Interim Security Arrangements

Substantive Provisions
1. This Agreement stipulates the measures and processes for bringing to a
permanent end the war in Yemen, and for ensuring the security and safety
of the population and state institutions, the avoidance of security vacuums,
and creating the conditions for the resumption of full and effective State
control ofthe security ofYemen.
2. The measures and processes include:
(i) the declaration and consolidation of the permanent end of the war;
(ii) the establishment of a National Military and Security Committee
(NMSC), and the governorate military and security committees
(GMSCs) identified in this Agreement, to exercise temporary
executive responsibility for security and oversight of security
forces in the relevant areas;
(iii) the withdrawal of militias and armed groups from the defined
locations; and
(iiii) the handover of medium and heavy weapons to the State.
Permanent end of the war
3. By signing this Agreement, the Parties hereby declare the formal and permanent
end of the war. The obligations in this Agreement shall therefore replace the
Cessation ofHostilities Agreement in Yemen (April2016) ("the CoH").
4. The NMSC shall ensure full compliance of any forces with this declaration, and,
in particular, the provisions of Annex XXX of this Agreement, which relates
to the regulation of the conduct of armed groups.
5. The NMSC shall take over the functions of the De-escalation and

Coordination Committee established under the CoH, which shall hand over
to the NMSC within 14 days of the signing of this Agreement. The NMSC
may create or task other committees to oversee, in any area, the compliance
of armed groups with the provisions of Annex XXX.
6. The NMSC or the Government of National Salvation (GNS) may extend the
CoH and its implementing mechanisms in an area as deemed necessary.
Preliminary Phase of Implementation
7. The implementation of this Agreement shall commence with a Preliminary
Phase, which shall run from the signing of this Agreement until the formation

8. During the Preliminary Phase, the NMSC shall ensure the implementation of the
interim security measures in Sana'a (Amanat al-Asima), Taizz and Houdeidah,
including withdrawals, and the surrender of heavy and medium weapons and
the establishment of GMSCs for those areas. This exercise shall be completed
within 45 days of the signing of this Agreement and shall be certified by the
Oversight and Follow-up Commission (OFC).
9. The NMSC may, in consultation with the ministries responsible for defence and
interior, establish further GMSCs to oversee security matters in additional
governorates, including al-Jawf and Maarib. In each case, the NMSC shall
specify the responsibilities and terms of reference of the committee in
accordance with the needs of the area.
Government of National Salvation and Security Matters
10. Immediately upon its formation, the GNS shall assume full responsibility and
oversight of all security matters in Yemen, including the effective
implementation of the security arrangements stipulated in this Agreement.
11. Within 14 days of the formation of theGNS, the NMSC and any GMSC shall
complete the handover of their functions and responsibilities to the relevant
ministries of the GNS and shall cease to exist unless the GNS determines that
the NMSC or a GMSC should continue to perform all or any of its functions.
12. The GNS shall develop an Integration Plan providing for the final status of
armed groups, including the integration or individuals into the national
military and security institutions, and the social and economic reintegration
of demobilised persons.

The National Military and Security Committee


Appointment and Composition of the NMSC
13. Immediately upon the signing of this Agreement, the President of the Republic
shall issue a decree establishing the NMSC. The decree shall specify the
members listed in this Agreement.
14. The NMSC shall have a Chairperson and XXX (an even number) of members
agreed upon by the Parties, two of whom shall be selected to act as Vice
Chairpersons to assist the Chairperson.
15. The chairperson and members of the NMSC are specified in Annex XX of this
Agreement.

16. The Chairperson and members of the NMSC shall:

(i) be respected Yemeni nationals who are serving or retired senior military
figures;
(ii) not have participated directly in military operations between September
2014 and June 2016;
(iii) be mutually acceptable to the Parties; and,
(iiii) demonstrate commitment to the objectives of this Agreement.
17. The Vice Chairpersons shall assist the Chairperson in carrying out his or her

duties, and shall, alternately, act in the place of the Chairperson when the
incumbent is unavailable.
18. The Special Envoy of the Secretary General ("the Special Envoy") or his or her

nominated representative shall attend NMSC meetings as an observer, and


may provide technical advice or guidance as required.
19. The ministers responsible for defence and interior, or their representatives,

shall attend meetings of the NMSC as non-voting members in order to ensure


coordination between the committees and the relevant ministries.
Tasks and Functions of the NMSC
20. The NMSC shall oversee the implementation of the security arrangements
stipulated in this Agreement, including the performance of the following
functions:
a) ensuring compliance with the declaration of the permanent end of the conflict;
b) developing interim security measures to ensure the safety and security of the

population and of state institutions in Sanaa (Amanat al-Asima), and to


eliminate military violence in the city;
c) creating and specifying the functions ofGMSCs;
d) developing a budget for its work and that of the GMSCs and submit these for
approval through the appropriate line ministry;
e) receiving, analysing and verifying reports of the GMSCs;
f) reviewing the compliance of any party with the plans and requirements for
withdrawal of forces, the handover of heavy and medium weapons and the
development of interim security measures and agree on specific actions to
ensure implementation;
g) reporting on the compliance with this Agreement to the OFC and the IGC,
through the Special Envoy; and,
h) undertaking other measures to build public trust and confidence in the
Agreement, and promote the safety and security of the population in the
Transition Period.
21. The NMSC shall serve as the principal mechanism for resolving all disputes
associated with security issues, including: military or operational difficulties,
complaints, questions or problems regarding implementation of the

withdrawal of forces, the handover of heavy and medium weapons and the
development of interim security measures.

Governorate Military and Security Committees

Composition ofGMSCs
23. The NMSC shall determine the membership and structure of each GMSC, in
accordance with the following criteria:
(i) members shall be respected serving or retired senior military figures
from within the governorate who are mutually acceptable to the
Parties;
(ii) a member of the GMSC must not have participated in the armed
conflict between September 2014 and June 2016; and,
(iii) the membership of a GMSC shall not exceed XXX persons.
24. The chairperson and members of the GMSCs of Taizz and Houdeidah are
specified in Annex XX of this Agreement. The chairperson and members of
any other GMSCs which are created prior to the formation of the GNS will be
determined by the NMSC .
General Provisions

25. Where a person is unable to assume, or continue in, their position of a


member of the NMSC or the GMSC, he or she shall be replaced in
accordance with the criteria identified in this Agreement. A member of the
NMSC shall be replaced by the OFC and a member of the GMSC shall be
replaced by the NMSC.

26. The NMSC and the GMSCs shall seek to prevent the resumption of military
clashes; defuse tensions between military groups; ensure that security
vacuums capable of being exploited by extremist groups are avoided and that
armed groups generally abide by their obligations to end permanently the
conflict.
27. Executive institutions of the state shall comply with the decisions of the NSMC
and a GMSC in the relevant area.

29. In order to ensure transparency, coordination and ownership the NMSC and the
GMSCs shall:
(i) consult with the ministries responsible for defence, interior and other
relevant ministries; and,

women.
30. The NMSC will have its headquarters in Sana'a, and may meet in any other
location as necessary. GMSCs shall be located in the relevant governorates.
Meetings and methods of work
31. The quorum for the NMSC shall be at least two thirds of the members. It shall
seek to take decisions by consensus. In the event that consensus cannot be
achieved, decisions shall be taken by a two-thirds majority of those present.
Where a decision cannot be taken by consensus or the requisite majority
cannot be achieved, the Chairperson of the NMSC shall inform the OFC of the
matter and the OFC shall endeavour to resolve the issues.

32. The same rules on decision-making shall apply to a GMSC, except that in the
event of a failure to reach consensus or the requisite majority, the chairperson
of the GMSC shall refer the matter to the NMSC.

RESTORATION OF STATE INSTITUTIONS

Guiding Principles for governance

1. The Parties are committed to restoring and ensuring the continuity of State
Institutions and increasing their functionality in the service of the Yemeni
people, based on the principles of national partnership, inclusivity, the
effective participation of women in government, and the promotion of the
national unity ofYemen.
2. In furtherance of this objective, the Parties shall ensure: the removal of any
hindrances or obstacles to the functioning of any State Institution; respect for
the legally established lines of authority in all state institutions; and,
adjustments to the composition of specified National and Governorate-level
institutions and ministries.
Governing during the Transition Period

3. A Transition Period shall commence upon the signing of this Agreement and
shall run until the national elections.
4. During the Transition Period, the Government of National Salvation (GNS) shall
be formed in accordance with the terms of this Agreement. The GNS shall
take office only upon the completion of the Preliminary Phase of the interim
security arrangements and the restoration and handover of state institutions as
specified in this Agreement, and as certified by the Oversight and Follow-up
Commission (OFS).
5. Prior to the formation of theGNS, the Government shall prioritize the smooth
functioning of Ministries and State Institutions at the National and
Governorate levels, the restoration of social services, the reconstruction of the
country, and revitalisation of the economy.
6. Prior to the formation of the GNS, the Government shall not make any decisions
which contravene the terms of the Constitution, undermine the implementation
of this Agreement, or which concern any matter relating to the roadmap of the
national elections or the completion of the draft constitution. These matters
shall be determined within the Political Dialogue provided for under this
Agreement.
7. Prior to the formation of the GNS, the decisions and actions of the Government

shall be in keeping with the Outcomes of the National Dialogue Conference,


as well as the GCC Initiative and its Implementing Mechanism.
Priorities in governing
8. In the conduct of Government business, priority shall be given to the delivery of
basic services to the people of Yemen, with a view to attaining the immediate

improvement in their living conditions and the long-term recovery of the
economy.
9. The Government shall work to ensure full and unhindered humanitarian access
and the safe return of internally displaced persons.
10. The Government shall mobilise international support for reconstruction efforts,
which will be implemented in an impartial manner throughout the country.
Restoration of the Functioning of State Institutions in Transition Period

11. The Parties shall ensure that the following measures are implemented in
accordance with timetable specified in this Agreement, which shalll take into
consideration plans for the implementation oflnterim Security Arrangements:
(a) All non-state actors, committees or other entities not established by the
constitution or applicable Yemeni law that might have taken over any
functions of Government ministries or other state institutions shall
desist from any further involvement or interference in the work of the
ministries or institutions, and shall vacate any state premises and return
public assets.

(b) The Parties shall respect the legally established lines of authority within
all ministries and state institutions.

(c) In implementing the above measures, disruption to government and


services shall be minimized, and that the effective handover of
administrative power, information, and assets shall be ensured.
The Status of Government Decisions

12. In order to minimize disruption to the functioning of the state, all


administrative decisions taken since September 2014 shall be provisionally
ratified, pending ministerial review to be conducted after the formation of the
GNS. Upon review, decisions may be confirmed, revoked or amended.
13. In order to minimize disruption to the functioning of the state and prevent
unfair treatment of state employees, the Parties agree to the provisional
ratification of all personnel decisions taken since September 2014 with the
exception of appointments of Minister, Deputy Minister and Wakeel levels as
well as of Governors and deputy Governors and dismissals of civil servants.
12.1. These measures will apply to all Ministries and State Institutions with
the exception of the Ministry of Interior, Defence and their
associated defence and security agencies and institutions. The
measures applicable to these ministries and institutions are specified
in the provisions of this Agreement relating to Interim Security

Measures.
14. Parties shall ensure that in the period from the signing of this Agreement until
the formation of the GNS the leadership of all ministries and state institutions
receives general acceptance. In order to ensure this, the Parties agree to respect
the list of Ministers, Deputy Ministers and Wakeel which are specified in this
Agreement.
15. Individuals who have been assigned any public function since September 2014
will be indemnified from civil legal liability arising from the performance of
those functions. The criteria, mechanisms and procedures for indemnification
shall be elaborated by the GNS. Until that time, no adverse action may be
taken against such individuals.
16. The independence and technical nature of the civil service shall be respected.
Public officials shall be protected against retribution or any other adverse
official action as a consequence of their service or activities during the period
of conflict.

Political Consultations and Dialogue


1. Upon the establishment of the Government National Salvation (GNS), an

inclusive Political Dialogue shall be held in Yemen consisting of a


series of concurrent consultations with the full participation of
political parties, women, youth and civil society.
2. The Political Dialogue shall determine and develop specific plans and
measures for completing the remaining steps of Yemen's peaceful
transition to a democratically governed state.
3. The Political Dialogue shall be completed within [ ... ] months and the
Conclusions shall be submitted to the National Body for endorsement..
Agenda of the Political Dialogue
4. The agenda of the Political Dialogue shall include the following issues:
4.1. The electoral roadmap, including:
(a) Sequencing of elections for the President, Parliament, and
Local Assemblies;
(b) Reform of the Supreme Commission of Elections and

Referendum; and
(c) Plans to revise the electoral lists.

4.2. Completion of the process for adopting a new Constitution,


including:
(a) Re-establishing national consensus on mutually acceptable
elements of the draft constitution;
(b) Agreement on the mechanism for redrafting the elements of
the draft constitution identified as requiring review; and
(c) Steps and requirements for completing the Constitutional
Process.

4.3. A review of the executive institutions which will oversee the


Transitional Period.

Reconciliation and Accountability measures and the


mechanisms for addressing the past, including any violations of
human rights during the transition period.

4.5. Addressing the Southern Question in a manner which meets the


aspirations of the people in the South and ensures that they
enjoy the full benefits of good governance. The South shall be
adequately represented in the Political Dialogue and the
National Body.
Participation in Political Dialogue
5. In accordance with the principle of inclusivity, the consultations on the
above elements of the political transition shall include representatives
of political parties and movements, Women and Youth groups, as well
as Civil Society representatives.
6. In order to ensure the continuity of Yemen's political transition, all
political parties and movements which were represented in the
National Dialogue Conference as well as other relevant parties and
groupings that have emerged since the conclusion of the National
Dialogue will be represented in the consultations.

Consistently with the Outcomes of the National Dialogue Conference,


the Parties shall ensure that women make up at least thirty percent
(30%) of the representatives in the consultations.

The role of the National Body


8. The conclusions of the Political Dialogue shall be submitted to the
National Body for review and endorsement.
9. Following its endorsement of the conclusions of the Political Dialogue,
the National Body shall transmit the conclusions to the Yemeni
Presidency, the Parliament and to the GNS, as appropriate, for
implementation.
