Frederick Shuler, III, pled guilty to two counts of possession of crack cocaine
with intent to distribute and one count of possession of powder cocaine with
intent to distribute, 21 U.S.C.A. 841 (West 1981 & Supp.1996). He appeals
his 108-month sentence alleging that the district court clearly erred in
enhancing his sentence for possession of a firearm. United States Sentencing
Commission, Guidelines Manual, 2D1.1(b)(1) (Nov.1994). We affirm.
We therefore affirm the sentence. We dispense with oral argument because the
facts and legal contentions are adequately presented in the materials before the
court and argument would not aid the decisional process.
AFFIRMED.
Defense counsel proffered that Shuler bought the gun for his girlfriend's
protection. However, neither Shuler nor his girlfriend, who was present at the
sentencing hearing, testified about the matter
