-03 construction shaft
adjacent to, and other relevant and significant design or construction activities.

Management Plan (10%). The management plan to be applied by the design-build


team members, vendors, and subcontractors in accomplishment of the Project. This
plan should describe the details of the teams organizational structure, identify a clear
and logical schedule for key activities, demonstrate an understanding of the schedule
critical path for the Project, explain how the Project will be coordinated with construction
of the pumping station, power supply facilities, and other associated facilities, explain
how impacts to existing Dubai Municipality operations will be avoided, describe work
site safety procedures, identify hazards and actions to mitigate risks associated with the
details of the proposed design and expected geologic conditions, provide for
compliance with all environmental stipulations and permit conditions, and describe
quality control procedures.

Evaluation may include interviews with Proposers to clarify understanding of the Final
Tender Proposal.

SECTION V. SCOPE OF WORKS


1. Description of the Works
Introduction
Last decade, before the 2008 economic crisis, Dubai has experienced an unprecedented
boom. The industrial, commercial and residential real estate sectors have expanded at a
rapid pace. Due to the speed and scale of this development, Dubai Municipality (DM) did not
take direct control of the entire associated infrastructure. Rather, Dubai expanded through a
combination of development projects that remained under the responsibility of DM as well as
private developers.
The economic crisis of 2008 led to a slowdown in the development of Dubai. Many
developments grounded to a complete halt. Post crisis, development has resumed although
at a slower pace. In order to reflect the changing scenarios in the master plan, DM decided
that it was an appropriate time to produce a new Master Plan for Dubai to the year 2025. The
current Master Plan provides for improvement of stormwater management across the emirate
of Dubai. The DS233 Deep Tunnel Storm Water System (DTSWS) has been proposed to
collect and convey storm water from the DWC area and adjacent communities to the sea.
Scope of Work
DTSWS is intended to collect and convey groundwater and stormwater runoff from the DWC
area (about 135 km2) and adjacent communities (about 245 km2). In addition, the emergency
Treated Sewage Effluent (TSE) from the Jebel Ali Sewage Treatment Plant (JA STP) will
also be conveyed by the system to be discharged through a sea outfall. The overall Project
layout of the project is shown in Figure 1. The main components of the project are
conveyance tunnels, construction and drop shafts, a network of pipelines, connecting
chambers to the shafts, a terminal pumping station, detention pond and lifting station and a
sea outfall. The project as presently envisioned is divided into four (4) design-build tender
packages. The tender packages are:

Contract DS 233-01
Pumping Station (30m3/s capacity), a screen and gate
structure (Construction Shaft), an overflow structure and an approximately 600m long
sea outfall, consisting of three 2000mm outfall pipes.

Contract DS 233-02
Main Tunnel along D-53 road, minimum 9m diameter tunnel
approximately 12,000m long; and five (5) construction / drop shafts; and connection
chambers at the shafts (for future pipeline connections DS233-04, by others).

Contract DS 233-03
Lateral Tunnel along Shaikh Zayed Road and Jebel Ali
Lehbab Road, minimum 9m diameter tunnels, approximately 11,150m long; five
construction / drop shafts; one shaft for trenchless connections, and connection
chambers at the shafts (for future pipeline connections DS233-04, by others).

Contract DS 233-04
Pipelines, a network of 1m 3m diameter stormwater
pipelines, approximately 125 km in total pipe length which will connect to the deep
tunnels (DS233-02, DS233-03) and 1m 2.4m diameter TSE pipeline approximately
104 km in total length and a 95 ha detention pond and associated 3 m 3/s lift station.

The proposed works under this design-build tender package; Contract DS 233-03, as
mentioned above consist of the following key elements:

10 at Sheikh Zayed Road

Near surface structures connected to shafts

Tunnel will convey the stormwater and groundwater flows from the DWC area at the
intersection of Sheikh Mohammed Bin Zayed Road and Jebel Ali Lehbab Road (DWC north
outfall) and follow beneath the road easement along the Jebel Ali Lehbab Road and Sheikh
Zayed Road (SZR) terminating at SZR Interchange no. 10. The Tunnel connects to the main
tunnel (separate contract, DS 233-02) to the sea at the SZR IC 10 (intersection of D-53 and
Sheikh Zayed Road).
The current design has been prepared to the preliminary design level. Final design is to be
carried out by the design-build contractor and shall include, but not limited to:

Additional geotechnical investigations

Hydraulic design

Physical modelling of the drop shafts.

Preparation of GBR-C

Tunnel and construction shafts design and construction

Drop shaft structures design and construction

Connecting Structure design and construction

Gate design and construction to regulate flows

Instrumentation and controls for the conveyance system

Detailed specifications and drawings

Environmental Impact Assessment

Environmental protection and mitigations

Construction and Final No Objection Certificates (NOCs)

All supporting calculations and details shall be provided for approval.


All materials are to be provided by the design-build contractor.

PRE-QUALIFICATION DOCUMENT FOR PROCUREMENT OF DESIGN BUILD CONTRACT
CONTRACT DS233-03 LATERAL TUNNEL

Description of the Works to be undertaken


I.

Site Investigations
Additional site investigations required to facilitate the Detailed Design and construction
of the system components as listed below.

II.

Tunnels
Each tunnel contract will require multiple TBMs. Construction and drop shafts will
connect to the tunnel. The design-build contractor is responsible for its means and
methods, however it is anticipated that the tunnels will be constructed using the TBM
method. The design-build contractor will design the construction (drop) and drop shafts.
The design and hydraulic performance of the tunnel and drop shafts shall be confirmed
by a physical model.
The short connections between the main tunnel and the lateral tunnel (Contract 233-03)
and the screen/gate structure (Contract 233-01) will likely be excavated using sequential
excavation methods.
In general, it is anticipated that the bored tunnels will be lined with precast segments
and shafts and the connecting tunnels will be lined with in-situ reinforced concrete.
Secondary lining may be required due to the corrosiveness of the groundwater, the
service life requirement, hydrostatic loads, and/or to prevent scouring, as needed. The
design-build contractor shall be responsible for the design of the lining systems.

III.

Disposal of Spoil
The design-build contractor shall make his own arrangements for the disposal of the
tunnel spoils or muck in accordance with environmental regulations.

IV.

Connecting Structures
Connecting structures will be required just below the ground surface to collect the flows
from the stormwater pipelines (by others) and to convey the flows into the drop structure.
Gates or weir structures will be needed to control flows entering the conveyance tunnels.

V.

Operation and Maintenance Manuals


Fully detailed Operation and Maintenance Manuals shall be provided by the design build
contractor for all equipment installed under this contract. Civil engineering works will
clearly describe the operation of all systems. The manufacturer and reference of all plant
and equipment for the various components of the system, the frequency and detail of the
inspections and maintenance of the system will be provided.
The items to be included in these manuals shall include but not necessarily be restricted
to the following:

Monitoring and control instruments and transmitters

Telemetry equipment

Tunnel inspection and inspection equipment
